Alright. So most everything has been said before. I read the filing, skipping over several sections that were repetitive (there was a lot of it). So, here's my thoughts and observations.

I noticed he linked his psychological study, claiming it to be a causal effect once more, not a correlationary relationship as was explained. I'm pretty sure that the APA clarified through Dennis that is was not claiming causation. However, we all know Thompson doesn't believe what he doesn't like, as shown by his attitude the next day.

He's openly racist, hypocritical, and alarmist. His use of speech when describing "sexual" content he doesn't like (ie. kissing = homesexual sex, anal sex, etc.) is intended to shock. He brings in pages of quotes of important people, all unrelated to this series of events, in order to build up his own appearance. He repeatedly brings up violent crime that he claims as linked to violence in video games, no matter the game, in an attempt to legitimize his case, and demonize the entire industry.

His claim that media, industry groups, and even webcomics are in a grand conspiracy against him, all at the behest of T2 and their agents, is laughable. I doubt any of the groups will sue him over it. If anything, I could see them being called in as witnesses to define their relationship with Thompson. Penny Arcade would have quite the tale to tell.

His description of the harassment he has suffered is interesting. However, his listing is highly focused. T2 can easily wave it off as not their doing, no matter what. But I would enjoy them pointing out how some of those "deliveries" were in fact flowers from the gaming community, asking for an open dialogue, which he lashed out at.

Then, we come to the final page. The very end. Whereupon we discover how he could have a chance at winning this. He's requested a jury trial.

A jury of uninformed individuals, who would possibly be open to all Thompson's half-truths, outright lies, and libelious statements. Unless T2 does a significantly better job at highlighting all the holes in Thompson's "proof" and "experts", his case could possibly be seen as reasonable. If Thompson gets a good lawyer, and manages not to cut in with one of his rants, his case gets even better.

I sincerely hope that it does not go to a jury trial. I would much prefer to see an informed judge, one who knows what is legal and what is not, cut through the arguments. One who will do background research upon being given evidence by either party, and notice the inconsistencies. And one who will have no issue with telling Thompson not to try such blatant falsehoods with him after he's researched the issue.

Page 20 is rambling craziness. He fails to realize that they died to protect Take Two's rights to make the games as much as his rights to ramble like a crazy goat-man.

This man is just beyond all comprehension. He must really want that Dominoes Pizza Delivery Job to deep six his law career this thoroughly.

He is accusing all these websites because they cover all the stories he is involved in and "let" user's post negative and hateful remarks about him.

He also accuses them because he puts his home and work addresses and phone numbers in each of his posts and expects the websites to protect his private information.

He is not very bright when it comes to using the internet.

I made a post about Jack's hilarious 37 page rant, and originally I was just going to write a few paragraphs. Then suddenly it became a line-by-line rebuttal, and I know nobody wants to hear my boring nerd ass prattle on for a novel's length, so I stopped myself.

However... one thing I did notice was Jack's use of wording and phrases. Employing "murder simulator" "homosexual sex" and "harmful to minors" is clearly a sneaky way of trying to evoke a certain response from the reader. Maybe that kind of rhetoric is a common lawyer's common trick, I don't know.

I'm not sure how professional it is in legal circles to demonstrate racism in documents like this. Toward the end he accuses them of sending sex toys to his wife who has undergone cancer treatment! This is laying it on a little thick I think, and in the worst case is a libelous and slanderous accusation of harrassment. I do not condone this behaviour in any way, but perhaps Mr. Thompson should look at his own actions in making himself such a figure of ridicule and hatred when assigning blame for this. This is a man whose son dislikes him due to his behaviour, how does he think others are going to react when he stereotypes a massive section of the population and then lies about them and their passtime. This is a man who mocked and insulted a community who had lost a member due to suicide, I feel so sorry for his family that he has brought all of this upon them.

He refers to the Hot Coffee material as containing anal sex. I'm no expert on this subject or anything, but how can he tell? Any pictures I've seen have featured the non-anatomically correct models from the game (sometimes fully clothed) simply moving beside each other in a way that looks like sex. I believe that the reason he refers to it as anal sex in particular is that he wants people to believe it is disgusting and is probably hoping for some backwards bigot judge to equate it with (gasp) unholy gay behaviour!

I can't see this going anywhere. If complaint of conspiracy by Thompson was thrown out before, then this has no hope as it's an even grander, even more complicated and even more unbelievable accusation! Seriously, when people have had enough of you trying to harrass them and take action, and there are already (what is it, 6?) different complaints against you to be processed by the courts, and there exists a public record of all the stupid and offensive things you have done, the last thing you want to do is claim to be the victim of a grand conspiracy. There is a sound clip of JT stating he wants to take down T2. It's a nightline interview. Check it out on youtube you'll get a laugh out of it. Especially when you see that the interviewer is calling him out on some of his crap.

OK, I read most of this screed, particularly his countersuit claims and a few things jumped out at me.

According to him, the whole civil rights thig was when he was a "student mayor" whatever that is. Sounds like it was a college project. That to me hardly counts as being a Civil Rights crusader.

He repeatedly invokes the late great Ed Bradley, making it sound almost as if he was a personal friend of his (also trying to get sympathy on his side by mentioning his cancer including the "excrutiating pain" and fever). Other than JT's word, is there any evidence that he had a sympathetic ear w/ Bradley? Or that Bradley indeed agreed with him? based on JT's history of lying and exaggertion, however, I doubt it.

JT also makes much of his wife's illenss and that somehow Blank Rome knew about it, going as far as to accuse them of foreknowledge about this so they could deliberately serve the papers to his incapacitated wife and 14-year-old son, somehow knowing of her condition. Newsflash: having had experiernce with the court system, the court DOES NOT CARE what state you're in when they serve you your papers. They serve them when they want to, even if you're dead! ("Have you no decency" indeed! I recall myself on others asking that very same question of JT!)

Finally, JT makes it seem somehow that this is related to the impending purge of T2's board of directors, and that the stockholders plan to fire Blank Rome along with it. That this move is somehow some sort of last-ditch desperation ploy to "handle" him as he puts it. This sounds plausible, but how likely is it? As dissatisfied as the stockholders may be, i somehow doubt they'd throw the baby out with the bathwater and jettison Blank Rome as well.

Just a few points to ponder. Any thoughts?

I'm going to read this before I offer a "proper" opinion, but my first reaction to the highlights above is acute disbelief.

It's hard to tell whether JBT actually thinks this is a reasonable series of accusations to make, or whether he's just trying to be as outlandish as possible in order to draw attention to what he sees as T2's shaky legal ground.

Either way, it's a pretty ambitious list of claims and it'll be interesting to see how Blank Rome (and any judge(s) called to hear this nonsense) react.

People keep saying that if he were taken out in one way or anothe; be it disbarrment or what have you, that this would somehow make him a martyr. I need to ask, a martyr for WHAT?!

Most people who martyr themselves do it with the assumption that someone else will be inspired enough to take up their cause in their place, picking up where they left off. Somehow, I don't see that happening with JT.

It's clear by now that no one likes him. Whatever allies he once had have been alienated by his behavior. What little he has left, like the Peaceoholics or the Eagle Forum, are fringe groups which hold very little influence. He's made many enemies in the judicial system, his fellow lawyers regard him either as a joke or an embarassment, he's burned bridges with several politicians (depsite his statements to the contrary) and even the press is starting to get tired of his antics as word spreads of how crazy and unprofessional he is.

If he going to be a martyr, he'll be a very lonely one, and I don't see many who would be eager to replace him, much less be as shrill or as crazy as he is. The only one I can think of off the top of my head would be Dave Grossman, but he's pretty much dropped out of sight and doesn't seem eager to come back.

As games continue to become more accepted as mainstream enterainment, become more ubiquitous and more politicians are sarting to come around to the fact that they may not be so harmful after all, JT's point of view becomes less and less relevant. If anything he's becoming percieved more like Don Quixote; tilting at windmills he thinks are giants while everyone else comments about how crazy he is. If he were to be taken out tomorrow, I don't think many tears will be shed, and that most will say he had it coming. In fact, I can only see the dialogue improving if he were removed from it, as we would no longer have to put up with his lies and be distracted by his histrionics.

Most likely, he'll be a martyr only in his own mind. He'll see it as committing "revolutionary suicide protesting the conditions of an inhumane world." But it will ultimately be a worthless gesture.

No, no...sueing him isn't the way to go, if you were to take activism. You need to do something else. It's like this; the courtroom is his territory. Sure, he doesn't necessarily hold as much strength as he thinks, but instead, you want to get at him in a way more of us are much more familiar with than he is, basically, you got to use our territory, and the real world outside of the courtroom where, in the end, you hold higher power. For example, if you were to start a rally, y'know, outside, he really couldn't do anything about it I don't think, and can make all the threats he wants. And that's why you want people to gather as much information and records as possible, and should he by some chance appear in person, have video cameras to just in case, and use the gathered information to demostrate his attitude in full light. Basically, a public protest or the likes would be better than dragging lawsuits into it.

Bethesda is the developer and owns the IP rights, but theyh didn't self-publish or anything. It was puiblished by 2K Games, which is a subsidiary of Take-Two.

Ummm...does anyone else find it fascinating that Jack holds Take Two responsible for Oblivion....a game developed and owned entirely by Bethesda Softworks, which is a subsidiary of ZeniMax Media Inc.? Obviously I'm no smart lawyer, but I fail to see relevance.

JT is doing what I expected. He is like the type of person who would knock on your door to tell you that you can only be saved by God if you go to his church "and sit" next to him and donate 11 percent instead of 10 percent and if you say something is cooking or your busy he would speak faster and make statements like:

He reminds me of this but relates it to gaming. The problem is he cant give up as he has no way to do so. You need to cross-compare the two forms, the Take Two suit and the JT one.

I think the fact of the matter is here is that JT's case basically reads as 'I want Take Two to be singled out and have to produce all it's mature games to a court for judgement before release, and if they don't accept, they're mafia.'

Thing is, in Jack's world, 100% of people who buy computer games are minors, that's the only way his maths could have come up with 42% of the copies of GTA were sold to under-age customers.

Either that, or he didn't do particuarly well at averages in school.

Achievement points for all who read the thirty-seven page monstrosity. Has anyone ever wrote an e-mail or letter to the Florida Bar Association regarding Thommy boys' idiotic use of the justice system???

There are some things in Thompson counter-suit that just doesnt make any sense. If he is responding point by point to T2's claim then the following make no sense (in short):

T2: Thompson seeks to regulate the expressive medium of videogames and limit access to certain videogames based solely on the content of the expression depicted or contained there in.
JT: Denied.

T2: Videogames are a form of artistic expression, with extensive storylines and developped characters. Videogames explore the same themes and plots as other forms of literature, such as good versus evil, the corruption of governmental authorities, or the life of criminal.
JT: Denied.

T2: Videogames also contain extensive visual, graphic, animated and computer generated artwork, as well as original scores and songs.
JT: Denied.

And a lot of others regarding legal issues. Seriously, how can someone denied there is artwork and music in videogames?

I believe he is correct that Take Two doesn't have much room to recover damages on a preemptive suit, but is dead wrong on almost every legal argument he makes. He misses basic things like state citizenship, makes claims that directly contradict the legal record, such as he was only trying to prevent the sale of Bully to minors when public nuisance law makes no such provisions, which is unsurprising as it wasn't really aimed at products which are sold. He repeatedly said he wanted police to seize it. He makes numerous factually incorrect claims abotu Florida's public nuisance law along things lines, claiming the standard for being a public nuisance is being harmful to minors, which it isn't. In fact, this is essentially the whoel basis of his suit. He is claiming Take 2 wants these game to be ruled to not be public nuisances on the basis that they are nto harmful to children when the actual reason they want is that public nuisance laws do not apply to video games as they aren't written in a way that makes it clear how they would apply.

I have no idea where he got the claim that 42% of M-rated game sales are to minors. THe total percentage of game sales to minors is much lower than this. so it can't be correct. I am similarly puzzled about when Take 2 said they woudn't advertise in public transportation. The whole document is filled with claims that feel like they ought to have a citation, but don't. He doesn't even properly reference the suits he was involved in and misrepresents a lot of the rulings.

Argument 17 is especially absurd. Having to get court approval for speech is called prior restraint and very much not allowed under US law.

I assume the racist claims about Scots were an attempt at irony, which is not something usually engaged in in court filings.

The saddest thing is I think Thompson actually believes the claims he makes.
