That gurgling sound you hear could be Jack Thompson's legal career swirling down the 'loo.The frequent video game critic, already facing professional misconduct charges from the Florida Bar which could see him stripped of his license to practice law, has outraged a U.S. District Court judge by including images of men having sex in a document filed with the court last week.
It's difficult to fathom what Thompson was thinking, but here's how it all, um, went down:
As GamePolitics has previously reported, Thompson has a pair of lawsuits underway against the Florida Bar in the U.S. District Court for the Southern District of Florida. One of the cases, presided over by Judge Adalberto Jordan, has been the recipient of a flurry of motions by Thompson in recent weeks.
In a document filed with the court on September 19th, Thompson criticized the Bar for allegedly collaborating with Norm Kent, a criminal defense attorney from Fort Lauderdale. Thompson and Kent have a contentious legal history dating back nearly two decades. From Thompson's motion:
The Bar’s demonstrable mindset is that the “enemy of my enemy is my friend,” as indicated by The Bar’s enthusiastic, recidivist collaboration with Mr. Kent, over a twenty year period, at Thompson’s expense. Lunacy proceedings have been sought and secured, Bar complaints have recently been maintained for nearly three years.
Kent, who publishes the National Gay News website, was criticized by Thompson in last week's court filing for "distribution of hardcore porn to anyone of any age." Not content to make that alleged point in writing, Thompson attached several gay porn pictures to his motion with Judge Jordan. The pictures apparently do not come directly from the National Gay News site, but rather are contained on sites linked from NGN's adult links section.
In any case, His Honor was not amused.
In an order issued on Monday, Judge Jordan directed Thompson to show cause as to why he should not face sanctions, including possible contempt charges. Judge Jordan wrote:
The attached exhibit, which includes several graphic images of oral and genital sex between adult males, was filed electronically in the docket in this case, without prior permission from the court...
To the extent that the other attorney’s alleged conduct is in any way relevant... there was no need for Mr. Thompson to file these graphic images in the public record. A simple reference to the website and its alleged links would have sufficed...
Through his actions, Mr. Thompson made available for unlimited public viewing, on the court’s docketing system, these graphic images.
For this reason, by October 5, 2007, Mr. Thompson shall show cause why this incident should not be referred to the court’s Ad Hoc Committee on Attorney Admissions, Peer Review, and Attorney Grievance for appropriate action.
In the wake of Judge Jordan's order, Thompson has filed (at last count) four responses. In the first, he proclaims that he is ready to go to jail over the issue:
Thompson may have more to say in his own defense as to his alleged contemptuous behavior, but at this juncture, with all respect, he does not apologize for nor regret what he has done... if this court desires to throw Thompson into jail for trying to sound the alarm in this dramatic fashion... then Thompson is prepared to go there.
In another response Thompson likens his actions to those of a rather more famous American:
To hold Thompson in contempt for alerting the federal court system to the criminal activity... is akin to arresting Paul Revere, in 1775, for “disturbing the peace” with his midnight ride...
Via e-mail, Thompson told GamePolitics:
I'm not the one in trouble. The judge found a certain lawyer's material obscene. I absolutely love it. This is the best thing to happen to me in a long, long time. Check my [case] filings, sweetie.
We have, and this isn't the first time Thompson has been warned by a court not to include suggestive photos in those case filings. An April 12th entry in the Florida Supreme Court docket covering the Florida Bar's case against Thompson includes this notation:
...the Court notes that [Thompson] has attached inappropriate and pornographic materials to his petitions that are irrelevant to his arguments. Respondent is warned that should he continue to submit such inappropriate filings, the Court will consider imposing sanctions which may include, but are not limited to, a limitation on Respondent's ability to submit further filings without the signature of an attorney other than himself.
GP: As we said earlier, it's really hard to imagine what Thompson thought he might have been accomplishing by including the offending images.
What he has apparently succeeded in doing, however, is seriously upsetting the judge who must decide the merits of Thompson's attempt to block the Florida Bar from taking action against his license to practice law.
UPDATE: We've received comment from Norm Kent:
On a legal note, I am thinking most heterosexual lawyers... could better advocate their cause and arguments in the United States District Court than by... seeking, searching out and subsequently then downloading homoerotic images, that may or may not be found within our advertisers website content, over which I have no authority or control.

Sometimes I wonder if Jack has some kind of Legal version of the Magic 8-Ball.
It's not even that. His filings can be basically resumed as "The Florida Bar likes Norm Kent better than me but look Norm Kent's internet site has links to gay porn sites so I'm right! Here's proof, images from the porn sites!"
Do we have to read everything about this lawyer, just because he's badmouthing videogames? I think not. It's off topic. Please let's focus on the game controversies and keep our eyes on the ball. That lawyer isn't the ball. Symbolically speaking - that lawyer is just one player on the field, and right now he's munching popcorn, sitting at the sidelines, playing Phoenix Wright on his DS.

Technically Thompson IS the other team so we have to watch him. Albeit, slightly out there and not a good spokesman against our "team" but still an opponent nonetheless.
And even if you don't consider him the entire team, he is still a player on that team and if you watch the team, it means watching the players that make up that team.
Even then, it is still hilarious.

It's highly amusing that jack actually thinks he's winning when it's blatantly obvious to everyone else that he's failing miserably in the most stunning way possible.
I think what this boils down to in part is things we cannot see, Thompson is famous for harassing people, not just them, but their families, their employers etc, he's actually pretty much a stalker, he's already harassed Dennis' employer and left some really creepy messages on his home phone, and it's not the only case, I'm sure people remember the 'I know who you are, I know where you live' comment he made on Tycho's cell phone at PAX.
So I think it's partly about Jack involvement with Video Games and partly to do with the fact that he finally recieving the payback for all the hatred he has spewed at those who don't agree with him over the years, and I wouldn't be surprised if there IS a hint of satisfaction for Dennis to report this, Jack tried to destroy (and that's a direct quote) his opponents through various nefarious means on numerous occasions, and all he's succeeded in doing is destroy himself.

Seriously, y'know what I think he should do. Before filing any motion, he could consult his wife or close friends. He should ask them 'does this sound alright?' or 'Would it be a good idea to do this?'. At the very least, he'd look less insane. Come on, John. Submitting gay porn with a court filing? How does that play into anything?
We understand you don't like gay people, and y'know what? That's fine. I don't care what you like or don't like, but before you do something like this, you could at the very least consult somebody regarding what you're doing.

I'm not so hot on the gay porn in a professional resource, but I suppose there are some other objectionable images there albeit for more appropriate reasons. Regardless: *slow clap*

You've just got to be astounded at the man's delusions of grandeur. To compare himself with Paul Revere? Giving an advance warning about an imminent attack by enemy forces and warning against people of an alternative lifestyle are two very different things, but I guess Jack's mind makes no such distinction. :P
I think Jack has more in common with Mahmoud Amhadinejad than he would care to admit. Both men are known to make bold, outrageous statements wich they have no intention of backing up or following through on. As was noted earlier, they refuse to face the facts in spite of overwhelming and obvious evidence. And finally, both are due to get a good thumping soon from all indications. I think JT might want to consider moving to Iran and applying for a position in his cabinet after he loses his license. They'd probably get along great!
One difference though: Amhadinejad was willing to visit a country that was largely hostile to him and where there was probable cause to fear for his life. Yet Jack wouldn't go to PAX because he feared for his safety from hostile gamers. Say what you will about Mahmoud, but I at least have to give him some credit for that.

This made my morning, thanks for the laugh Dennis.
1) He's already been warned.
2) He attached the obscene material WITHOUT getting prior permission from the court. He has also since the second warning, provided no solid REASON to include said images.
3) Jack's got to be even dumber than he thinks since the images weren't from Kent's site, but rather a site that Kent's site LINKS to, and it is noted as being listed under "Adult Links". Jack has absolutely no ground to stand on.
4) He said he's willing to go to jail if it means not backing down from his beliefs.
Guess we'll be seeing him in the slammer. I can't wait! :D

My point is that during the McCarthy era, even being neutral to anti-communism was considered supporting communism. The smallest aspects of peoples lives were used to defame and ultimately to marginalize "unsavory" people. Jack Thompson is basically acting out the entire McCarthy era in his ongoing tirade on whatever he believes offends him.
Just like in the McCarthy era, if you arent part of the solution (IE You arent buying into Thompson's hysteria) you are part of the problem (basically everyone and everything else).
Then this. Oh man. "Jack Thompson, disbarred and facing criminal contempt charges for sending gay porn to a judge." That just sums it all up. Not only is his LEGAL career done for, his PUBLIC career is pretty much going down with the ship. Sic transit Jack Thompson.

GP: yada, yada... Jack's point (if you can call it that) here is that Judge Jordan called the pix obscene. And in Jack's mind that means that Kent was illegally purveying obscene material.
Except that the pix were not on Kent's site. They were on a site linked to from Kent's site under a heading that was clearly labeled "adult."
Bt that logic, GP is pushing those same images, since we linked Kent's site in the article.
And just like McCarthy, JT is being undone by his own zealotry. His picking on Halo 3 is the equivalent of McCarthy's picking on Fred Fisher. All we need is a Joseph Welch equivalent to yell at him, "You've done enough. Have you no sense of decency, sir? At long last, have you left no sense of decency?" and we're done. :)

BTW, Jack. Sidewinder would like to inform you that only people with mental disorders or minimal IQ would speak about themselves in third person. The shrink cleared you, so Sidewinder thinks that the latter option is more likely.
