GTA IV Gets Dated, Triggers Obligatory Jack Thompson Threat

Last week's announcement that the long-awaited Grand Theft Auto IV would be released on April 29th did not escape the notice of Miami attorney Jack Thompson.

The anti-game activist, who has been abnormally subdued since the conclusion of his Florida Bar trial last month, issued an e-mail on Thursday threatening unspecified legal and political mayhem for Take Two when GTA IV launches. Thompson, of course, has a contentious legal history with Take Two and its Rockstar subsidiary.

The controversial barrister's predictions of dire consequences were typically vague:
Take-Two shares have jumped approximately 12% today on this news.  What the market is not factoring in, however, is the downside risk coming Take-Two’s way with the sale of this “Mature” game to kids, which is a murder simulator for violence against women, cops, and innocent bystanders...

Thompson will, in the days and weeks ahead, be contacting state and federal officials to stop the improper sales of Grand Theft Auto IV to anyone under seventeen years of age, as any such sales violate state and federal fraudulent and deceptive trade practices statutes. 

Indeed, Thompson has today contacted Florida Attorney General Bill McCollum, who has supported Thompson’s efforts in the past.

GP: Actually, we have to wonder how inclined McCollum will be to support Thompson. The Florida A.G.'s deputies have been obligated of late to put in hours defending the Florida Supreme Court and Judge Dava Tunis, referee of Thompson's Bar trial, against Thompson in federal court.

Judge Tunis, by the way, is conducting a review of transcripts and documents from Thompson's December trial. A ruling - which could affect Thompson's status as a licensed attorney - is expected by spring. Wouldn't it be fascinating if the decision came down on the same day that GTA IV released?

Oh that's right, I forgot. He can't sue them DIRECTLY, but he's found a loophole where he can get others to do it for him.
Ya know, I'm rather surprised on why he doesn't go after Nintendo on Smash Bros Brawl simply because if I was in Jack's place, I would go after Nintendo for the following in Brawl

1) It involves using children's mascots(Well, most of em, including Sonic)

2) It involves using violence(Ex: Baseball bats)

3) It lets you play the game online

4) It can be sold to children

But I distress. People like Jack Thompson can be a pain to gamers, especially when they keep beating the dead horse around and not prove any point.

I think you miss the point of the entire issue. Nobody is against M rated games being sold to kids. The debate is how this is to be done. The industry has plenty of efforts to do so, and will continue to improve as time goes on- as the statistics show.

The anti-games crowd, however, wants the government to regulate not only game sales, but also the very content. They consider games to be as dangerous as narcotics, tobacco, and firearms and believe gamers are sociopathic porn addicts ready to snap at any moment. The goals of these people is no different than if someone wanted the government to control the content of books and music. A game banning by the government is no different than a book banning.

This is similar to the moral panic decades ago that seriously hindered the advancement of the comic book as a creative medium. That is why american comic books are still relegated to mostly kid/adolecent themes and audiences. Only recently has the bulk of the medium begun to evolve expressively (note the term "graphic novel" being used more frequently)- the comics code is diminished and the people who fought comic books are dying off.

If the anti-games people have their way, the videogame medium will suffer the same creative slowdown comics saw. Interactive storytelling, characterization, and theme will all be watered down for decades to come.

To allow people like JT, Yee, the NIMF, and others to have their way would result in a creative medium being stifled so they can exert control over masses they consider to be their moral inferiors.
Hey Jack. I'm curious to just how you think this is going to work when all of your previous attempts to do this have all ended in failure. Bully, Manhunt 2, prior Grant Theft Auto games. You know you're like Wily Coyote right?

My take on the Mass Effect, Jack being so obsessed with GTA4 that he heard about it "too late," and realized he avoided all this mess about being wrong & un-creditable.

Wouldn't surprise me if he was also upset that Fox didn't even contact him about this game....
I think the fact that he is defending Mass Effect makes him even more of a hypocrite than ever.

Anyway, I was wondering when we would be seeing Jack again. Its been forever since we last saw him.
I personnaly WANT Jack Thompson around as the main enemy of all gamers ; He's an awfully low, unknowledgeable, impulsive, uninformed, old, on the verge of forced retirement age, failed attorney. Aside from media attention, which gamers have successfully squashed concerning Mass Effect, Jack Thompson has nothing to help him.

Thus, by the very definition of his situation, we, gamers, have a perfect enemy.
We've been over this before but it's worth noting again: the sale of Mature rated games to minors does not constitute fraudulent and deceptive trade practices.

Nevertheless, it's nice to see Thompson is still out there doing his best to entertain us all.

And so he returns in order to make a threat and gloat about an impossible victory. In other words back to business as usual.

It didn't go anywhere; it's still in effect. According to the terms of the settlement, Thompson can't sue or threaten to sue Take-Two to block the release of its games.

He can write all the state and federal officials he wants though. That's not against the settlement.

Thompson's burnt so many bridges it's going to be difficult for him to find anyone to side with him. Even if he does, whatever legal action they come up with will ultimately fail.

Why?

Simple. Despite what anyone may think about the game itself, Take-Two and Rockstar aren't doing anything wrong.

As you know, grinding is a tactic in CRPGs where you try killing monsters within a given area for the sole purpose of gaining experience. While not as effective as choosing a more optimal loadout, it is good enough to gain a few more HP or damage/sec against the next powerful boss.

It is never effective to grind on low level opponents (or opponents that provide no benefit) when there's much more suitable targets.

Aside from media attention, which gamers have successfully squashed concerning Mass Effect, Jack Thompson has nothing to help him.

This is the case in point - the media is a much more suitable target than a single nut. We've (or at least the game manufacturer) managed to get one blogger and one news anchor to redact their statements, which means that the people who played games are a significant force. Whichever sources they got their information from will be treated as less credible since it made them look bad.

In a recent CAGCast (103 I think), Cheapy D mentioned a new lawsuit by TT against JT preempting the release of GTA4. I have heard no news of this seemingly new lawsuit in any of the credible news sources. Does anyone know about this, or is Cheapy D ignorant about (too many) gaming topics again?

As for GTA4 coming, the utter shitstorm that we will see (Its an election year) will be utterly insane. Mass Effect was just a taste of the lies & stupidity that GTA4 will spur.

Its going to be a busy year for this crap.
Thompson... If it were a murder simulator, one would spend either 90% of the game in preparation and cover-up, or 99% of the game in court and prison. Running around wantonly performing acts of violence and theft in full view of dozens of witnesses, with the occasional need to hide from authorities for up to five minutes, is a caricature. It is a joke, and anyone unstable to mistake it for reality shouldn't be given the freedom enjoyed by those of sound mind.

The bigger worry is in glorified violence. Better targets for your outspoken disapproval would be war shooters like the Call of Duty series, or anything bearing Tom Clancy's name.
And Rockstar is most likely dancing at the thought of all the money they will make from Jack and similar morons creating huge controversy. I mean how hard is it to realize that by villifying these games they just make them more attractive? Is that really that difficult a concept to grasp?

if the game is rated M, and the label clearly says M, that's not fraudulent at all. if a retailer puts a sticker or something over the rating, on both sides then it's the retailers fault.

I just can't fathom how Thompson comes to this conclusion. Now I'm not a lawyer and I don't play one on tv but I don't see how selling GTAIV to teens (if it does happens) is illegal, deceptive or fraudulent. Immoral in a lot of people's mind perhaps but not illegal.
In other news the sun came up this morning. So Jack Thompson thinks the last murder simulator is bad? Damn, now I have to buy a 360 just so I can buy it.
Thing is, Thompson probably doesn't want GTAIV banned. It goes against his new "tactic". He wants GTAIV sold to teens so he can push people into suing Take Two on fraudulent and deceptive trade pratices althought I can't see how it is deceptive or fraudulent. He probably imagines that the financial and social backlash of these lawsuits will be enough to put Take Two in the ground.

Are there any legal experts out there? I'm curious if we can make any conclusions about the likely outcome based on how long it is taking the judge to decide this. Is this normal to take this long? Or is this a sign that the case is very tough? That it is one sided? That it isn't a high priority?
We can all speculate on what it might mean (It doesn't seem like a long time to get a verdict would be good for Jacko) but I'm curious as to the opinion of someone who knows.
Also look out for:

- Press releases from Leland Yee warning parents about the horrible GTA4 game. Also to include self-masturbating paragraphs about his (unconstitutional) legistation.

- Fox News running a series of reports with (self-proffessed) "experts" about the evils of videogames and GTA4. Expect to hear about the hardcore pornography within. Perhaps even virtual orgasmic rape and sodomy!

- The PTC, NIMF, and other faith-bas...er...parent based groups coming out against GTA4. They will release press releases and newsbites about how these evil games are being marketed to children.

- JT will spam email inboxes around the country with statements like: "I will destroy Rockstar games"; "I predicted Columbine", "The V-Tech gunman trained on videogames"; "Halo caused the DC sniper attacks"; "I am doing god's work"; "I'm going to heaven"; "Only gamers or hitmen kill people".

- Hillary Clinton, whether the 2008 candidate or not will try to push her party to back game legislation- citing GTA4 as a reason. The Dems will want to get the backing of as many Bible Belt voters as they can. Banning an un-christian thing like videogame porn is perfect bait.

You overestimate how important the games issue is to most candidates.

The way I see it the only candidate who will mention the game is Hillary (who would still condemn it even if it was 2009 and she didn't win presidency).

To sort of echo Nightwing's comments, where was Jack exactly when the whole Mass Effect thing was going down? You would have thought he would have jumped all over it, citing it as further prood of his "games=porn" argument. He was conspicuously absent from Kevin McCullough's blog and even more conspicuously absent from FOX news, whom would never turn down an opportunity to give him a sound bite. And even though he's been banned from here, that doesn't mean he had nowehere else to go and troll. He could have just as easily gone to Kotaku or Joystiq and spout his rhetoric there. So yeah, where was he this whole time to cause him to miss a golden opportunity like that?
Isn't this in violation of the gag order he received against Rockstar games? He may have found a loophole against it, but the judge on his disbarment trail is going to take this blatant disregard of his court order into account when he makes his ruling in the spring.

I-I just don't get it. He won't gain anything from pulling this crap. He just gives the game free advertising, drums up interest in the product by making it "controversial" as he continues to dig himself deeper and deeper into hole that'll bury his ability to practice law in Florida for the rest of his life. Doesn't he understand that the Florida Bars Association is MANDATORY if he wants to have any legal work in his home state?

What does he gain from this other than to alienate people away from his cause?

Get a large enough movement with enough actual experts, bipartisan support with a for the children mentality, combined America's rapidly increasing neophobia and xenophobia, and with organization and competent leaders and the odds are not in our favor. Judges have ruled that video games are not speech and with no one on the Supreme Court under the age of 50 what you think they are going to decide. And Justice Ginsberg has decided cases based on international law. All I am saying is it could go either way. The first amendment is rapidly becoming irrelevent, within a few decades it will either be gone or meaningless.

Cain, almost all of the laws that were attempted were all backed near-unanimously by the state houses and senates, and it's been the judges and the supreme courts that HAVE been ruling that no, video games are not pornography, violence is not pornography, and yes, video games are protected speech. The current precedent is pro-games.

There’s no problem with wanting that. You just can’t legislate it. For one, it’s patently unconstitutional. For two, it’s completely unnecessary.

Not familiar with any such court cases. Can you cite them? All I know is that the Supreme Court ruled that comics are protected speech over 50 years ago. Any recent rulings to the contrary would very likely be overturned.

The only judge I know of who ruled that games weren't protected speech was Judge Stephen Limbaugh, who ruled that way in 2002. That shouldn't be too relevant today, though, since he was overturned by a higher court in 2003.

I'll be playing the game the day it's due out for release. Again Gamers will win, and the big baby will lose.

Not too sure, but it might have something to do with the screwup by Kotaku of reporting of last years TT taking JT to court as "CURRENTLY BREAKING NEWS!!!!"

Keeping controversial games alive seems to fuel his adrenaline, and if by miracle he succeeds in making Take Two and his other enemies bend to his will, his life will be pointless after that. Sooo, why is this worrisome? If he wants to help prevent the sale of this game to kids younger than it is rated for, all of the power to him! I don't see how that is at all related to Take-Two OR Rockstar. It's not their job to police big box stores that want to sell violent games to minors.

It seems to me that if Mr. Thompson re-allocated his energies into informing parents about the ratings system that is in place and into making sure retailers aren't selling violent games to minors that he would come much closer to his actual goal. As far as I know, that is keeping violent games out of kids hands. Again, I do not see how that involves developers and publishers in any way, shape or form.

A google search of "Rome v. Gordon" turns up one result: this web page.

Without the quotes, I found the actual name of the case, Georgia v. Gordon Lee. The case involves this. Gordon Lee, the owner of a comic shop, gave out bags of free comics for Halloween one year. A comic containing nudity was accidentally put into the grab bags and it just so happened a small child got it. The parents filed a complaint with the police.

The case has to do with decency laws, not comics being free speech. No one is saying the comic shouldn't have had that content, they're saying it shouldn't have been given to a child.
Aw, come on...it's a RATING. It's not enforced by law. If i worked at a store and sold a M-rated game to a minor i would've done nothing wrong. I'm not saying one should, but it's like putting a sticker on a grenade saying "You should really throw this after pulling the pin". As has been said many times before, it's the parents' responsibility to look after their kids and see what they're playing. So if you don't listen to the advice given by the ratings, suit yourself.

(i'm speaking from Sweden here. i don't know if ratings are enforced by law in the USA or anywhere else, but i hope not)

but let's take in to account who we are talking about here, this man believes he has been sent to this world by God to root out and destroy the creators of such vile media, he is not sane and he is not logical, so to him going after the developers seems like a smart thing to do

Even though you didn't bother posting any links to articles, I looked up the case you mentioned. That's hardly a sign of impending doom for comics. The comic fight is considered done because it's not facing legislation on a weekly basis. That case is clearly the result of an uptight good ol' boy who knows somebody in the system and has an axe to grind.

I do hope that it works out in the end though. That's some pretty blatant misconduct.

So Jack is planning to convince state and federal officials that GTA IV is improper and should not be sold to minors. Judging from past performances, I wouldn't hold my breath. Not once has this tactic succeeded. His time would be better spent advising parents not to buy the game for their young children, but considering the title, I'm sure most wouldn't.

Jack doesn't just burn bridges. He pours gasoline on them, sets them ablaze with a flame thrower, and throws grenades into the center, and booby traps the surroundings. Then, he travels to their homes, steals the valuables, kills the pets, burns the house down, rips up the gardens and lawns, and salts the ground so nothing will ever grow there again.

Let's face facts, Jack. By now, most parents know enough about the GTA series (or think they do) that they wouldn't buy the game for their 8 year olds. Most retailers are requesting ID when a person tries to buy an M rated game. Most people under 17 don't have the $60 dollars required to buy the game, much less the $300+ for the system to play it on. Despite the popularity of video games, crime and violence has decreased. Most of the people committing crimes would likely be doing so without the influence of any outside entertainment.

I agree that Jack Thompson is a mega-douche and that video games alone don't breed mass murderers. Anger and under-education on violence breed mass murderers, and I agree with Jezebeau when he said that GTAIV was nothing but a caricature. The problem is with desensitizing kids. Isn't it true that prolonged exposure to violence in media can make kids take violence less seriously in real life? We don't have to be worried about our kids causing violence, but shouldn't we be worried about what our kids think of violence?
Of course Thompson supported Mass Effect, it was made by somebody who isn't Take-Two. That's the only company in gaming he cares about.

Here's what I really think of JT defending Mass Effect. He's trying to deflect some of the recent pressure that Kevin and Cooper has been receiving. He concerned that the netroots efforts that gamers are extruding is something that he can't handle. That and he might have a new agenda hes working on.

Remembered when Mitt Romney was attacking violent games after Virgina Tech and Jack posted his support for the Romney campaign. That support for Romney has wavered. He's now attacking the Romney campaign because of the advisiors in Romney's inner circle. Barbara Comstock is Mitt's senior advisor and worked for Blank Rome in the lawsuit that Jack filed in Alabama against Take-Two in 2005. Jack claimed in letters to Joseph Liberman and the Florida Bar about her use of opposition research on him in that trial. Hes also upset about another of his advisors that lobbyed for a porn company (he complianed about it in a comment section in a Fox News' campaign blog). Jacky Boy was complaining that Romney's campaign hired a guy that works for the same law firm that's defending the broadcasting company that aired Howard Stern's old radio show in the Miami area when he was still on AM/FM radio(the same law firm that filed a bar complaint against him).

Looking at the Kotaku report, Jack's statement comes off as totally offhanded. It looks like he knows nothing about what really went on, as evidenced by referring to Cooper Lawrence as "he" (while I may not agree with her, she is a lovely-looking woman and I'm sure she'd take some offense to being misidentified as a man. Then again, we're talking about a guy who was "touched by a girl who looks like Lurch," so I wouldn't be surprised if he can't tell the difference after being so traumatized!)

The attitude is typical Jack; he's too busy with his little crusade that he can't really be bothered with the likes of us as our voice doesn't matter to him. That's interesting when you consider that with Kevin McCullough and Cooper Lawrence we were able to raise our voices so loudly that they couldn't ignore us. It only goes to show the level of delusion and willful ignorance on Jack's part. The man really does have a one-track mind.

It also shows his egocentricity; if he's not involved with the issue in some way, shape or form, then it doesn't matter to him and he won't pay attention to it. He's so fixated on Take 2 and Rockstar now that he won't notice any other games. It's clear now this is less a moral crusade and more of a personal vendetta. Ahab has to go hunt his whale.

Hopefully it won't be much longer and Judge Tunis will decide to yank his ticket. Yes, it really will be a good day if GTA IV is released around the time that happens. :)

Sorry for the double post, ran across a comic (didn't think to get a link) I believe it to be on Fanboy$ comic. Well it has JT writing a letters to police asking them to ban GTA citing it as a "comp killer. Last panel has two cops playing GTA going "See now kill that hooker! no wait shoot the cop! Ahh two stars now!"
As you can see, Mr. Thompson is still spreading his words that these companies are pushing their mature games at kids.

Now, if you look at the cover of any GTA game, you will see the certificate 18 written on it. Meaning it is only suitable for 18 and over. If they wanted to push this at kids they would of tried to lower the rating so younger people could buy them. Have they ever tried to do that? No.

It's also ridiculous because does a game with sex, murder and crime look appealing to the young mind? No.

All he wants to do is stop it being sold to kids. I mean, he can try all he wants butt even if he is successful, children will still get their hands on these games somehow.

Funny I thought GTA was a Crime drama told through the eyes of a criminal. It's just a video game where you play an anti-hero. It's good to let go every once in a while and play the bad guy.

I'm playing Mass effect right now and I'm working on doing everything in the game as a honest hero type, I plan however on playing it as as much of a bad guy as I can on my second play though.

It's all harmless fantasy.
