Jack Thompson Guilty on 27 of 31 Misconduct Charges, Says Bar Trial Judge... FL Supreme Court Must Now Rule

The judge who presided over Jack Thompson's Florida Bar trial late last year has recommended that the controversial attorney be found guilty on 27 of 31 professional misconduct charges. The Florida Supreme Court must now rule on those recommendations.
In a report issued last week, Judge Dava Tunis writes:
After considering the arguments presented by the Florida Bar and the Respondent (Thompson), observing the Respondent's demeanor during the nine-day trial proceedings, and carefully reviewing the record consisting of four volumes of exhibits totaling 1700 pages and approximately 2400 pages of transcribed testimony, the Court finds that the facts, circumstances and evidence presented regarding the Respondent's conduct, supports a finding of guilt as to certain Florida Bar rules...
Tunis made 21 recommendations of guilt in relation to Thompson's participation in Strickland vs. Sony, an Alabama case in which the anti-game attorney represented the families of two police officers and a police dispatcher slain by 18-year-old Grand Theft Auto player Devin Moore.
Tunis also recommended that Thompson be found guilty on four out of five counts relating to his 2006 attempt to have Rockstar's Bully declared a public nuisance in a case before Miami Judge Ronald Friedman. An additional two guilty counts stemmed from a non-video game matter.
Among the Florida Bar offenses for which Judge Tunis has recommended a guilty verdict:
- Knowingly making a false statement of material fact or law to a tribunal
- Knowingly disobeying an obligation under the rules of a tribunal
- Communicating the merits of the case with a judge before whom the proceeding is pending
- Using means that have no purpose other than to embarrass, delay or burden a third person
- Engaging in conduct involving dishonesty, fraud, deceit or misrepresentation
- Engaging in conduct in connection with the practice of law that is prejudicial to the administration of justice, including to knowingly or through callous indifference disparage or humiliate litigants or other lawyers
- Making statements that the lawyer knows to be false or with reckless disregard as to the truth or falsity concerning the qualifications or integrity of a judge
Judge Tunis's full report to the Florida Supreme Court is due on September 2nd. In the meantime, a disciplinary hearing regarding possible sanctions against Thompson will be held before Judge Tunis on June 4th.
For his part, Thompson has made a number of allegations concerning Judge Tunis, including a complaint that state-mandated loyalty oaths were either not signed by the judge or were signed by others. Thompson also has filed federal lawsuits against the Florida Bar and Florida Supreme Court in relation to the Bar charges and other sanctions.

JDKJ: No, it uses the very peculiar and expensive 5.7 x 28mm round. That's why it's call the "Five-Seven." It's smaller than a 9mm round, allowing the magazine to hold 20 rounds. And, in some variants, is armour piercing (hence sometimes called "Cop Killers").

Though I read all available info and transcripts about this as it unfolded, it is pleasing that so many charges are found; though most of us were hoping and expecting something so complete (due to Tunis needing so many extensions to sort through all relevant data).

Okay, I'm hoping someone can clear this up for me...
Judge Tunis is recommending that JT be found guilty on 27 of 31 charges. Does that mean he's not actually guilty yet? I mean this certainly can't be construed as good news, no matter how JT tries to spin it. But this doesn't mean he is done yet either, right? He can't be disbarred until the FL Supreme Court makes a ruling based on Tunis' recommendations, correct?
I guess to try and use an analogy of sorts, the water is boiling and the lobster and being held over the pot, but he hasn't been thrown in yet.
Basically, yeah. The actual case itself is expected to go to court by september 2nd. But right now the judge has only issued a recomendation. But he is definitly in hot water now, short of bush offering a pardon he is hanging over the open flames by 1 flailing leg...
If Bush pardoned him I would think that he had signed the wrong papers. If Bush somehow does it on purpose he may be impeached for a final act of stupidity.
I had something else to say, but the image of Bush being impeached with JT as his defense lawyer just popped into my head and I can't stop laughing.
The funny thing about all of this is that, even though he may be dis-barred, he will probably still be out in the media. He will still be spouting out his anti-game rhetoric. Still screaming about how video games ruin the world and peoples lives.
Logical people would ask why this would happen. Why would anyone listen to this guy at all? Any time I see any mention of him (on television, radio, the net, etc, etc), I ask the same question: Why would anyone value this man's opinion? Why would any producer have this man on their show? Because there is a whole shit-ton of people out there who will listen to what he has to say. People will still listen to the message, no matter how ludicrous the messenger is. And unfortunately, you have to take into account that there will also be someone out there to take his place, whether it be regarding video games or any other type of entertainment medium. The only thing that we can do as a community is inform. Get the word out.
There are some points to what he and his cohorts believe in that I do agree with. Do I believe that sales of games such as Grand Theft Auto IV should be restricted to adults. Yes. Should a young child be playing a game where you can go out and have various services performed for you by a prostitute? I think no. I do not think someone that young has the mental capacity to understand the context of what they are seeing and doing, and I do not see what good it would do to expose any child I may have in the future to it. Should it become law? I don't think so at this point, but the retail industry should begin counting M Rated games as something they should ID for, like a rated R film or a CD with explicit language.
With all of that being said, I will jump on the bandwagon...Jack Thompson is an idiot when it comes to crusading against violent video games like this. He comes off as a standoffish prick. He puts too much of his ego and emotions into this. I'd give him the benefit of the doubt that his message is just misunderstood, but the fact that when he is presented with a fact that is contrary to what he feels (keyword: FEELS), it is as though the person never said anything.
One of the key things that really irks me about Mr. Thompson is that he stands to make money off of this. I doubt he goes on to television or represents familys of victims for free. It seems like a huge conflict of interest on this part. If he does take any kind of compensation for his time, I would like him to come here and state that.
This is all my opinion, mind you. He could, in real life, be a swell, upstanding gentlement who really wants to do some bit of good in the world. If that is the case, his tactics should really change. He should be working more with the industry, instead of having it sued everytime they draw breath.

Actually, the retail industry has really been pulling their weight on this. The most recent FTC reports said they successfully card about 80% of kids trying to buy M rated games. I believe the rate for minors trying to get into R rated movies is around 65%. I forget the rates for retail movies and explicit CDs, but I recall them being quite abysmal (like in the 20% range).
I knew the figures were pretty decent for games, as opposed to the movies and cds. I was really referring to the way they are perceived by the world at large. Thanks for the stats.
I think that we need to keep this in prespective. These are recommendations by the referee that he be found guilty on these counts. Not actual guilty verdicts themselves. Granted I'm sure that they'll carry a lot of weight, but he hasn't been found guilty yet.

Holy Crap, I got through the turmoil.
I wanted to say more, but it was lost. As far as I can tell, this amounts to a jury trial finding a defendant guilty. It's then up to another court, in actuality usually the same, to pass the sentence. So Judge Tunis has acted as a jury in finding JT guilty. Now it's up to the sentencing judge/jury to weigh in on the merits of the case to determine the punishment.
JT's case is no different from any criminal trial's. A criminal defendant can be found guilty but let off on timed served, given probation, or given a fine for his/her actions (or jail, termination). It's up to the presiding body.
Jack is in no better position than any criminal who has been found guilty. He could be faced with life in prison, or no appreciable penalty. It's just a matter of semantics, i.e. disbarment or a warning/limited censure.

For the curious, here's a little primer on exactly how this disciplinary stuff works. This is very general, and I don't know the peculiarities of Florida.
A state's highest court is generally the "head" of the bar. Everything from admission to discipline is officially in its hands. But most tasks are delegated to the state's Bar Association, for obvious reasons. When there are allegations of misconduct, the Bar usually has at least one person who is responsible for investigating them. If there's something to the allegations, Bar Counsel can initiate proceedings. In some places, they begin in hearings before a committee of the bar. In Florida, from what I can tell (I haven't researched this), it appears the process is begun by filing an action in the Supreme Court, then the Court delegates the fact-finding to a trial judge. Ultimately, however, the Supreme Court is responsible for any discipline.
As far as that discipline goes, bar sanctions can range anywhere from a private sanction to disbarment. The type of sanction depends on a variety of factors, including whether there was actual harm to a client, the number of violations, whether the lawyer has taken responsibility and cooperated with the Bar's investigation, etc. Disbarment takes quite a bit of misconduct to earn. Even if someone is disbarred, most states (maybe all, I'm not sure) allow the person to re-apply to the bar after a set time, commonly 5 years. There are certain requirements, however. For example, the would-be lawyer must keep up with continuing education requirements during the intervening period.

Number, nature, and the fact that Thompson's been fighting this investigation screaming invectives, throwing insults, mocking his fellow professionals, and generally making the whole thing into a debacle of a three ring circus - every step of the way. Given all that I'd imagine that disbarment's up for some pretty serious consideration. Sure State Bars hate to strip one of their members of the right to practice their profession, but Jack's pretty much done his damnedest to make anything less out of the question. Forget straying across the line, Jack pretty much charged across it firing artillery shells all the way. If they can't get him to admit professional error on his part, what hope do they have of him changing his ways (which is generally the point of lesser sanctions)?

There will be no jail time from this proceeding. This just involves his license to practice law. If anything warranted criminal charges, that would be separate. And nothing stands out that would warrant criminal charges, anyway.

Not criminally. It takes a civil suit to win anything for defamation (of which libel and slander are two forms). As far as I know, nobody has filed a civil suit against JT alleging that he has defamed them. Likely, nobody will--it would just draw attention and not accomplish much.
Oh, and even if someone did sue for defamation and win, that would just result in a money judgment, not jail.
I think it's even more complicated than that. I'm no law student, but I'm pretty sure you need to have suffered some kind of harm as a result of the defamation if you want to have a case. As such, Take Two might have a case, citing loss of sales resulting from these baseless trials, sales losses from raising SA to AO rating, or even legal fees, but the average gamer wouldn't be able to make a slander charge stick, IIRC.
You need to prove that they knowingly lied (in this case, either they know they were making false statements or should have known they were making false statements) and intended to defame.

Regardless of what happens on June 4 or later, this whole thing will go on for a long time. JT will likely bring all kinds of appeals, counter-suits, and general harrassment out like he always does. And you can count on him trying to play the "my wife has cancer" card.

IIRC it states that a person needs to exhibit a certain number of the criteria to be considered as suffering from NPD. Jack exhibits ALL of them. He may be the greatest example of someone with NPD in the modern world.
So Jack doesn't really have any choice in his actions. He's incapable of acting civilly or logically, as only he is correct and only he is intelligent enough to understand this. This has been evidenced multiple times when he has attacked his supporters when they didn't support him unquestionably. Also, they make useful scapegoats, since it was they who screwed up, not him.
I personally want him to try the "my wife has cancer" appeal again. During my e-mail convo with him, he said she had it over a year ago and is now doing fine. He tries it, I'm calling B.S. unless he can prove her cancer has returned.

My wife has had cancer. 3 times. Including brain cancer. She's been cut open so many times, she looks like a jigsaw puzzle with her scars in places. A year after we were married, she slipped into a coma. On our 1st anniversary, the doctors handed me a DNR order and suggested I sign it. The cancer was removed, but she was in a coma for 108 days. The damage done by the cancer still gives her problems to this day, and this was in 1990. She has balance problems, vision problems, short term memory problems, and will never be able to carry a child or even get pregnant. and what is worse that when she slipped into a coma was that she was pregnant and miscarried.

I hate to be the party-pooper but the actual sentence (more correctly referred to as the "sanctions"), if any, that Judge Tunis will recommend Jack receive is unlikely to be handed down on June 4th. That date is for a hearing on the issue of sanctions, at which time the Bar and Jack will be given an opportunity to argue about what they think is an appropriate sanction. The actual sanction will more likely be included in Judge Tunis' Report and Recommendations to the Supreme Court (which isn't due until sometime in September).
