With Sanctions Hearing Looming, Jack Thompson Accuses Bar Trial Judge of Leaking Documents to GamePolitics

As GamePolitics has previously reported, embattled anti-game attorney Jack Thompson faces a sanctions hearing tomorrow before Judge Dava Tunis in Miami.

Tunis, the referee appointed by the Florida Supreme Court to preside over the Florida Bar's prosecution of Thompson on professional misconduct charges, recently issued a recommendation that the controversial attorney be found guilty on 27 of 31 counts, including "Knowingly making a false statement of material fact or law to a tribunal" and "Engaging in conduct involving dishonesty, fraud, deceit or misrepresentation."

For his part, Thompson has been actively seeking to discredit Tunis, including charging that she is not a valid Florida judge due to her state loyalty oath apparently being signed by a clerk without her knowledge.

On May 30th, Thompson upped the ante against Tunis, charging in a document filed with U.S. District Court that the judge had leaked documents to GamePolitics. Although the name of this website is not specified in Thompson's motion, it is clear from the document's context that he is referring to GP. Thompson writes:

In the last 36 hours, plaintiff has discovered that the referee in the state Bar "disciplinary" proceedings has leaked documents to a video game industry web site that only she had. This has resulted in more harassment of Thompson by "video gamers" who have been threatening to kill Thompson and his son.

 

The referee knew to leak these documents, which only she had, to this particular gaming web site because it came out at Thompson's bar "trial" that this site had filed a Bar complaint against Thompson (which was so bizarre that even this Bar dismissed it) and that this site was in fact orchestrating harassment of Thompson during his trial.

 

This same site had orchestrated postings at Amazon.com, when Thompson's Tyndale House book was published, that there was a "Canadian edition" of Thompson's book in which Thompson disclosed his internal struggles with homosexuality and drug use. Thompson has had no such struggles; there was no "Canadian edition."

There's just one problem with Thompson's charge that Judge Tunis leaked anything to GamePolitics: It is not true. I don't know Judge Tunis. I've never spoken to her, exchanged e-mail with her, or had any contact with her. I did call her office once, many months ago, to inquire as to when we might expect a ruling on Thompson's trial. A staffer referred me to Eunice Sigler, Director of the Office of Government Liaison and Public Relations for the 11th Judicial Circuit of Florida.

GamePolitics has obtained three documents relating to Thompson's case in recent days. All came from public records requests with court administrators.

On May 20th , GamePolitics broke the news concerning Judge Tunis's recommendations as to Thompson's guilt. That document came from the aforementioned Ms. Sigler. I've been tracking the Thompson Bar trial since it took place in late 2007. Months ago I contacted Ms. Sigler and made a media request for any developments. As per my request, she forwarded me the recommendations. These were also published in the Daily Business Review, which apparently obtained them via its own public records request.

The following day, in a filing with Judge Tunis, Thompson alluded to having 33 witnesses that he hoped to subpoena for his June 4th sanctions hearing. Curious about these, I asked Thompson for the names. He refused. I contacted Ms. Sigler on May 23rd and made a public records request regarding Thompson's proposed subpoenas. I received the subpoena document from her on May 28th and published it later that day.

Also obtained via public records request was the Miami-Dade State Attorney's investigative report into Judge Tunis's loyalty oath. This document came from Public Information Officer Ed Griffith.

Thompson may not like it, but he has made himself into a very public figure. His case is a matter of public record. His court filings are not sealed, nor are they classified information. They are a matter of public record, readily available through the proper channels.

In a series of e-mails, Thompson demanded several times to know where I had obtained the documents. Being under no obligation to do so, I declined to tell him. Moreover, he is an attorney. He should understand that these are public records.

Regarding his comments that I orchestrated harassment of him or orchestrated bogus reviews of his book, these are utterly false. I've addressed his allegations on the book issue in some detail in the past, and I've also discussed my filing a 2006 Bar complaint against him. Nor, as Thompson alleges, is GamePolitics a "video game industry web site." Readers need look no further than today's story on E3 and Gov. Rick Perry to confirm that.

So what will happen at tomorrow's sanctions hearing?

It's impossible to know, although Thompson's e-mails of late have indicated that he expects to be disbarred. In any case, Judge Tunis does not have the final word. That responsibility lies with the Florida Supreme Court.

Probably because Jack was demanding answers that he should have known already...namely that anyone can request these PUBLIC documents from the court, and there was no reason the court should have declined to give Dennis a copy. 

Jack has a way of demanding things like a three year old.  Scratch that, my three year old nephew knows how to ask nicely sometimes.

You need to give respect to earn it. Jack needs to learn that lesson. Why is it ok for him to withold information, and tirade childish insults at GP and videogamers,  just to be awkward?

THEN, despite his previous actions, he should be able to obtain non obligatory information from GP, just because he wants it?

Its a two way street we all walk on. He learned his lesson the hard way. You'd treat a kid in exactly the same way. And you know what, if my parents set this example to me,  itd be a lessson well learned and one i would thank them for.

Dennis is under no obligation to give JT information he can obtain himself.  Remember what he tells us EVERYTIME he posts? "Jack Thompson, Lawyer and you're not"

If what he says is true (I know, I know, I know, just saying), no one should be threatening either him or his son--they'll be miserable enough over the coming years enduring the infamy that JT has brought on himself.

I do like the idea of the Canadian edition of his book though!

we'll this isn't really surprising. i seem to recall wacky jack threatening gamepolitics with a lawsuit in the recent past because of one of the recent postings about him. as usual all bark and no bite for jacky. i feel sorry for the poor fool, his own actions have ruined his career and all he can do now is flail around acting like an jackass in a vain attempt to save his already doomed hide.

This is a case of someone needing to take personal responsibility for his life.  Instead of blaming games, gamers, game developers, music, musicians, news, activist judges, bloggers, and so forth and so on Thompson needs to take a good look at his own self-destructive behavior.

It doesn't really matter any more, the man has officially reduced himself to nothing more than white noise anyway.

There's a kind of strange morality lesson in there, a man who believed that Video games created manic-obsessive killers, against all evidence, to the point where he became manically obsessed with the idea and destroyed himself in the process.

Becoming so convinced of something that you choose to reject reality is not a danger caused by computer games any more than it is a danger caused by wanting to destroy a video-game company, the danger is the obsession not the target, it's kind of ironic that Thompson should become a role model to demonstrate exactly <i>why</i> people shouldn't be focussing on computer games, and should be worrying more about obsessive compulsive behaviour traits, it can destroy careers, families and lives.

This man has clearly lost it, providing he ever had "it" to begin with. I'm not sure if he means harrassment on this site or through email and phone calls. But if it is the former, which I suspect, I don't think him trolling the site, posting a condescending, derogatory, and/or completely fucking delusional comment, then having negative comments in response can constitute harrassment.

And if it's the latter, I don't see how this site, which as far as I know, has never posted his personal information (even though he's posted his own a few times), could have possibly orchestrated his harrassment.

I think he must have skipped physics class the day his teacher talked about cause and effect. He has yet to realize that his actions have very real consequences. It might also explain his misgivings about the whole "correlation vs. causation."

How can it be harrassment , if you voluntarily switch on a computer, load your internet browser, type www.Gamepolitics.com into the URL bar, select the story, and then click through to the comments.

If you VOLUNTARILY do that, and then read negtive comments that you dont like, you know what you can do... umm how about NOT READING THEM. wow.. harrassment solved in 5 seconds. I should have my own agony aunt talk show.

I think someone in the forums pointed out someone "prank calling" JT recently...

But still, it isn't like GP is the only site with people who have a problem with him, and chose such childish harassment out of their own free will.

Finally, not like you can't escape it nor am I avocating it, but one who has posted & said such vile stuff along with knowingly posting their personal info on the internet doesn't get mcuh sympathy from me.  While there have been other figures people here and elsewhere have had issues with, for the most part we showed them the same respect they showed us.

What a funny concept, treat others how you want to be treated, and get treated the same....  And is just as funny as someone claiming to debate the "video game" issues, while ignoring the other side's points and questions.

Sounds like JT's last gasp, he finally realized he will face punishment for his actions and is trying every possible action he can conceive of to either delay, or take attention from the sanction hearing tomorrow. And I can't help but notice the closing of the document either.  Served upon counsel for defendant Mr Fahlbush? Who the hell is Fahlbush again and what does he have to do with this? Is John Bruce representing someone else and using that poor persons case to continue his own??????

Fahlbush is an attorney in the Florida Attorney General's Office. The A.G.'s Office is responsible for defending judges who have been sued as a result of performing their judicial duties. Fahlbush is assigned to defend Judge Tunis in the lawsuit Jack's brought against her.

Yeah, and in blaming everyone else, didn't he just perjure himself? There were no "leaked" documents. I guess you could call it ignorance, but I honestly think an attorney not knowing that public records are open to the public is less likely. Even if said lawyer is Thompson.
