We Have the Judge's Report Recommending PERMANENT DISBARMENT for Jack Thompson

UPDATE: In addition to her recommendation that Jack Thompson be permanently disbarred with no opportunity for reinstatement, Judge Tunis recommends an assessment of $43,675 for the costs incurred by the Florida Bar in prosecuting his case.

The report by Judge Tunis is quite lengthy. We will break it down and comment on it beginning tomorrow. For now, we will note the Judge's conclusion regarding the evidence presented at Thompson's Bar trial, as she definitely knows Jack:

The Florida Bar has recommended disbarment for a period of ten (10) years. This Court respectfully declines to follow the Bar’s recommendation... This case involves factual findings of cumulative misconduct, a repeated pattern of behavior relentlessly forced upon numerous unconnected individuals, a total lack of remorse or even slight acknowledgement of inappropriate conduct... 

 

Additionally, the Court is taking into consideration a review of the Respondent’s conduct not only as proven by the evidence, but by what this Court has witnessed of the Respondent’s behavior throughout the eighteen (18) months of litigation. The undersigned finds no evidence whatsoever to indicate that the Respondent is amenable to rehabilitation, or even remotely appreciates the basis upon which a need or purpose for such rehabilitation is warranted...

  

Over a very extended period of time involving a number of totally unrelated cases and individuals, the Respondent has demonstrated a pattern of conduct to strike out harshly, extensively, repeatedly and willfully to simply try to bring as much difficulty, distraction and anguish to those he considers in opposition to his causes. He does not proceed within the guidelines of appropriate professional behavior, but rather uses other means available to intimidate, harass, or bring public disrepute to those whom he perceives oppose him.

 

Thus, after careful consideration of the underlying facts in the instant cases, together with the Florida Standards for Imposing Lawyer Sanctions, the applicable aggravating and mitigating factors and the precedent case law, this Court makes the following recommendations for John Bruce Thompson:


A. Permanent disbarment, with no leave to reapply for admission.
B. Disciplinary costs currently totaling $43,675.35.

Gallagher can araç kiralama say all he wants, but I strongly rent a car believe it's due to his crappy leadership and E3 being a joke. ESA's Board of Directors need to find a way to get out  of this horrid contract with this Bush cronie before there's no one rent a car left on the Board.

Ever since I learned of Jack Thompson's existence and actions, I've been looking forward to the day he got his comeuppance.  Actually, I don't disagree with the idea of excessively violent games influencing kids negatively- but merely thinking of what JT has done (specifically his unshakeable arrogance and hypocritically "violent" antics both in and out of the courtroom) is enough to ruin my day.

So, hearing that he's to be disbarred, and not just for 10 years, is music to my ears.

At this point, I just gotta ask:

1. When is the actual court date that determines whether or not JT is no longer able to practice law?  Just so I can mark my calendar and watch for the results.

2. I can't help but worry that JT can still do something simply awful even without being an attorney.  Aren't you guys worried of what he'll do against gaming in general after he's disbarred?  A man that convinced of his cause and totally unrepentant of his actions, even if obviously, objectively immoral, is not going to go down easily.  I doubt he'll be successful in any actions undertaken to discredit those who disbarred or to become a lawyer again anywhere in the world- but, for example, to claim and convince other anti-gaming advocates of his "expertise" in video-game-to-real-life-violence is something I think he's still quite capable of.

3. Sorry for not keeping abreast of his career too much, but why hasn't someone sued him for libel, slander, defamation, grave threats, etc.?  There's so much recorded on Jack that proving such should be easy as cake in court- nevermind how emotionally distressing he would be to his opponents.

Whoa, wait, hold on, guys. Aren't we forgetting something? I mean...How pissed will Jack's wife be when she finds out that not only has he lost his job, but that they're gonna have to pay almost $50 grand in fees? Unless that's a drop in a hat for them (and I ddoubt that neither of them are that rich).

I'm more surprised this didn't happen sooner. Problem is being banned from the Florida bar doesn't mean mean he won't impose 'jack thompson' justice with another bar association. The dood is a spanner. I still remember laughing so hard on amazon.com when his book came out. 1000+ reviews all 1 star, vicious comments from hundreds of supposed 'readers' of his book used to attack him personally and my favorite was all the pictures attached with some hilarious pic and a big FAIL written across the bottom. I think I actually saved those pages because I knew amazon wasn't going to keep them up for long ;)

in this case, I obviously don't condone the capital punishment for stupidity per se, but this is just public enough to adequately serve as a warning to other idiots of the same caliber for at least a few years... wouldn't be bad if it were more public though.

Yes, I agree this punishment is harsh and ultimately ends Jack Thompson's legal career, notwithstanding his flawed bid for president of the Florida Bar, currently pending.   Yet this result is justified in this case.  The system has afforded him leniancy at many turns.  In a remarkable showing of judicial restraint, Judge Tunis (and for that matter, every one of the other judges implicated in her opinion) had mercifully granted Mr. Thompson opportunities plenty to respond to allegations against him, to be heard, to correct the record.

What this order lays out in excruciating details is that Thompson used each court's repetitive grants of mercy (much of which he was not entitled to in the first place) to abuse those very systems.  Instead of reform or advocacy, he demonstrated the very vitriol and lies that he was accused of.  He disregarded multiple court orders--a point he never disputed.  Those court orders operate with the force of law against him.  His actions illustrate that he felt that the restraints of law did not apply to him, or perhaps only when convenient.  He felt that he was above the system of laws that he would use to impose his will against others was.  C.f. "The Simpsons," episode BABF18 (orig. aired. Mar. 4, 2001) ("Marge: I thought you said the law was powerless. Chief Wiggum: Powerless to *help* you, not punish you."). It is unremarkable to note that Thompson was not entitled to use the power of a court of law unless he abided by the rules of that forum. 

Remorseless and defiant upto this point (and probably in the end, whenver that turns out to be), Thompson has violated so many professional rules that it seems overkill to go back through them.  His violations of the basic duty of an attorney should suffice to explain why Thompson should never be allowed to practice again, nor exercise any fiduciary duties.  Duty of loyalty to a client:  What seems clear is that he is not capable of representing any other interest other than his own.  In the Alabama case, it was clear that he was not interested in anything but to litigate a frivilous matter--and not to the best interests of neither the party he purported to represent. So don't weep for Jack.  With him disbarred, he can no longer represent other clients to advance his own agenda.  Nor can he appear in court to further abuse the legal system.  Should he wish to vindicate his own rights, he may hire another attorney to do so (something he should have done long ago). 

Good riddance.

The other thing is, even if he is disbarred for life (right now it's only a recommendation), in reality I'm not sure if that would prevent him from doing the kinds of harassments that has been outlined by multiple people in the complaint. He could still send lawyers and groups he doesn't like derogattory, threatening, and defamatory emails, faxes, and press releases. It's pretty clear from the pdf document, that his respect for the law is non-existent, so I'm not sure if even disbarrment would really change his MO.

I've skimmed through the pdf document and it's actually quite frightening. We only hear about the odd crazy press release he might put out. But these companies and lawyers were harrassed by him for YEARS on a daily basis.

I'm sorta surpised no one has put a defmation lawsuit against him? Looking at some of the emails and faxes he sent, surely it would be hard to find such conduct protected under 1st amendment rules.

I just caught a tidbit of an e-mail Jack sent to the Florida Supreme Court:

"Your Referee down here, Dava Tunis, the one who does not have a federally-mandated loyalty oath even to be on the bench, just today issued her final Referee's Report in the above matter, and she rejected The Bar's recommendation of a ten-year disbarment for me and instead is asking you to disbar me permanently with no opportunity ever to apply for reinstatement."

Maybe now he can use that time he won't be attorneying to get some serious mental help, since he is clearly a disturbed individual (probably obsessive-compulsive), and start his life fresh.

Yeah, usually he would be posting some sort of insulting victory speech at 4 am....this time the guns are silent and all is quiet on the western front heh. Jack is notorious for his usual early morning gloats... Kind of odd, peaceful, and creepy.

Maybe he really is admitting defeat...either that or he is spamming every government and law enforcement official (or flinging out his press releases to Dennis and every media outlet in the east coast, telling how corrupt Judge Tunis is and how it is all a conspiracy), trying to stave of the inevitable. I think that is more likely...

Has anyone seen those pins/shirts that say "Jesus would slap the shit out of you," generally with a picture of W on it? We need to have cafepress make shirts with that and Jack's picture on them. I think it really says everything about Jack's "crusade" and his "Christianity".

I can just see Jesus now:

I recall Jack recently turning down an interview.  The potential interviewer's last name was Thomson.  Good old Jack, in fine form, not only denied the interview but also insinuated that he was better because his family "could afford the 'p' for their last name".

 

Does this turn of events mean that Jack will need to sell it back?

You know, I almost felt pity for him, ALMOST. But then I remember all the lives he's ruined, all the insults and lies he has made and repeatedly cited. He told gamers to kill themselves for god's sake, he mocked a gamer who did kill himself. A person liek this deserves no pity, he pushes his own sick opinion under the guise of a crusade against evil, and he knew exactly what he was doing. He is a lying scheming scumbag who should NEVER ever be allowed in the legal system, I don't care if he might die in 10 years, permanent disbarment makes sense for someone who is a sociopathic freak and wants all humanity to bend to his will.

With people like JT being allowed to make a mockery of the legal system for as long as he has, it's no wonder that so many people hate/loath/detest the legal profession as a whole.  It's unbelievable that he's been able to act in this manner for as long as he has without serious repercussions.  I can only imagine that guys like this must irritate the hell out of attorneys who do strive to conduct themselves in an honest and professional manner.

Someone previously mentioned that his wife is also an attorney (see http://www.carltonfields.com/pthompson/).  The fact that she's marrried to him aside, I kinda feel sorry for her.  I'm sure this is the kind of notoriety/publicity that she could probably do without.

Actually, JT's the reason I WANT to become a lawyer. I want to help undo the damage he's done to all lawyers, including his wife. Maybe if the timing is right, I could be his wife's divorce lawyer.

Okay, correct me if I'm wrong.  But in the last few days has Jack both said that Judge Tunis has been paid off (I'm guessing by the video game industry), and that Dennis has some sort of relationship with Judge Tunis(I'm geussing of a sexual nature).  Does this mean that Jack's crazy has gone from a little suspicious to a full on tinfoil hat wearing conspiracy whackjob on the level of the "We never went to the moon!" crowd.

I am just reading the document now and this part about how Mr. Cardenas got involved is just amazingly stupid.  Jack just wont drop it either.  And all these letters that Jack is writing about all this.  I am at a loss for words on how to describe this.  This is much worse then things I was aware of.

I'm about 60% of my way through the ruling at this point, and this is simply amazing to see written in a judge's ruling.  I had been vaguely aware of Thompson before as an anti-gaming zealot, probably with some delusions, but what I'm reading so far is completely in agreement with what I've seen here in the comments.  This man is not only insane and delusional, but he's malicious, and a liar as well, and has no qualms about collateral damage, or compunction about using people for his purposes.  If his actions here are indicative of what he's done as a whole, and I gather from the comments that they are, then not only is this recommendation of disciplinary action overdue, but it's probably much less than he deserves.

I have no sympathy for someone who acts this way toward other people, wrecking the lives or careers of anyone who gets in his way, lying about anyone, to anyone, to get what he wants.  And I have to agree with what others have said above about his family: it would be wrong of us to worry too much about his family when he's shown such callous disregard for others' families.

You know, I might actually miss the hijinks of ol' Jack Thompson.

I was reading through the report and came across just the thing to highlight this:

(Page 57) Mr. Thompson wrote to the Judicial Inquiry Commission in Alabama, with copies to Judge Moore, the media and actor Joe Pesci.

What!? I haven't followed the antics of JT too closely... but how does Joe Pesci fit into any of this?

I assume this disbarment is only for the Florida Bar, correct?  Does that mean Jack can apply to a different Bar and become a lawyer licensed in another state, or would this prevent him from doing so?

Granted, moving from Florida to apply as a lawyer somewhere else would seem to start the entire process over again...but we've seen that Jack is indeed...zealous to put it lightly.

If you lose (or surrender under such duress) a professional license or bond anywhere in the country, California 1) wants to know about it and 2) probably won't let you become a lawyer because of it.  Unless other states are way out of line with this (ABA-based?) policy, Jack will never practice law again.

Of course, he can always sue pro per.  Anywhere.  So, in that sense, he's like a bad horror movie killer: he will never truly die.
