We Have the Judge's Report Recommending PERMANENT DISBARMENT for Jack Thompson

UPDATE: In addition to her recommendation that Jack Thompson be permanently disbarred with no opportunity for reinstatement, Judge Tunis recommends an assessment of $43,675 for the costs incurred by the Florida Bar in prosecuting his case.

The report by Judge Tunis is quite lengthy. We will break it down and comment on it beginning tomorrow. For now, we will note the Judge's conclusion regarding the evidence presented at Thompson's Bar trial, as she definitely knows Jack:

The Florida Bar has recommended disbarment for a period of ten (10) years. This Court respectfully declines to follow the Bar’s recommendation... This case involves factual findings of cumulative misconduct, a repeated pattern of behavior relentlessly forced upon numerous unconnected individuals, a total lack of remorse or even slight acknowledgement of inappropriate conduct... 

 

Additionally, the Court is taking into consideration a review of the Respondent’s conduct not only as proven by the evidence, but by what this Court has witnessed of the Respondent’s behavior throughout the eighteen (18) months of litigation. The undersigned finds no evidence whatsoever to indicate that the Respondent is amenable to rehabilitation, or even remotely appreciates the basis upon which a need or purpose for such rehabilitation is warranted...

  

Over a very extended period of time involving a number of totally unrelated cases and individuals, the Respondent has demonstrated a pattern of conduct to strike out harshly, extensively, repeatedly and willfully to simply try to bring as much difficulty, distraction and anguish to those he considers in opposition to his causes. He does not proceed within the guidelines of appropriate professional behavior, but rather uses other means available to intimidate, harass, or bring public disrepute to those whom he perceives oppose him.

 

Thus, after careful consideration of the underlying facts in the instant cases, together with the Florida Standards for Imposing Lawyer Sanctions, the applicable aggravating and mitigating factors and the precedent case law, this Court makes the following recommendations for John Bruce Thompson:


A. Permanent disbarment, with no leave to reapply for admission.
B. Disciplinary costs currently totaling $43,675.35.

I disagree, i am quite surprised in this. While i'm also overjoyed, I say again that this comes as quite a surprise. To see the Bar get an official recomendation to disbar anyone FOREVER... well it's not quite unprecedented, but it's certainly precedent setting, anyway.

169 pages?  My work server won't load anything like that.  I'll have to wait for the analysis, or until I'm home for the evening.

In any case, the simple fact that it's so long probably means it's thorough.  No loopholes, no points left unresearched.

With the flood of releases from Jack today, I'd say he's trying to get one final word in before his legal tongue is wrenched from his mouth.

 After reading the entire report I find that what little I had read in the news didn't begin to tell the real story.

I thought vaguely that he might be an over zealous fundamentalist crusader against porn and a responsible adult trying to look after the children.

Once I concluded the report though it became obvious that at the very least, he has lost touch with honesty and is way into the end justifies the means, no matter who he has to slander.

While disbarring him will help to protect the court system from him, I am a little worried for the rest of us. As a Christian I have decided to pray for him. He is mentally ill and needs some help. Counseling would be good. Medications might help. 

I am afraid that with as little self control and as out of touch with reality as he is, we will be hearing more about him sometime soon. I just hope he doesn't hurt anyone else.

Yes, I'm sorry, but the "news" like Fox and CNN (or 60 Minutes) don't begin to tell the story on this guy. He does what he can to vilify any who oppose him so he can dismiss it when they point out what he is doing. First he throws out how he get death threats phoned to him 24 hours a day by gamers. I don't  know about you, but I just don't care about the man enough to bother calling him. I'm fairly sure it's exagerated and happens no more then any other public figure who posts their home phone everywhere he can. Then every officer, judge, or lawyer that disagrees with him or fights against him in court is obviously being bribed by the industry.

The average John Q. Public only hears about him once in a while, so they don't have any reference when he makes his claims of corruption, they sound plausible. But if you see what has been happening for a decade, the pieces start to fit together and a clearer picture can be seen.

In the end, his story may come out. Who knows, it may even be on 60 Minutes. When they show all of his allegations, his trial record, his public statements after every tragety, perhaps the real story will be aired.

We can only hope that it doesn't have a tragic ending.

(Whistles)  I have often wondered how the bloomin' hell one could not take something like this as a sign that you need to re-evaluate your tactics.  How....if I was a lawyer, wouldn't I want to AVOID leaving a swath of pissed-off judges in my wake?

I'm starting to think it's not just gamers.  I'm starting to think the legal community is getting tired of his little human freakshow.  If this keeps up, in a couple weeks, law enforcement is gonna get tired of it.

Wow, a court official completing their assignment EARLY? I guess there wasn't much "deliberation" needed when the facts stack up like they do in this case. Considering his treatment of her, I wonder if she was giggling as she finished it. And now for the long wait as the final judgement is handed down.

Considering how much he's harrassed everyone involved with the proceedings (including the Judge herself), I'd be more surprised that he wasn't charged with paying all the fees.

Not really, like others have pointed out there is the court's time & resources he as wasted, and because he represents a fool for a client he hasn't had to pay for any of it.

Serves him right, all his other harassing lawsuits were essentially on the house because he didn't have the burden of paying himself and the opposition was the one spending the money.

I think I recall somewhere he even admits that part of his strategy for putting these "unethical" companies out of business is harassment via the courts and wasting these companies time & resources...

Funny how when he does it he gets disbarred and pays costs and when the Clinton administration stated the same thing was their goal with gun companies.  They were applauded by the liberals.  I guess if you use other peoples money to do it then it is ok.

Background, HUD(housing and urban development) sued all the major gun manufacturers supposedly for costs related to gun crime.  Instead of one lawsuit which the gun manufacturers could afford to defend, HUD filed separate suits in every major city.  The Clinton administration acknowledged that they filed suit in separate cities to bankrupt these "unethical" businesses by wasting their time and resources.  Smith & Wesson settled out of court and agreed to stop selling firearms to the public because of this tactic and got preference for Gov't contracts.  It almost worked with the other companies. 

Can't get the constitution changed? Sue whom ever is enabling that right using Gov't tax dollars.  Or in this loser's case your own money.

Let's look at in legal terms. I actually don't think it covers the time of the other lawyers or other people who Jack has purposefully wasted time of.  That isn't that much money, lawyers play for higher stakes then we do.

As for him not having enough money, there are two ways to look at it.

1. That's about 5 MP3's by RIAA standards.

2. I hear he has a 10 million dollar lawsuit in the pipes which I'm sure will be a slam dunk for him.

If thats a real legal document then I'm the last king of Scotland. Where are the pictures and the barbed comments? I did not count a single insult or veiled threat. No where did the Judge mention any TV appearances she made or any prior documents she published. It read so clinical, wheres the emotion and virtol. This has been clearly made as a spoof.

Now granted, my knowledge of legal documents is limited to the ones Jack has filed but I assume all other documents must be written in the same style.

Throughout these proceedings the Respondent faxed his pleadings, motions and correspondence to the Bar and the Referee herein. On a number of occasions the faxes Respondent sent to the Bar were incomplete. When the Bar requested the missing pages of the fax be resent, the Respondent stated the Bar was not to “expect any courtesies” from him. Thus, at the case management conference held on August 30, 2007, the Court granted the Bar’s Motion to Prohibit and issued a written order dated September 5, 2007, that “[a]ll communications and filings by the parties shall be sent by United States mail henceforth. 100 page fax to a local number - free

100 page package through the mail - $5-25 depending on how fast he wants to get it there.

Even a few page submission (5-10 pages) would cost him $1-25 (again, depending on how fast he wanted it to get there.)

Multiply that by 500 submissions over the course of the proceedings, and we have a serious chunk of change being paid out for his "rants".

The same number of trees get used either way.  It's just that with US mail, Jack's the one paying to print all the pages, instead of the owner of the recipient fax machine.

 What little experience I have had with the lawyers taught me that they charge a few dollars every time they have to copy a document, and each of those documents had to get copied a few times and sent around. The document fees were the lions share of the financial aspect.

Thus no indication exists from the totality of the record and Mr. Thompson’s continuing behavior that he will be rehabilitated, follow court orders, and comport himself appropriately and professionally toward judges, attorneys and litigants whose position is in opposition to his.

Sounds very similar to the language they use up here in Canada for "Dangerous Offender" status, ie "keep him in jail until he rots" type sentencing... "no remorse", "no acknowledgement of guilt", "no hope of rehabilitation", "no understanding of what the law is", etc.

And a final kick in the pants:

$43,675 in fees to be charged to Jack, including $1,460 in copy costs. I wonder how much of that was for a new fax machine. ;)

Page 167 was the best part of the whole report, where the Honorable Judge Tunis rejects 10 year disbarrment and suggests lifetime disbarrment. Judge Tunis, I salute you and think you are an absolute credit to moral integrity and intelligence in the legal system.

It's a little more technically than that. More like there was a time when his application for admission to the case wasn't yet approved by Judge Moore (although it ultimately was). It was during this period in which he wasn't yet admitted to the case that he was runing his mouth and falsely telling anyone who would listen that he was an attorney admitted to the case. And, when Judge Moore finally disbarred him as an attorney from the case, he also ran his mouth and falsely told anyone who would listen that he was still an attorney admitted to the case. That's, in part, what's he's been found guilty of: lying about his status as an attorney on the case.

I don't know what "should he find it right to do so" is in the actual quote from A Knight's Tale, but what you put instead fits what a lot of people will probably say to Jack after he is disbarred and can't do sh** about them.

OUCH.  The fine of over $43,000 is the real kicker, especially since Jack has implied that he's more or less broke.  Getting disbarred forever seems lucky in comparison.

I am thrilled that this horrible man is getting his comuppance, BUT... what will happen to his wife and son?  As far as I know they've not played any part in this, so I hope they escape to safety somehow.

Well, for one thing, he does have a more civil persona other than the vitriolic one which he unleashes upon his opponents.. He's also still human, he probably has something which can attract an intelligent and capable woman in his own right..

That said, I'm rather baffled why he has to choose using an excessively antagonistic attitude towards his opponents.. Doesn't charm actually work better anyway?

Jack's mental state has deteriorated at an exponential rate these past couple of years.  At some point in the distant past when he was more stable (guessing pre-1971 since that's when "Computer Space" came out) she clearly saw something in him, and apparently still does.  I have to admire her sticking by him after everything he's put them through.

 Ironically, when the 60 Minutes story including Mr. Thompson aired on March
6, 2005, his “Statement” for Pro Hac Vice had not been date stamped into the
Fayette County, Alabama Clerk’s Office.  See Bar Ex. 3.  In fact, it was not until
March 22, 2005, that Judge Moore even granted Mr. Thompson’s request for
Admission Pro Hac Vice to practice as an attorney in Alabama in the Strickland
case.  See Bar Ex. 4.   Thus, as an aside, Mr. Thompson not only went on a
nationally televised news show and held himself out to be an attorney in
Strickland, when in fact, that permission had not yet been granted to him by Judge
Moore or the State of Alabama, but he likewise has years later repeatedly
continued in various missives, faxes, filings and court pleadings to wear his
appearance on 60 Minutes as counsel in Strickland, as a veritable badge of honor. 
However, it has not been known until this evidence was reviewed, that it is clear he
was not even an attorney pro hac vice in Alabama, and therefore not counsel of
record in Strickland, when he participated in the interview.  As will be outlined
herein, the evidence supports this type of similarly misleading conduct, premised
on falsities, that is frequently repeated without purpose, through many of Mr.
Thompson’s actions.

Hear that? JT's much lauded 60 Minutes appearance was a sham, too, and not just because of the videogame angle. Aw Jeah.

Judging from what we've seen from JT here on GP and other sites, I wouldn't consider that likely at all.
It appears as if he is completely unable to recognise that he has made a mistake or behaved inappropriately in any given situation. Its never connected to him, its always someone else who is to blame.
That will also be true here, he will never admit defeat, never surrender, never quit. That's what scares me about JT to be honest, his utter relentlessness, atleast his influence will be neutered somewhat when this recommendation is followed.

I am in awe.  I have been following the activities of JBT for a couple of years (Since the end of Howard Stern) but had no idea just how much of a complete and total idiot jackie is.   Well no I had some idea (hard not to) but the confirmed paper (fax, mail, email etc) trail proof of it is... impressive and heavy enough to bury a fool alive. 

Tis a pity wackie jackie I had expected more out of you for all your ego and boasting. Well no not really but trying to be nice even to you, like most posting types here I knew better.   Ah well.

Over a very extended period of time involving a number of totally unrelated cases and individuals, the Respondent has demonstrated a pattern of conduct to strike out harshly, extensively, repeatedly and willfully to simply try to bring as much difficulty, distraction and anguish to those he considers in opposition to his causes. He does not proceed within the guidelines of appropriate professional behavior, but rather uses other means available to intimidate, harass, or bring public disrepute to those whom he perceives oppose him.

While I know you are going to go through it(I suggest just to make it a update to this article to calm those "STOP GIVING HIM ATTENTION WITH ALL THESE STORIES" posters), that bit is pretty much all that needs to be said.

As an attorney and a gamer, I am of several minds on this one.

First, there is an incredible outpouring of sheer, uncompromising "Ha, ha!"  The game industry and video game culture's chief antagonist got very publicly slammed.  Now, he's not down yet, as the FL Sup. Ct. still needs to check the appropriate boxes, but he's on the ropes and staggering.  As a gamer, remember today.  Today is a good day.

Second, this is a reminder that, as ill-favored as lawyers are by the rest of society, the worst of our breed do get removed by the rest of the profession and that, as a whole, we're at least trying to be good people.  While it's fair to question how often it happens, we do police our own ranks.  The Bar trial and Judge Tunis' report hopefully sheds some light on this process and all of its perhaps-flawed machinery.  We too are disgusted by this man's actions, we too are horrified by the filth he has spewed, and we too want to see an end put to it.  But did the Florida Bar wait too long before going after Jack?  Yes, it probably did.  He's ruined lives and cloaked himself in the garb as an officer of the court for more than a decade.  I believe there are serious, founded Bar complaints about Jack going back to the early 90s.  Taking action then would have benefitted the profession and society as a whole.  However, Bar prosecutors have other cases.  Lawyers steal from clients.  Clients falsely accuse lawyers of stealing from them.  These are Bar cases with more concrete outcomes that may have taken precedent.  It's unfortunate that we have had to deal with Wacko Jacko for so long, but part of the reason we have had to do so is that he's just so far out there, so far beyond any of the "normal" disciplinary actions, that I suspect that the Florida Bar prosecutors office couldn't quite make out what to do about the man.  It took the complaints of multiple judges and "respected" attorneys to finally compel them into action.  Is it right?  No, not really.  JackDon'tKnowJack pointed this out most forcefully months ago, and he's absolutely right.  It shouldn't matter who makes the complaint, but it did.  This isn't right, and the Florida Bar owes a lot to Jack's very real victims as a result.  But now it's all but over.  Sure, as above, the Supreme Court has to sign off on Judge Tunis' report.  It's spectacularly unlikely that it will do anything but, though, considering that it has been the recipient of Jack's pornographic onslaught.  Jack Thompson, Attorney, is consigned to the dust heap.

Here's the other side of it, though.  For a professional, this is like looking into the abyss.  This is, quite literally, the worst fate possible for the title of attorney.  Jack as a guy will walk away the same as he walked in (apparently unshaven), but Jack Thompson, Attorney got burned.  Bad.  He won't just be legendary in gaming circles for his rise and fall, but this report, or exerpts thereof, will be standard fodder in Florida law school ethics classes (required by law, by the way - all of us take ethics after Watergate) for a generation.  His name will be used as a shorthand for an impossible meltdown of a professional career.  "Hey, did you hear about that guy out in Albany?  He's in danger of getting Thompson'ed."  That, more than anything else, will be Jack's legacy.  His name will be synonymous with downfall, with the public, humiliating end of a career in a profession that many of us feel called to as powerfully as any who take the priest's collar or the soldier's gun.  Jack Thompson, Attorney, has given way to Jack Thompson, Disgrace.

And you can't look too deeply into the abyss without getting that prickling sense that somewhere in its black malevolence, it's looking back at you.  Anybody with an ounce of empathy and a Bar card winced a little when they read this report.  It's a rebuttal and effectively an endcap to his life's work.  Nobody wants that.  Frankly, I couldn't have wished this on Jack.  It's not funny, it's not fair comeuppance, and it's not karma.  Nobody deserves this at the point in their days in which they are looking back at their careers more than they are looking forward.  Don't point and laugh too hard without considering this.  God forbid, we could all be him, blinded by our causes and unable to comprehend just what we have done in their defense.

I agree, there is room for some pity here, sometimes I felt like screaming 'For God's sake, man, just stop!', not because he was a threat, but because it was actually painful to watch him not only reach the sanity event-horizon, but cross it at full steam.

No-one deserves to end their career like this, I'll agree, but still I find it hard to sympathise with the man. Maybe, once his license is removed, I'll have time to think more deeply on his plight as a person, but right now, whilst he wields that law license like a baseball bat, I cannot help thinking of those he has attacked and insulted over the years, whether he ever stopped to consider their families and livelihoods before sending off all those Emails, Faxes and letters. He fully expects people to consider his family when he is under attack, but how much time did he spend considering other peoples?

I'll agree, he's finished, and yes, maybe in the future he needs to get some help, but, from my perspective, the first priority is to stop the damage he's doing to himself, to his opponents and to the legal profession in general.

I'm going to have to disagree here, unfortunately there are folks who deserve this.  Jack is one of them, and I do pity him for it, but I won't say that it is undeserved, or unjust. What folks deserve and what they might like or want are not the same thing.  What one sdeserves sometimes isn't kind, and often isn't delivered.  But that doesn't change what is deserved.

I doubt this is much of an 'end' for him.  His success at practicing law has been dropping for years now so it probably was not much of a career at this point.  What it will be is a potential springboard for milking groups like that freedom festivil or the eagel council (or whatever they are called).

There is a certain segment of american culture that loves to think of themselves as persecuted and they might flock to JT.  If he plays his cards right (which is doubtful) he could use this disgrace to actually get some real power.

Very well said Anonymous, I agree that each and every person has somewhere deep inside something for which they'd go to similar lengths as JT has, to defend it to their last breath.
It is however never pretty to watch someone like that go down in flames like this.
Having probably done more harm to the object they sought to protect or promote than its opposition ever could.

Zealotry regardless of the shape it takes is never a good thing.

OK, I have empathy (or at least I'd like to think so) but no Bar Card, but...

When I think of even half the things that JT has done (example: "go play a suicide game and get real good at it") I find it harder and harder to sympathize with him. Yes, his downfall will be spectacular, and he will, god willing, be very sorry afterwards. Maybe a case can be made that he didn't deserve it. But undoubtedly, and more importantly, demonstrably, he bought all this on himself. He has no one to blame but himself for the situation he finds himself in.

I read every last word of that and I appreciate it as someone who's been more toward the right end of the sliding scale of Idealism vs. Cynicism lately.  I mean, lawyers are essentially mercenaries, right?  They don't produce anything; their job is to guide people through a system they invented and occasionally attack other targets on demand.  I hope there are more good lawyers out there than I beleive though; honestly I'm uneducated about them.

The root of this though is that Jack is highly religious.  He believes that no matter what he does, God will take care of him and smite all who opposes him.  Maybe he's counting on all his repititious prayer or something.

God has ethical standards too though.  Hell, he wrote the book on them.  So you could say that Jack has failed not only in this plane, but the next as well.

There's always time to right oneself as long as one has life, but I don't believe Jack will anymore.  It's all up to him, and he's happier living in a world where everyone is in a conspiracy against him.  Why?  Because that's the only way he can be "right".

You are right, there is a degree of pity to be alotted here, though from me it's simply a pity at seeing someone basically fall into the depths of insanity. To me, it's the equivelant of seeing a former CEO of an evil corporation begging for change. Not pity for what they were, but pity for what they are now.

As for pity to his career, I can't feel that same level of remorse. This was not an orchestrated assault on him that he couldn't win against This was him lashing out at anyone who wouldn't follow him and instead of taking a step back and looking around at where he was headed, he charged in head down and now is on the peripice. And yet, instead of trying to make amends and to be responsible, he chose to continue to lash out.

This isn't a hard fought battle, despite what he's claiming. This was him seeing the abyss on one side and solid ground on the other and choosing the abyss.

Would I wish this? No. I would never wish it on anyone. But this was his own doing and though we mocked and jeered him, we had little to do in the things that are really impacting him. The only orchestrator of this disaster is the one it's happening to. Hoisted on his own petard (or several in this case) to coin a phrase.

My pity is reserved for the insane little man that cries out, not for how he got there.

Normally, I'd be inclined to agree with you. However, there's a difference between being blinded by a cause and being a bully. There are ways he could have defended his cause to his dying breath and not been known to repeatedly "strike out harshly, extensively, repeatedly and willfully to simply try to bring as much difficulty, distraction and anguish to those he considers in opposition to his causes." There is a line between devoted and malicious that Jack crossed far, far too many times.

Even blinded, he could have played by the rules, or at least broken them in such a minor way as to help his cause without causing too much damage.  However, Judge Tunis stated that he "does not proceed within the guidelines of appropriate professional behavior, but rather uses other means available to intimidate, harass, or bring public disrepute to those whom he perceives oppose him."

Blind devotion is disturbing, but pitiable. Malice, however, is not. The efforts that he has repeatedly taken (and continues to take) to bring grief and suffering to others is not simply a case of unbridled zeal. I believe that it most certainly is fair comeuppance and, if anything, he's getting off light. After all, he's not being held criminally liable for the threats and harassment that he so generously ladled on his enemies.

I have no pity for Jack Thompson. I pity his son.

Your arguement is deep, impassioned, and logical. I cannot help but respect your convictions and position.

But at the same time, I respectfully disagree. He continued down this road for a blisteringly long time, and ignored all the warning signs right up to and including the proceedings of the trial. To use a metaphor, I have sympathy for someone who steals metal artwork to feed his crack addiction (might like I dislike Mr thompson) but I have no sympathy for the same who breaks through three heavy doors at a power substation to steal the cabling, only to get electrocuted and killed. Sad, but one did ignore all the warning signs on the way in. Similarily, Mr Thompson chose to ignore all that was before him and set himself on the path. He's harvesting the crop that he has sown, and I for one am thankful that his family has a mother that can support it.

Yes, I can understand that you are wincing at the fact that he has put himself out of his line of work forever, and etched himself into the legal equivalent of a military marshal Bazaine, but it was his own ignorance and blindness that did him in. He was given enough rope and wood to build a raft to save himself from these consequences. He merely chose to build a gallows instead.

Stupidity is its own reward. So I shed no tears that Mr. Thompson is getting the reward he has labored so long and hard to achieve.

But "you" don't do it efficiently, "you" do it with low standards, and "you" don't do it in a timely manner. Yes, he might become a case study in ethics classes. And what will this teach future lawyers? It will teach them how low they can go, and that is pretty low. Fare to low for considering the bar disciplinary system anything else than window dressing. Jack Thompson has show us how much the system is willing to tolerate. He pushed the limits, so those coming after him now can estimate the safety margin within they have to operate to not be disciplinated. And that margin is fare to much in the black for my liking.

Bars work like cartels. They are there to ensure those that are in can prosper, that those who are out can't, that only the ones with the right pedigree get in, and that there is an esprit de corps among lawyers so it takes absolutely unbelievable outrageous, below all codified standards, continuous, persistent, highly visible, public misbehavior to even be considered for a disciplinary action.

I wish someone has the guts, the money and the perseverance to sue the bar for a couple of million $$$ for not acting on the early complaints. Yes, I know about the chance this happening, yet alone this being successful. But the zero chances alone tells a lot about how broken the system is.

His career is most definitely not over, there's always a management position available at the local McDonalds, where he can pass judgement on what he considers violent toys in happy meals. Maybe he can make the connection there between the evils of plastic toys and fighting amongst siblings.

I cannot fully agree with you.

I cannot feel any pity against this man.  He alone brought this on himself.  Many times he cried foul over the very tactics he frequently used on others.  Never once was logic, compassion or fairness ever a part of his gameplan.

The fact that he will likely never, ever, admit to himself that he caused his own downfall, that fact alone kills any pity I might have.  The complete lack of self doubt, the complete and utter lack of understanding that you cannot do good by doing evil, that quenches any pity from me.

I'll admit to enjoying this fall...I'm human. 

More than glee however, overwhelming feeling I have is relief that a major resource and weapon has been taken away from someone so incredibly contemptible.

All my pity for Jack Thompson died long ago. It died with Flowers for Jack. It died based on all the terrible things he has said to people and the undisguised glee he has expressed when anyone he percieved to be a gamer was hurt in any way. Judge Tunis's recommendation just reinforced that position becuase I was able to see how badly he has hurt other people and for how long. For a long time I did pity Jack -- I think he is mentally ill. But my resevour dried up. He's hurt so many people I can't feel sorry for him anymore. Frankly I don't feel sorry for his wife either -- she funds his crusade. Through her money he is allowed to continue to behave in this fashion and that makes her complicit. In their family the only one who has my pity, empathy or sympathy is his son. Can you imagine what that kid has put up with in the last ten years?

I can understand what you are saying about looking at the abyss as a professional. But just because it is sad that someone has made choices that led their life to this point doesn't take away from the fact that it was his choice. It isn't like he made the mistake once and was never given the opportunity to correct it. That I could pity. But Thompson has been doing these same things for more than a decade.

 Abusing the authority of his office is one of his crimes, but I'll never forget the day I saw him taunt people who were mourning the suicide of one of their friends.

Thing is, I remember when Mr Thompson went out to destroy the career of the person who runs this very site, he was continually contacting his Boss and harassing him and attempting to undermine his job. I saw no evidence of concern for his family, no evidence of anything other than a vindictive need to lash out and harm people merely for not agreeing with him.

Now that his fallacy has been revealed, we are all supposed to be concerned about his family?

Why?

When did he stop to think of the families and livelihoods of those whose jobs he attempted to destroy out of sheer vindictiveness?

Normally I'd be of a mood to 'rise above' Thompson's level, but in this case I simply cannot, he tried to destroy people's jobs, famlies and livelihoods to suite his own selfish goals, and he is getting precisely what he earned for himself.

Being better than him is one thing, I wouldn't attack his family or try to destroy his livelihood, he did that all by himself, and he would have no qualms whatsoever about attacking me, regardless of the effect it would have on my wife and child, just as he tried to do to Mr McCauley and his Newspaper reporters job, in fact, he would prefer to try to destroy my livelihood and my family to actually facing me, he's a backstabbing sort of person like that.

So yes, I wish his wife a speedy recovery, I hope his son manages to grow up moderately unscarred from his father's abuse of his age. But Thompson is insured, I remember Norm Kent stating that Thompson's insurers had to pay a five figure fine to one of his clients for libel, so I doubt the actual fines will hit him that hard, and as for the loss of a livelihood, I can't feel pity because it wasn't a sad accident, it wasn't a constructive dismissal, it was a man who took a 90 day suspension and managed to stretch into a lifetime disbarment through his own abusive action.

So, his family have my commiserations, and my hope for the future, but sympathy is a little too much to ask from me, they have a problem there, and they need to deal with it, and when they do that, then I will be happy to support and hope for a positive result, and, once Jack admits to having a problem, then, quite possibly, I will start to feel some sympathy for his situation, but right now, I've given him as much leeway as he is prepared to give me. Absolutely none.

To be happy that someone got a fair and reasonable sentence for their misdeeds will NEVER make us the same as the person who committed those misdeeds.

 

It is JACK THOMPSON who made the decision not to think about the consequences to his family and friends. He refused to give up his selfish, childish way of acting even when it became clear he was going to be severely punished if he continued.

Frankly, I hope he loses sleep over it, but I doubt he will.

Of course, we still have the token "this is the best thing that has ever happened to me, and now I will destroy the bar" release to look forward to.

JT said that his opponents would have to get criminal defense attorneys weeks ago.  He also claimed that his situation got him some high-profile allies who will help him destroy the bar and put judge Tunis (and others) in prison.  Oh, and let's not forget his Take Two "client" as well as his mystrey "client" who claimed he was the only lawyer in America who could help. 

Not only is the story of Jack Thompson a cautionary tale for young lawyers, but also for people who wear their religion on their sleeve.

Second, some advice for Jack.

Remember, when you are going on interviews, always shave beforehand. Management doesn't like scruffy looking people. Second, be polite and wear a suit, or at least a tie if you have to sell your suits in order to pay your new legal bills. Third, mentioning that you were on 60 Minutes would be a bad idea. Most management hear "60 Minutes" and go running for the nearest exit.

And finally, always remember to say "Would you like fries with that" if they don't ask for them. Upsell, Upsell, Upsell.

It's mostly to cover the costs of paying the people involved whilst they waded through the mountain of paperwork Thompson submitted.

Personally, I don't think it's uncalled for, certainly Thompson never gave a damn about the futures of those whose careers and livelihoods he attacked, so I feel no compunction to feel that way towards him. Once, maybe, I might have, but he needs stopping and he needs to learn that what he did was not only wrong, but incredibly unethical, vindictive and selfish.

It isn't a fine. It's the costs associated with having to prosecute Thompson. And those costs are ones which shouldn't be borne by the taxpayers of Miami-Dade, particularly since Thompson, by his conduct, needlessly caused his proceeding in the first place and, utimately, also caused those proceedings to be more cost-comsumptive than neccessary by dragging it out ad nauseum. Furthermore, as has been repeatedly noted here, Mrs. Thopson is a very well-to-do attorney at a big-name, white-shoe, silk stocking law firm.  The Thompsons can find $44k. I'm sure there's easily that much equity in their $1.5 million Coral Gables house.

I've got to wonder for how long his wife will be able to afford him and support the family. She is a well to do Attorney in a big name law firm today. But she is married to the man that, as an above poster pointed out, is now going to be the case study in Florida (and other states) Legal Ethics cases for several generations. Would you trust your legal work to the spouse of "Disbarred Unethical Lawyer Zero"? How about trusting it to the firm that she works at?

She is now a liability to her big name law firm. A huge one. She will probably soon face a personal decision between watching her hard won career evaporate, or cutting loose her obviously mentally ill, yet toxic spouse. Not a good osition to be in. And all this on top of cancer? We comment about how much Jack obviously didn't care about the damage he did to his victims families. Obviously he hasn't cared that much about what damage he does to his own as well.

I am glad to see John Bruce get what I feel is a fair and just ruling.  It seems harsh that his career is completely destroyed and that the recommended fine seems steep but he brought it all on himself.  It would not be fair to have the taxpayers pay for costs that he intentionally brought forth with forethought.  He continues to lash out at those deciding his fate.  He is a fool.  A little humility would likely have gone a long way, had he shown any, throught this entire proceding.  Instead he chose to abuse the legal system to further his own agenda and when others tried to tell him to stop with his tactics, instead of stepping back and looking at changing the way he did things, he chose to ignore those people and attack them using the same tactics.  People like this need to be stopped.

Jack Thompson is a bully.  In fact, he is more than that.  He is a terrorist and needs to be treated as one.  Sure he doesn't kill people but he uses the same tactics.  He tries to impart his own beliefs and his own agenda through fear and intimidation.  If you do not follow what he believes, he will turn his terror tactics toward you without any regard or remorse for the collateral damage he causes to others who happen to be caught in his path.

He deserves everything the judge recommends and more.  People have no faith in the legal system because of people who abuse it and Jack is a major offender.  More poeple need to be made an example of, not just lawers, but anybody who abuses the power then are entrusted with by others in order to selfishly further their own gains.  Political leaders who line their pockets, social figureheads who outcast all those who do not follow, corperate leaders who steal money from their employees, priests who intimidate children for sex, managers at fast food who break labor laws by threatening to fire their minimum wage employees.  Obviously some of these things are more severe than others but they all illustrate a willingness to abuse power.  Power is entrusted to people and its abuse for terror tactics should not be tolerated and punishment for it should be strong and swift.

Jack deserves jail time for the assults he perpetrated on others, trying maliciously to harm their reputations and their careers.  Retribution is here for those he attacked.

If the world never hears from him again, it will be too soon.

We're not done yet, the reccomendation could be ignored, but I'm glad Judge Tunis took her time to compose her thoughts.

 

We gamers are all-too-easily painted by the words and actions of the most extreme. As a growing percentage of the population, those who speak out attract note among those seeking to frame us in their world views.

And now, we see the other side's most vocal extremist hobbled, and has been said, 'On the Ropes'.

In the time since I've come to be aware of his existence, Mr. Thompson has never shown pity nor the faintest attempt to understand or grow. He listened only to our worst and insulted our best, met our kindness and sympathy with threats and invective.

A year ago, I was worried that something would happen at PAX if he showed up unannounced. This year, there is nothing left of him to be afraid for his safety. He lacks the wit to deal with us, he lacks the grace for self-introspection, he lacks the credentials (or will be seriously damaged by) to appear as anything other than Jack Thompson, former attorney and game critic. He would just be another attendee among the throng, another face. Even if he was recognized, this document makes him safe, gives him a clean slate with us.

We have learned his greatest moments in the media were lies. We have known his true character. All he has left is those who would award him based only on his idealized message without looking at method or fact. And that is a far less troubling group than what he had during his Halcyon days of hot coffee.

I believe jack is out of 'lulz'. They've been condensed by Judge Tunis into 169 pages, and it is up to Jack to become anything of further interest to the internet's pop culture. His name is now linked to grevious misconduct, bullying, and intimidation tactics in the legal system, and that is how he will be remembered. A case study, a profile, a man only known for being abusive and spiteful.

He was the best champion for the anti-gaming minded that we gamers could ever hope for, and in this document, he has been rendered pointless. But what he was will linger, hurting his cause, for a long time, possibly until the hysterical, baseless rhetoric stops.

Thank you, Jack, but even if you retain your status as an attorney, Judge Tunis has brought us to the point where we are done with you. All the facts, all the testimony, all that made you our hated opponent have been stripped from you. There will be no further book deals, no more chances to explain. A moment of silence, then, for the toothless Thompson.

A lifetime disbarment, while horrible, means nothing without a lifetime gag order on him and his entire bloodline.

He can still stir up trouble even without a lawyer's license. And since he's so willing to abuse that power as a lawyer, he's going to abuse his rights as a free citizen as well. And his family as well.

After disbarment he can't fling subpeonas at anything who doesn't agree with him.  Excuse my bad language, but he's just another (beep) with a (beep)-y opinion.  Let him howl to the moon if he likes.  Contrary to whatever it is Jack may believe, I'm not dead-set against his agenda, I just don't like his tactics. He thinks the courts are his own personal cudgel to bludgeon whomever he pleases, and that, to me, is what's offensive (more so then the discussion regarding violent games and their consequences.)  A discussion is just a discussion, I have no problem with rational discourse.  Frankly, even if it means laws we don't agree with, we all abide by portions of the law that we don't agree with every day of our lives.  Game law wouldn't be any different.

First, just as the Referee (Judge Tunis) was not bound by the Florida Bar's recommendation, so too is the Supreme Court not bound by hers. But know this, the Florida Bar News just this week published an article of how the present Supreme Court has been significantly more harsh and severe in its sanctions against attorneys for professional misconduct, and how 'progressive discipline,' or prior conduct, is a critical factor.

Though Mr. Thompson claims to have been an attorney in good standing for 31 years, he was given a public reprimand in 1992 for a violation of comparable Bar rules, involving those now famous episodes which he was required to go for a psychiatric evaluation.  Considering his lack of remorse, contrition, and continuing offensive conduct, it is reasonable to assume the present court, which has already sanctioned him for being a vexatious litigant, and whose order of March 20, 2008 Thompson has now defied and ignored, will fully and swiftly adopt the recommendations of Judge Tunis, probably before the end of the month.

Once so adopted, the Supreme Court does not have to give the respondent attorney any opportunity to 'close out his practice,' but has the right to order disbarment effective immediately. That too is a reasonable assumption in a case like this.

In her conclusion, Judge Tunis took note of even a fifty year old case where a single instance of calling a jurist a bribe taker led to disbarment. Here, the situation is aggravated by multiple instances of recurring and ongoing behavior.

Thompson's done, his goose is cooked, and the Supreme Court has been waiting for this ruling to impose its final sanctions. By this time next month, he will not be a lawyer. He will be filing law suits as a lay citizen, if he is allowed to step in a courthouse, which may be unlikely based on his bizarre and dangerous behavior.

And if he refuses to pay the fine, he'll be unable to practice law even as a layperson.  I can just imagine him spamming "lawsuits" to all of the courts and ignoring this ruling.  (And anyone want to bet he'll continue to use his infamous "Jack Thompson, Attorney at Law" stationary?)  He'll end up in jail before this decade is out.  You heard it here first.

That was a good thousand years or so earlier. The English Civil War was in the 1640s (with a few scattered battles up to about 1653). The Arthurian period, or the early Anglo-Saxon period, was between the Roman withdrawal from Britain in the early to mid 400s, through to about 650.

Wow, just finished reading it!  While the first part was basically a recap of the last few years, the funny thing is that after you sort through all the legalese the conclusion pretty much just says:

"You're a clueless asshole, so you lose your job."

It only just occured to me, but; how good is it to know that the people that Jack is answerable to understand how much of a douchebag he is?

I don't know if its just me, but I always worried that Jack would be able to pull off an air of respectability and no-one would listen to all the complaints about him. Its good to know thats not the case.

Wow! I just read the whole thing... what a freakshow. It still leaves me stunned, the sort of document you never expected to see. I mean how many published Judicial decisions do you see that prominantly use the word C**TFLAPS? And generations of Florida law students will be reading it!

I still have to wonder what is wrong with the Florida Bar? Based on reading that whole thing, they obviously knew exactly how crazy Jack was since 1989. Yet they let him keep on being a crazy lawyer for 20 years, until he finally went batsh@t crazy on some actual lawyers and judges? His treatment of the general lay public and individual citizens wasn't enough?

To be honest, that's something I wondered too, the man should have been out of his job years ago, but the Bar refused to act.

In part, Jack Don't Know Jack explained that the people who were complaining weren't 'influential' enough to have an effect, but I also think the other part is that disbarment is such a major punishment, it's essentially worse than simply being 'sacked' because it removes any possibility of finding a similar job elsewhere, ever. So I believe that Disbarment is only used in the most severe of cases, and is examined in microscopic detail for validity before being recommended.

To a certain degree, I can understand that, but it still took a heck of a long time to reach this point.

That was an amazing document. To see all of Thompson's.....crap....lined up like that in a sequence you could understand. I really gave me a feel for how badly he has harassed people over the years. Judge Tunis is an amazing person. I hope her recomendations are taken to heart by the Florida Supreme Court.

Well, you have to remember that most would insist that, based on their experiences with attorneys, I spin sweet lies for a living.  For a first post by a long-time lurker, I'm glad it provoked the thoughtful responses it did.  I wasn't so much calling out for sympathy for the devil, though, as much as I was trying to point out that this isn't something to crow over.

Jack is a loathsome individual.  His actions throughout the Bar proceeding have demonstrated that he has no comprehension of his actions, much less remorse for them.  He deserves no pity, no empathy, and no heart.  However, his decline and fall is (hopefully!) so complete that it's hard to point and laugh.  I'm revealing something of my academic heritage here, but trace a line from Sophocles to Camus on the thread of personal downfall.  The question of how one does (or even can) react to such a complete tragedy on a personal level, at least for me, carries over here to the professional.  Law was one of the four original professions (discounting prostitution), and, as I noted in my original post, that Matters to some of us.  Jack's been handed the equivalent of a dishonorable discharge or an excommunication.  If "Jack Thompson, Attorney" was what made Jack Thompson who or what he is, losing that all-important suffix is a repudiation of all of the values that he's built his life around.

That's going too far.  Losing it should be a repudiation of the values the members of his profession swear to uphold: service, the pursuit of justice, assistance to those in need (no, I am not a white-shoe, silk stocking lawyer; can you tell?).  Losing his law license may be nothing more than another brick in the conspiracy wall for Jack.  Because, as we all know, he's insane.  So no, I don't have any sympathy for him.  He should rot forever for the harm he has caused.  I do have empathy for his position and the tragedy that it entails for those of us that care about the law.

I think that's enough on Jacko.  From here on out I'll stick to explaining the Hart-Scott-Rodino Act in Take 2 threads.  Much more fun.

I agree, if the only think that Jack can use to define himself as a person is that he is an attorney, and that he's a Christian. Sadly, neither one of those is a good way to describe 'who' that person is, as in their character, what people think of them, and how they lead their way through life. With that said, we all have some clever adjective to describe Jack, of varied levels of intelligence or profanity, and sadly that truely does describe what kind of person he is. I've known people who are described in the same sentence as being a pain in the ass, but also being very good at what they do. This is not a way that anyone would describe this rather pitiful fellow, because he has no redeeming qualities that any of us can list.

I would pity him, I really would, except that pity is for some poor soul who has done their best but did not win. It's not for one who has decided to do their worse in order to hurt others and bring pain to everyone who comes near them.

I just... I really want to know how it is possible. Jacko went through law school (presumably), and passed the bar exam. This is not something that any random putz could do. So why, after all that, does he do this kind of thing? Maybe he was quiet for a nice long undistinguished career, got older, and felt the itch to go out and cause trouble. Or maybe he went nuts. Heck, maybe he's just bored and pissing off judges is how he gets his kicks. I can certainly understand getting bored, but how much of a breakdown does a lawyer have to go through to piss off a judge badly enough that she will write a 160-page report on why he should be summarily thrown into the legal equivalent of a deep fryer?

One of my favorite bits that I've read so far was the entire "They asked Thompson which of the four binders contained the exhibit he was talking about. Thus provoking an epic discourse on the World as Seen through Jack-O-Vision."

Does the judge have a clerk?  Some of the writing has that combination of energy and new-lawyer outrage that you just don't get in most solely judge-written opinions.

I think not like the federal courts or some state high courts have "clerks" (i.e., the top 5% at Harvard and Yale types). Most minor lower courts have full-time staff attorneys on the payroll and every judge has at least a "judicial assistant" (i.e., two steps up from a secretary), but no "judicial clerks" as the term is commonly understood.

Judge Tunis also turned down the Bar's offer to take a first crack at drafting her Report for her, insisting she would do it herself. Either she wanted to have all the fun drafting or she wanted to personally dot the "i"s and cross the "t"s so Jack can't come back on her. Probably a little bit of both.

It's tough to describe my reaction to this. It's almost as if Jack made me a better person. His hateful speeches with a Bible in one hand and a microphone in the other made me want to be a better christian only because I knew people would see what he did and apply it to us all. He made me strive for excellence in my job so that people would know that game developers (especially programmers like me) aren't anti-social nerds with a pentiant for slinging filth to children (you'd be surprised how many times it's come up). And now I want to extend my condolences to him simply because I know he wouldn't do the same for me. We have a real opportunity to show our maturity as a community... although I really really really would like one of those t-shirts...

I find it damn near impossible to feel the slightest shred of pity for the man. After all, he has spent several years: -Harassing hundreds of people, certainly causing immense amounts of stress on a number of those, many of them not even remotely connected to any case he was pursuing at the time. -Childishly lashing out at anyone whose opinion even slightly skews from his. -Wasting countless hours of court time better spent on actual crimes, not to mention the wasting of taxpayer money caused by this waste of court time. -Ranting incoherently about the same selfpromoting bullshit for years on end. -Conducting himself with a seemingly complete inability to behave with even a minimum of civility, even towards the people that decide his fate as a lawyer. JT has nailed himself into his own coffin over the last 18 months. Had he behaved and acted respectfully throughout the trial, admitted even SOME wrong doing and shown ANY remorse, perhaps he would be looking at a 10 year disbarment or maybe less.

But no. The fact that over the last 18 months JT has acted and shown him self to be just the person we have known him to be for years, has dashed any chance of leniency. And he has nobody to blame but himself. He REALLY doesnt know when to quit. But at last, it has backfired on him.

 

Watching JT over the last 18 months,  has been akin to watching a psychotic arsonist on trial, claiming that he has never burned anything in his life,

whilst at the same time standing in the centre of the courtroom, next to a makeshift bonfire he is actively making from legal files, paperwork, broken desks and chairs, dousing in petrol, and frantically twitching and striking a box of matches.

On top of that, he COULD have just taken a 90-day suspension and been done with it, but instead he flung insults at those who offered it.  Right before his trial started, he was whining that he wanted to take the deal, but it had long since been rescinded.

A nasty thought

Just had a thought about something he might try. He has always tried to escape his come-uppance on technicalities, for instance; announce to run for a Judge's position in order to force a recusal, bringing up the crazy loyalty oath ploy in order to have the referee removed, etc.

What are the odds that he will try and resign, or leave his profession, so to keep saying "I was an attorney for blah blah years in good standing until I became dissillusioned with the bar and had to leave", in order to avoid his disbarment. Same result, but this way he would keep crowing about his "victories".

I can't see it happening though, his narcissism won't let him back down, and he's probably learned from before, when he tried to quit the Alabama case but the Judge made him stay so he could be rightfully kicked off!

He can certainly resign as a practicing attorney.  But he would technically still be a member of the Florida Bar until his membership ran out (not sure what the term is before you have to renew).  So the Florida Bar could still disbar him in order to prevent his practicing in the state again.

I'm pretty sure there is no way of resigning your bar membership, you just don't renew it if you aren't interested.  He's technically "paid up" for the year (or 5 years, or however long the term is) and is therefore a member as long as that term lasts.

The only thing Jack can resign from is actually practicing law, but not his bar membership.  That lasts until he either allows it to lapse or the bar kicks him off and I imagine the bar has an interest in kicking him off before it lapses for just the reason you said.

It's a testament to the mild temperment, positive disposition, and general well-rounded goodness of the gaming community that nothing has happened to Jack Thompson, despite the fact that he routinely goes on TV an in courtrooms defaming us as a whole.

If you went on TV to give the same terrible qualities to ANY OTHER COMMUNITY, he would walk around with a loaded gun. It would be a DEATH WISH. What do gamers do? WE SEND DONATIONS TO CHARITIES IN HIS NAME.

Once he's disbarred, I think Jack will wind up on the lecture circuit.

 

And he could make a real good living doing it as well. Look how much Bill clinton makes on it. Millions a year. And I'm sure there are alot of ultra-conservative groups who would love to hear him speak.

Hotel paid for.

Meals paid for.

Transportation paid for (about 50% of the time)

 

So, free plane ride, free food, free hotel, and getting paid 25-20k a pop. Not too shabby.

Reading this document has made me feel ill.  The targets of Mr. Thompson's campaigns of falsehood and humilation have had to endure blows to their reputation and mental well being.  I cannot begin to imagine the actual misery inflicted upon these people.  My regret is that disbarrment will not stop Mr. Thompson from continuing to slander and libel these people, it will only prevent his ability to do so before a court as a lawyer.

It wouldn't surprise me one bit if there aren't a ton of lawsuits against Jack just waiting to be filed.  I imagine they are just waiting until he is officially disbarred.  His disbarrment can then be used as evidence against him (and pretty damning evidence) of his bad conduct towards various individuals.

Where exactly does it go from here? I would imagine that if the bar carries out the ban, he will go through the various appeals processes. Correct me if i'm wrong, but aren't most of the judges on those supreme courts of yours appointed by your right-wing pro-christian president? It is entirely possible that they might decide to overturn a decision against a right-wing pro-christian nut?

Most politicians are eager to hitch their wagon to the games are bad horse..

Regardless of whether a right-wing pro-Christian politican or judge sympathizes with Mr. Thompson's positions, their primary obligation is to uphold the system.  As an example, Judge Friedman in this case clearly felt that Bully was offensive, but he recognized that there was no legal means to prevent its publication.  Similarly, there is no basic legal recourse to overturn this decision unless startling developments or improperly filed paperwork surfaces.

However, that assumes that right-wing pro-Christian politicians actually sympathize with Mr. Thompson, who has attacked right-wing pro-Christian supporters and lobbyists as well documented internally.  He targetted business associates of the Bush family, which makes him a bit of a pariah.

It also needs to be remembered that even if a Judge sympathised with Thompson's campaign, which he may do, he also does NOT wan't to set a precedent that members of the Bar are able to make false statements about Judges in order to get their own way, regardless of the cause, because something like that would come back and haunt them in the future, they know that, and I'm pretty much 100% certain now that they will act appropriately.

It also means that, should the Supreme court decide to show leniency, or should Thompson appeal the outcome, rather than getting 10 years lowered to 5, he would get permanency lowered to 10, so either way, it puts him out of the loop pretty much permanently now, I think that is part of the reason behind the increase in the recommended punishment.

actually the main problem with Jack Thompson is NOT his crusade...

personally, i find both Bully and GTA very distasteful (even if i have played the former extensively in the past)

What really gets into people's nerves is the fact how he conducts these crusades

 

To sum it up, even if he has the right motives (which i doubt) and fighting for the right cause, if he does it the wrong way, it's still wrong. The end never justifies the means.

As far as the games go, yeah, I have a beef with Rockstar too.  It's like they create games like State of Emergency and Manhunt 2 simply to scare people, and that holds the entire industry back.  Many people don't understand video games yet, so Rockstar's works tend to amplify fear and rally the politicians rather than accomplish anything productive.

Do games make people killers though?  Absolutely not.

The important thing to remember though is that everything we see and experience becomes part of us and will always affect us in some way.  We have to be very careful about what we allow into our minds.  So if you find yourself screaming and flailing at your little brother more than usual, maybe you should actually stop playing GTA or watching South Park for a while.

I enjoy Resident Evil 4, Serious Sam, and Silent Hill 3 myself, but that's because they use violence as a spice.  It's not the entire dish.  Applied liberally, it can ruin a cuisine.  It's a tool that can be misused like many things in life.

Actually Jack has been very quiet after all this.  No claims of victory, no promises of what's going to happen to Judge Tunis, no insult-spew directed at Dennis or gamers in general...  I guess for once in his career he has nothing left to say.

Jack's silence is music to my ears.

Quiet?

Just yesterday morning, before this became public, he rushed off to file a Federal lawsuit against Judge Tunis, and got into an altercation with the Federal Marshalls at the buildings entrance. It seems they have been warned about him, and consider him dangerous enough that he is not allowed in the building unless escorted by a marshall. They were not very nice to him.

This prompted him to declare that he will also sue the feds for $10 million over his treatment by the Marshalls.

Yesterday he also posted a few ranting leters calling Judge Tunis a maniac of a woman, etc etc, which he sent to the Florida Judicial Qualifications Board.

Jack has been a busy boy.

Solving the problems in Africa isn't going to be done by throwing gobs of money at them.  To really do anything, world governments need to crack down on arms sales flowing in, and drugs and diamonds flowing out.  Then you have to deal with the reamining warlords on-by-one, finally allowing the troubled parts of the continent to heal and progress at their own will. 

Paying for JT's legal fee would be publicly seen as a magnanimous gesture done by us - his 'enemies.'  The flowers for Jack thing worked very well, but it wasn't picked up by anything other that small blogs.  But I can respect the idea that you believe your money is better spent elsewhere.  I also can see from the other (not yours) response to my idea that most gamers are too immature to realize my point.

Maybe after the disbarment goes to finality, we run a t-shirt contest that the proceeds go to helping his family in defraying the costs of his career's implosion.

He'd claim it's harassment. Like I said before, remember Flowers for jack. And in the wise words of Gimli the dwarf: "Let him rot, why should we care". He brought it upon himself. And he never paid a cent for every unconstitutional law he "drafted" and then got struck down. Taxpayers did it. He HAS to pay the fee.

its very clear that the transcribed reports that Dennis posted were actually VERY fair to jack. I was struck by Judge Tunis's report just how much of an utter monster jack Thompson is.

Did anyone read the untouchables bit, were the threatened to put a lawyer in the morgue? Dear God, is the man of his rocker?

A stunning, and DAMNING report into this mans mind. The Judge is completely correct, he has never shown regret, nor does he give ANY sign of changing his behaviour. He is literally, a contemptible, evil little man

Bye Jack!  It's been fun. And I wouldn't worry about him, I'd say he's got a promising future as a bail bondsman in Florida. He needs to channel all that aggression into an occupation that would reward it.

Am I correct in worrying/thinking that the score is now 1 down and 49 to go?  I mean this is just Florida right?  He could still "practice" in California if he got a license here no?  Hate to give the man ideas because if I could keep him on the right side of the continent I would but is there some sort of reciprocal agreement between state bars that would make it tougher for him to practice here with a lifetime disbarment in Florida?

Read the report, my friend.

He not only will never practice law, but I doubt that he will be able to find any job at all. Judge Tunis just put one huge final nail in his coffin. No person would want to have around somebody depicted in this document.

Technically yes he could practice in any of the other 49 states or D.C.  However, to do so he would have to:

1) Pass the bar exam

2) Satisfy the "Character and Fitness" board that he is of the "requisite high moral character and ethical fitness" to be admitted to the bar.

It isn't simply a matter of passing the Bar exam, you have to be admitted to the bar based on that and your character as both a professional and an individual.  Extremely unlikely Jack would satisfy such a board (except maybe in Utah).

I have met lawyers from other countries come here and get jobs after passing a bunch of requirements. Couldn't Mr. Thompson just switch over to Canada, pass their requirements and then carry on with his legal war?

Not even in Utah. That sham of a reward scam was a private organization's idea. BYU in fact. Given his history with utah's legal system, he'd stand a better chance of not being hung in Nevada after shooting one of our fellow gamers there. And there would be heavy backlash, there already has been some.

I just want to thank Dennis for providing the link to the document.  I've been saving all this stuff.  I have to satisfy a writing requirement to graduate from law school.  I'm thinking of writing it on Legal Ethics and well...Jack would have to figure prominently in ANY discussing of legal ethics.

I'm not sure whether Jack got it pulled, or, more likely, Dennis was in two minds about it, I'm inclined to agree with those who think that this isn't the place. Maybe Kotaku or something would be better suited to that sort of thing?

I don't doubt there are a great deal of reasons, that Dennis hasn't disclosed, that Dennis should feel somewhat vindicated by yesterdays' news, I know Thompson well enough to know that we have probably seen about 1/20th of the harassment, inimidation and aggression that Thompson has directed at him, his employers and his family/friends over the years, remember, Thompson doesn't only wan't to win the argument, he want's to leave you unemployed, imprisoned and penniless. It's kind of ironic that in his mad rush to do this to other people, he has damaged himself far more than anyone else.

So yes, it's tempting to point and laugh now that his chickens have come home to roost, but I think Dennis is concerned that gloating too hard would start letting things sink down to Jack's level.

Although Jack can apply for a license to practice law in other states, it's highly unlikely to happen. For a start he would have to pass the exam. Jack is constantly demonstrating the fact he knows absolutely nothing about the law he practices. Secondly, he would have to somehow convince the state bar that being PERMANENTLY disbared from Florida is no reason to refuse him a license elswhere. You'd need one hell of a silver tongue to manage that. In fact I'm fairly sure most states would refuse outright to let him apply.

I assume this disbarment is only for the Florida Bar, correct?  Does that mean Jack can apply to a different Bar and become a lawyer licensed in another state, or would this prevent him from doing so?

Granted, moving from Florida to apply as a lawyer somewhere else would seem to start the entire process over again...but we've seen that Jack is indeed...zealous to put it lightly.

I think you'll also see from the report itself that most bars ask you if you've had disciplinary proceedings with another association before you can apply.

JT did in fact lie about this very thing when applying for his pro hac vice license to work in Alabama.

If you lose (or surrender under such duress) a professional license or bond anywhere in the country, California 1) wants to know about it and 2) probably won't let you become a lawyer because of it.  Unless other states are way out of line with this (ABA-based?) policy, Jack will never practice law again.

Of course, he can always sue pro per.  Anywhere.  So, in that sense, he's like a bad horror movie killer: he will never truly die.

You know, I might actually miss the hijinks of ol' Jack Thompson.

I was reading through the report and came across just the thing to highlight this:

(Page 57) Mr. Thompson wrote to the Judicial Inquiry Commission in Alabama, with copies to Judge Moore, the media and actor Joe Pesci.

What!? I haven't followed the antics of JT too closely... but how does Joe Pesci fit into any of this?
