In Wake of Fallout 3 Ban, Australian Pol Tries to Justify His Position

July 14, 2008 -

Following last week's disturbing news that the highly-anticipated Fallout 3 would be banned in Australia, website Australian Gamer has remarks attributed to the man blamed by many for the ban.

Australian Gamer has posted a scan of what appears to be a letter from Michael Atkinson (left), Attorney General of South Australia, to an unnamed constituent. Atkinson's continued opposition to the introduction of an R18+ rating for the Australian games market has meant that games judged unsuitable for 15-year-olds are routinely refused classification. The country's highest rating is currently MA15+.

From the Atkinson letter:

I am aware that statistics show many game players are adults. Indeed, a whole generation has now grown up with computer games. It is not surprising that those who enjoyed gaming as children... play electronic games with their own children... 62% of Australians in these gaming households say the classification of a game has no influence on their buying decision...

Given this data, I cannot fathom what State-enforced safeguards could exist to prevent R18+ games being bought by households with children and how children can be stopped from using these games, once the games are in the home. If adult gamers are so keen to have R18+ games, I expect children would be just as keen. I have publically argued that because electronic games are interactive, the violence and other adult content in games have a strong impact. I am particularly concerned about the impact these games have on children, who can spend a lot of their unsupervised leisure time gaming.

This man is to put it best... a tool. It's difficult to try to think of another word more fitting. Please take your fanatisicim elsewhere, we're a modern country, your due by date expired 30 years ago.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

What about gamers like myself. 25 years old and NO children maybe id like to play a decent game made for adults? Im sure Michael Atkinson enjoys a cigar and a scoth, but oh no what if children get there hands on that. Better ban them. Ridiculas how about a little common sense. How about a little trust in parents to to control censorship in there homes. Why bother having "classifications" if there not the to educate parents. My understanding of having classifications is so people can be advised of the content so they can make the resposible choice for themselves. All i can say is thankgod for the internet, i guess ill have to do what every other gamer plans on doing and download a pirate version of this game. I wish i could buy the retail copy but hey nie work on bringing piracy down Micheal. Remember every action has a reaction you should think about what you do a little more deeply before imposing you out of date opinions on the public. Gboot asap i say.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

I would like to see this person removed.

Ignorance of this magnitude in his level of of responsibility is just plain dangerous.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

"If adult gamers are so keen to have R18+ games, I expect children would be just as keen."

So what does he base that assertion on?  Any concrete data?

Somehow I doubt it.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

As an Aussie i am getting really sick of this, it is bullshit that we have to get every AG to get on changing this its needs to be able to be done easier and quicker. im sick of atkinsons "protect the children" excuse to force his religious views and morals onto us. it the parents job to "protect the children" not the govt and censors.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

The real reason he's banned it is because he wants to legislate morality in what he views as his lands. The "think of the children" argument is a distraction, and he would not want anyone to be able to play these games. Many politicians think that video games turn you evil, in a few more words.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

I'd just like to know if there's any proof that this guy has ever played any of the games that have been banned. i don't mean play just ten minutes but the whole way through to the end. You guys know that if the game shows gore and death like F.E.A.R. (First Encounter Assualt Recon) it passes no R18+ rating. Over the last few years several games SoF3 (Solider of Fortune) was originally banned until the game devolpers dulled down the gore.

I'd just like to see games get released in this country without the follow words being mentioned "It's banned for the kidies". Since when do kids(you know the ages i mean 5-10) have $80+ to buy these games, i know of no kid that has that much cash or gets the much off their parents. If people want to buy a for themselves that should be the end of it, if they wanna buy them for there kids it should be their decision not the government.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

'prevent R18+ games being bought by households with children' it sounds like he thinks the adults will buy the game for them self and the kids will go behind there back to play it. Thats not what happens if the adults buy it the kids can usely play it too with the adult knowing about it and not stoping them

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

Michael Atkinson = Australias own Jack Thompson... with political power. You Americans think you got it bad with politicians and Jack Thompson etc trying to enforce there conservative rating systems?

We have had this for years, we have had to put up with this crap for years, banning the proper versions of GTAIII, GTAIV, Leisure Suit Larry, Manhunt, BMX XXX and the list goes on and on and on.

Australia is the front lines in this war against these morons.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

"So basically parents are too stupid to decide what there children can or can't handle so the state is going to decide for them."

Yeah, that is pretty much what I said.  Except you worded it in such a way to make this insult to free thinking people on behalf of their government to seem justified.  If a parent thinks their child is capable of handling r18 rated material that is their perogative.  The world needs less Big Brothers and more parents.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

Uh, maybe I'm kneejerking a bit hard here.  But did he pretty much say that adults can't be trusted to make their own decisions and need the government to protect them and do their thinking for them?  Because that is how I interpreted it.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

No it was more that adults can't it becuase the state can't prevent a child from getting it in there own home. So basically parents are too stupid to decide what there children can or can't handle so the state is going to decide for them.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

If adult gamers are so keen to have R18+ games, I expect children would be just as keen. <-- So you 'Expect' Adult gamers have the minset of children? AU classification system = fail

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

Everyone seems to have forgotten that at the last SCAG meeting all of the attorney generals, including Michael Atkinson, agreed to canvas public opinion on whether or not to implement legislation for an R18 classification for games.

This legislation is being conducted by the Victorian attorney general Rob Hulls and, just like Dava Tunis with her report on Jack Thompson's bar trial, Hulls is probably being very careful to dot all the i's, cross the t's so when the results of the survey are tabled and the legislation eventually approved it will result in micheal atkinson's face resembling this smiley.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

Just like I thought he uses fear and the excuse of irresponsible parents who may have different views on what the MA 15+ rating is just to justify his position. I don't normaly get angry because of other people's different opinion, but when a opinion of one person who has religious reasons that affect the entire Australian Audience to chose what they want to play, well it is hard not to be a bit angry about it.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

Ah. I remember the good old days, when I was little girl of six and my father made sure that I only played games and watched movies appropriate for my age group. You know, the days before the dumbass bomb was detonated and all adults- according to the gov't- became gibbering morons who couldn't parent their way out of a paper bag, so the kind and benevolent gov't stepped into the shoes.

Really, Atkinson? There's this thing they usually teach us in school, starting with book reports. It's called reading and research and factual findings. Learn it. Love it. Embrace it.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

Introducing the new Atkinson diet.

Just remove Micheal Atkinson from office or give his opinion a total workout and you'll see results guaranteed.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

A question for all the Aussie readers:

What is keeping the people of Australia, the other Australian AGs and the Government of Austrailia from bypassing this guy's worthless opinion and filibustering and simply taking the R18 rating that everyone else wants?

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

The only person in a position to sack him at the moment is (to the best of my knowlege) is the Governor General who can only do it on behalf of the Queen.

The only way the people can get rid of this guy is to make sure he does not keep his seat in the next election. That would be hard as in the 2006 election he got over 3/4 of the vote in his local seat Croydon.

To get him unseated he needs to be vilified on a state and national level (international level will help). Accusing him of keeping this country in the dark ages etc and maybe the people of Croydon will elect his opposition.

If he feels this issue will be enough to unseat him, he will backflip. He knows full well he doesn't represent the people when he makes these statements. He knows full well the people are against him on this (95% oppose his views).

Until the next South Australian election is called we are basically stuck with him and we are stuck with with a 17th Centuary rating system.

I reckon that same thing is holding us back... fear and laziness.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

Unfortunately, it's written down somewhere (probably in some archaic book) that to get a nation-wide change like this, it requires the support of ALL the Attorney-Generals. Even if one voices disapproval, that's the end of the line for that suggested law change.

I do believe there have been movements to circumvent this guy's stupidly staunch disapproval of the change, but anything which does do so would read as the Australian government ignoring the highest echelon of law, so I can understand why they are hesitating.

It does seem that the only way we'll get some movement on this change is if Mr Atkinson resigns, is thrown out or disappears somehow.

Yeah really

Why aren't they layin' the political smackdown on this old Turkey-faced asshole? One old bitch against an army of millions should be more than enough.

A sure sign of someone completely out of touch; refering to video games as "computer games" and "electronic games." Who uses those terms in 2008?

This guy wants Austrailia to be a nanny state. What ever happened to parenting?

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

Ok, I just looked it up and here is a strange fact.  Bioshock was done by 2K's Australian division!  Amazing!

Let's face it, this guy doesn't even know his own country.  There is a growing game development industry in Australia and they aren't making "Happy Kitten Visits Rainbowland".  What they ARE doing is strengthening the economy and providing jobs, and THAT is what voters really care about.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

Wait a minute...

Isn't this the same game that gamers have been crying against because it is considered a "disgrace to the Fallout franchise"?

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

How to keep the R18+ games from kids, hmm, you could ask for ID!!!!!! and have the parents be parents.

I think I'll make a little list!!

If you don't wantcha kids playin' these games, you could always:

-Simply say no and then kindly explain why they are concerned

-not give them 60 friggin' dollars for the game (or however much it costs over there)

-put the TV and the game console in the living room

-use the parental controls and laugh as they try to play their games

There are dozens of other options available. There is no excuse for laziness.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

His reasoning is flawed.  Because some percentage of people don't care about ratings when all games are rated 15+ or below does not mean that people won't care about a rating of 18+.

If all games in Canada (where I live) were rated T or below, I wouldn't care if my child played them either.  If the child had resources enough to get a game behind my back, I would trust that he'd be able to handle T for Teen content.

And on top of it all...

Well put. Can't believe I didn't notice that flaw earlier. On top of it all though, it doesn't matter what bullshit arguement he comes up with, the people want an 18+ rating. Period. If they want it, he HAS to deliver. If he doesn't then there's no need to keep him around. Also, one old woman cannot stand against a legion of pissed off Australians. He will be out-voted.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

Given this data, I cannot fathom what State-enforced safeguards could exist

Atkinson implies, "if safeguards aren't State-enforced, they aren't worth a crap to me". I wonder if anyone else got that from reading this part. I see that most politicians that favor preventive measures much more than experimentation don't like to "live in the moment" and don't like to let things work themselves out. They are not very trusting of the people they rule. You can continue to live in fear of what may happen, and later regret the things you didn't do, or try anything on a whim without letting fear pin you down.

If enough citizens are against his argument, isn't that enough for Atkinson to follow the will of the citizens? This is how it's supposed to work. Democracy, etc. People are used to the fact that we are the puppets of everyone holding a position in government. When in fact, if we elect them, they should become the puppets of the voting citizens.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

"If enough citizens are against his argument, isn't that enough for Atkinson to follow the will of the citizens?"

Honestly I think part of the problem is he doesn't care what the citizens want. At least from this it seems like he feels he knows what is best and to hell with what people want. Democracy has problems when the people in charge decide that their views and decisions supercede the people they are supposed to be representing. It doesn't seem to matter to him what other people think, he knows what's right and to hell with everyone else. Jack would love this guy.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

This guy does NOT represent the Australian people when he says this. Last poll taken shows 5% of the public opposes the introduciton of an R18+ rating. Most likley idiots that buy into the Jack Thompson's of the world just like he does.

This guy is not qualified to make judgment calls on this and he has really got to wake up to himself if he thinks the majority agree with him.

Personally I would like to see him kicked out. He has a lot of heat on him at the moment with the recent Fallout 3 ban. He is hated.

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

Atkinson hasn't given reason why we shouldn't have R18+ games in Australia. Rather, he has stated that we don't have a regulation to distribute them. If the intent was to keep it out of the hands of underage players, why not have carding for game purchases in stores? Just as one would with other R18+ rated material in the country?

I wrote to my MP a while ago about this rating issue. I received a standard letter stating my concern has been noted, and they'd like me to participate in a survey regarding the matter. My comment/demand was not enough? :/

Re: In Wake of Fallout 3 Ban, Australian Pol Tries to Justify

Wow... are we in the dark ages?

"Given this data, I cannot fathom what State-enforced safeguards could exist to prevent R18+ games being bought by households with children and how children can be stopped from using these games, once the games are in the home."

right... so ban EVERYTHING that a kid an ever possibly have a chance of using because parental intervention means nothing?

Wow .. that means that they need to ban cars. I mean.. kids can TECHNICALLY use those once they are parked outside the family home. ban cars! back to walking everywhere i guess. I mean if a kid gets in one of those babies, think of the damage little timmy can do!

Oh and cutlery. Ban that too. back to eating with our hands i guess, i mean , we cant possibly allow children the chance to access cutlery like a dangerous cheese knife, or large spoon.

Oh and wrap everything in the house that has corners with cotton wool. i mean EVERYTHING. doors. cupboards, stairs need to be rounded at the edges. I mean any kid could use that sharp nasty corner as a weapon. Bubble wrap it up good.

Cookers, microwaves, ovens, sorry.. gotta ban those too. Gas appliances can be highly dangerous for little timmy. He could use them to harm others VERY easily.

hmm.. electricity? noo noo sorry. gotta ban electricity too. electricity kills dontcha know. Along with all the appliances that use electricity.

In fact i think we should live in caves with no objects or possessions, and live in giant bubble wrap suits. In fact.. wait.. no caves arent exactly safe are they...

RIGHT ive got it. We need to KILL TIMMY. its the ONLY WAY to prevent something bad happening to him, or to prevent him doing something bad to others. sorry timy, we need to kill you .....to....... stop you .......killing someone.... wait.. this logic has utterly confused me...

AGGH BAN Michael Atkinson .. he mahkes.... heeead... hurrrt... aaggh.. brains... on floor.... agghh
