Live Blog: Jack Thompson Tells Utah Conservative Group of Plans to Legislate Games

A live blog of Jack Thompson's Saturday morning keynote address to the ultra-conservative Utah Eagle Forum has been published at Mormon Bloggers.

Judging by the post, Thompson delivered his standard anti-video game rap. The disbarred attorney apparently also laid out his latest strategy to legislate games:

The impact of aggressive, violent, and pornographic videos simply can’t be denied. Jack cited case after case in which people like a young Devin, immersed in things like Theft in the City, went home and shot his parents, saying to the police,  something to this effect: “Everybody has to die, just like in video games.”

 

The man who killed on Trolley Square, said Jack Thompson, was apparently training on Theft in the City or something similar.  One part of that violent video illustrates an individual going to a high point in a mall and shooting in random people he doesn’t know.  This training ground has made victims in Columbine, in Miami, in  Paduka [sic], and needs to stop here.

 

Jack Thompson– attorney, crusader in fighting the entertainment media’s marketing of violent materials to minors, and  author of Out of Harm’s Way–is supportive of an upcoming a bill, which if drafted properly and put in the hopper here in Utah will stop the sale of these games to minors.

 

Currently, the Fraud and Deceptive Trade Pact Act says that if you sell a product and misrepresent what it does or is, it is simply fraudulent.  Walmart, Target, Best Buy assert in corporate sites, statements, and press releases that they will not sell a mature-rated violent to a minor.  Age verification software, though available through Ideology and other programs, are dismissed by these companies.  This is something we can enforce.

 

If you’d like to know more, check with Eagle Forum.  If you are informed and are willing to make a call, please let your legislators know that this bill should be passed.

GP: Couple of points here... The blogger characterizes Thompson as an attorney, but as GamePolitics readers know, he was disbarred for life by the Florida Supreme Court in October. As we pointed out last week, the agenda for the Utah Eagle Forum event also lists him as an attorney. At this time it is unknown whether the audience for Thompson's keynote address was told of his permanently disbarred status. If so, the blogger makes no reference to it.

Clearly unfamiliar with video game issues, the live blogger also gets a few of the details wrong. But that's not unexpected as Thompson was apparently going on about several cases in which he blames video games for violent crimes. The "Devin" mentioned by the blogger, for example, would be Devin Moore, who killed two police officers and a dispatcher in Alabama, not his parents.

Most amusingly, "Theft in the City" would be Grand Theft Auto, of course.

UPDATE: In relation to Thompson's scheme to legislate games in Utah, the question now becomes whether the disbarred attorney has any state legislators on board. We would suspect that Gayle Ruzicka, the politically influential president of the Utah Eagle Forum and an ally of Thompson's, will be able to persuade someone in the legislature to introduce Thompson's bill.

Could the sponsor end up being one of three Utah legislators who also spoke at the UEF convention? Those would be the controversial Sen. Chris Buttars (R) as well as Reps. Carl Wimmer (R) and Christopher Herrod (R).

UPDATE 2: In its coverage of the UEF convention, the Deseret News makes no mention of the proposed video game legislation, but quotes Thompson's verbal shot at President-elect Barack Obama:

"On Jan. 20 we are entering what I believe will be a time of peril for this country," said speaker Jack Thompson. "And that is Barack Obama."

UPDATE 3: Thompson e-mailed GP to assert that he made his disbarment known to the UEF convention audience:

I told everyone there I was disbarred, and said in my first speech that I was a 'recovering attorney.'

Thing is, it's not like Grand Theft Auto is a hard name to remember, it's like saying that rather than 'Murder', someone commited 'Stabbity Shoot Boom'

It's just like Thompson though, when you think about it, he managed to annoy the Utah AG, then accuse him of phoning him whilst drunk and basically alienate himself from the entire proceedings, so, as usual, Thompson tries to fool another, more gullible bunch of people into doing his dirty work for him instead.

I still think something should be done about that whole 'Attorney' thing though, I'm sure he'd be quick enough off the mark to point fingers if the situation was reversed, in fact, he'd be writing to all and sundry, reporting it to the FBI and probably dropping a letter off at the Whitehouse for good measure.

That bill is not going to pass after JT annoyed Mark Shertleff(even though he dosen't have power to stop the bill, because the Video game bill will fade away, and no loger be a threat)

Besides that, the FTC already said via a 2007 report to Congress on the Children's Online Privacy Protection Act(COPPA) that a credit card is a valid age verification method, as a minor's credit card must be attached to the parent's account. Plus, Thompson tries to claim that a bank card can't be used yet a bank card can be used as both a credit card and a debit card.

Thompson, of course, doesn't have the testicular fortitude to post his supposedly "constitutionally bullet-proof" bill because even he knows that it isn't.

They probably determined he was an attorney from his Wikipedia page which the beauracrats over there are refusing to change. Perhaps if they'd come to an agreement for once than trying to enforce ambiguous rules which they all make their own interpretations of (wow, that reminds me of Congress)... but this is not the forum for that...

Quite true, but also at issue are stores that don't ask any questions to those whom they sell guns to. A CBC investigation (Canadian news looking into the death of a boy at the hands of a US gun) tracked the same pistol through two or three other violent incidents, including at least one death, before tracking the gun back to the store that sold it. And some more digging revealed that the FBI had ID'd the store as having sold something like 2% or so of all firearms used in crimes in the united states.

Yeah. One store, 2% of guns used at violent crimes throughout the US came from this one store. Want to bet they got shut down? Smart. When the FBI agents requested to shut the store down due to gross violations, they got their program shut down, and the FBI agents were reassigned and eventualyl dismissed.... I'll have to dig up the link to the online edition of the show... is on the www.CBC.ca website somewhere in the 5th estate section...

Well, guns and weapons don't really help. I understand that if we intoduce gun control in American, it won't help, and would make things worse before it gets better, but people having weapons that can clear a mall of people in a matter of seconds don't really help either.

You don't need anything more powerful then a hand gun. If you against more then one person, or people with more powerful guns, you will lose anyway.

Your ignorance about 'gun control' astounds me.  Number 1, most crimes are committed with a 'handgun', one of the reasons why so many cities began legislation with them.  

Number 2, we have gun control in America.  Before you can buy a firearm, you have to fill out paper work, be checked out by the FBI's NICS, and be cleared.  Long barreled rifles and shotguns have no waiting period, but pistols often have a wait between purchase and actual ownership of the firearm.  Just because we don't demand that our citizens who want to exercise their 2nd amendment rights pay 2000 dollars to join a gun club or be forced to buy an equally expensive safe doesn't mean we don't have 'gun control'.

Today, gun control means something entirely different.  It means banning guns that politicians and simpletons are afraid of.  Any bolt-action rifle is basically a sniper rifle, so we can't have any of those.  And semi-automatic, magazine-fed rifles, ooh, those are very dangerous too, so no one can own those (except the government, of course).  And since shotguns are so powerful, no one gets to have those.  Oh, while we're at it, no one can have a pistol because they're so easily concealed.  And now, you can't own firearms in America.

Just because you don't need anything more powerful than a handgun doesn't mean the rest of us don't have a need (or want) for something more powerful.  Go sit in the corner.

how do you justify owning a semi/full auto magazine fed rifle? The kind seen and used by most of the worlds military units? What the hell do you hunt with a weapon which fires rounds designed to maim humans? just in case the british invade again?

I understand using bolt action rifles for hunting. I also understand it is sensible to do background checks and the delay between purchase and collection. But the whole secure storage thing confuses me, if dear little Bobby finds daddys gun in a drawer and it looks like his toy gun only better and takes it out to play, who gets it in the neck when poor Bobby empties his friends skull on the pavement while shouting "bang"? surely not the kid as in this case he wasn't intending on killing anyone he was just playing. The father? well there appears to be no legal requirement for secure storage so he gets off the hook. how does this console the loved ones of whoever took that accidental round?

I know this is a purely hypothetical situation but it isn't that hard to imagine happening. When I grew up I knew where my dad kept his guns (pistols, rifles, shotguns) but something that stopped me from playing with them wasn't stern words or a chance of a thrashing, no, it was a steel walled cupboard. There are differences between gun safes and gun cupboards, you don't want to pay $2k for a safe, get a cupboard, sure it won't stop a determined theif with a grinder, what it will do is make it harder for your family (who btw haven't undergone the checks that you did to aquire the weapon) to have access these weapons without your knowledge.

For those cocks who decide to say "but a knife/hammer/axe can be used as a weapon" yes I know but these were not principally designed to be used for the task of dealing death. Also I understand that you give a nut job something that can be used as a weapon, he will find a way of killing/injuring himself and others, there are always accidents, but that doesn't mean we have to be stupid not to try and limit them happening (not running with scissors, pointing a gun at another person unless you are actually going to intentionally shoot them etc)

I know most crimes are done with hand guns, but we don't need assault weapons available kind of like what we saw at VT. Personally, I don't want any civilian having no guns at all, but we aren't going to see that in a million years, and we all know the criminals are still going to get it no matter what, making things worse, making people need a handgun.

Why do you need something more powerful? Can you name a situation that a non-military or law enforce could need a more powerful gun without more people going to die. Their aren't going to be less deaths with more powerful guns at the scene.

When I say gun control, I mean not allow having a certain gun. I guess I used the wrong words. Yes, every gun is dangerous, but if you have a more powerful gun, it's means you could kill more people at a time. Really,  what use is a more powerful gun? It doesn't help the good people, but it does help the criminals.

How does VT play into this at all?  You're just using that as an idiotic buzzword, which is kind of sick.  Ooh, VT, 9/11, Columbine, Paduca.  VT was the fault of a judge and a psychologist who decided that putting into Cho Seung Hui's profile that he had been institutionalized wouldn't be 'respecting his privacy' and would hinder him getting into college (you know, that place where he shot people for no good reason), which means NICS was unaware that he shouldn't own a firearm.  He didn't use an assault rifle; he used a Glock 17 (pistol) and a Walther P22 (very, very small pistol, firing the weakest round known to man).  He didn't own an 'assault weapon'.  Chances are very good he didn't have the money for one; cheap assault weapons are more expensive than both of his pistols combined.

Of course, assault weapon is one of those words used by the media to incite a feeling in the people who watch.  It seems a lot scarier than saying semi-automatic gas(or piston) operated box magazine fed rifle.  'Assault weapons' are chambered in rounds like the 5.56, 7.62, 6.8, and occasionally in other rounds (but very rarely).  All of these rounds are smaller and less lethal than rifle rounds like the venerable 30.06, the 338 Lapua, and pretty much any other real rifle round you can think of.

So what does anyone need a firearm for?  How about hunting?  I've hunted bear, all manner of deer and elk, and rabbit, among many other animals.  Most of the time I hunt with a rifle chambered in .308 or 30-06, the 2nd being easily more powerful than those scary 'assault weapons'.  I also varmint hunt on a friends farm to keep his animals safe from coyote and from gopher holes, and for that I use an AR-15. What about competition?  I love three-gun competition, for which you need a semi automatic rifle with a box-magazine with 20 or more rounds in it, a pistol (I use a  Colt 1911 that would put Big Boss's to shame) and a shotgun.  What do I do at these competitions?  Shoot paper and metal targets.  What if someone breaks into my house in the night?  I have an MP5, an M14, and two pistols, as well as a mossberg shotgun in my bedroom.  I guarantee that my more powerful guns that you don't like will be a lot quicker in killing an intruder than the police, who, by the way, don't even HAVE to assist me. 

I know what you mean by gun control, that's why I believe you're ignorant.  Use the right word; you want to ban much of my right to own a firearm (actually, you want to ban it all).  This 'more powerful gun' crap is ignorant as well; many people who dislike firearms don't know what is more or less powerful.  That semi automatic rifle you hate so much is less powerful than my old Lee-Enfield, which is less powerful than my custom rifles.  The pistol is on the low end of the power and accuracy spectrum.  Of course, I have a sports car, so I shouldn't have that right?  Because that can get up to 120 with ease, I could kill more people with it I suppose. 

What use is a more powerful gun?  I don't know, maybe the fact that I can kill the criminal quickly and go back to sleep while I wait for the cops to take their sweet time?  Once again, just because you can't conceive of why we should have these weapons, doesn't mean we shouldn't.  It just shows your myopic view and lack of life experience.  But I'm sure once someone mugs you, you'll change your tune.

The misinformaton grows larger the closer you look. There is no legislation called "the Fraud and Deceptive Trade Pact Act." An Act so called simply does not exist.

And if the idiot's talking about federal consumer fraud and deceptive trade practices statutes as regulated by the Federal Trade Commission, then he's leaving out the "been there, tried that" part of his story. He's formally complained to the FTC before and repeatedly about T2's marketing practices, including the use of credit card information as age verification for on-line purchases. I assume the FTC politely told him to go pound sand.
