BREAKING: Utah Governor Vetoes Video Game/Movie Bill

March 25, 2009 -

Jack Thompson e-mailed GamePolitics a few minutes ago to say that Utah Gov. Jon Huntsman (R) has vetoed HB 353, the video game/movie bill passed overwhelmingly by the Utah House and Senate.

We've also confirmed this with another source in Utah.

According to Thompson, backers of the bill plan to seek an override of the Guv's veto.

We're hearing (not from Thompson) that the word on the street is that retailers lobbied the Guv energetically.

GP: Color me surprised. I did not think that Huntsman would buck the legislature on this one.

After careful consideration and study, I have decided to veto HB 353...

While protecting children from inappropriate materials is a laudable goal, the language of this bill is so broad that it likely will be struck down by the courts as an unconstitutional violation of the Dormant Commerce Clause and/or the First Amendment.

The industries most affected by this new requirement indicated that rather than risk being held liable under this bill, they would likely choose to no longer issue age appropriate labels on goods and services.

 

Therefore, the unintended consequence of the bill would be that parents and children would have no labels to guide them in determining the age appropriateness of the goods or service, thereby increasing children’s potential exposure to something they or their parents would have otherwise determined was inappropriate under the voluntary labeling system now being recognized and embraced by a significant majority of vendors.

I am surprised.  I was expecting the next round would be a court battle.

Which we may still get.  Goverment 101: Vetoed bills go back to the Legislator to be voted upon again, and if they can muster a 2/3rds majority, it passes without the Governor's signature.

Considering the lovely people back at the Senate and House passed this piece of trash overwhelmingly in the first place, there's a good chance they'll go ahead and vote it into law.  So, just a minor detour before we get to the court battles.

Maybe any gamers in Utah should thank the governer in a fax or e-mail? I'm thinking that after the people from the Eagle Forum are done clogging up the governer's fax and e-mail, a few "thank you"'s would be nice.

Like I said, I thought it was just as likely that Huntsman would veto it, because of his potential Presidential bid. He wants to be seen as a maverick like John McCain was, and vetoing this bill was a maverick move.

To the best of my knowledge, Huntsman becomes the first governor to veto video game legislation of any kind.

Looks doubtful that the Legislature would reconvene for an override session. So for this year, the veto will probably stand.

While I think it's a good thing the governor was thinking of the people of Utah and the potential costs they would incure, I happen to disagree with a statement he made:

The argument fails in the sense that the ratings themselves wouldn't be removed from the products.  The result would be that retailers would stop using the ratings in policies.  I very seriously doubt that the ESRB and MPAA would stop rating products because of this bill.

Parents, therefore, wouldn't be without the informational resource.  They would merely not have the voluntary support of retailers.  Not exactly a disaster considering that the policies are easily gotten around anyway.  But it's nice to know they voluntarily chose to set such policies.

Is the showing of a rating the equivalent of claiming you'll enforce it? Jack said it was, remember? The Senate did NOT include the suggested amendment that said it was not an advertizement making that claim. As such, it can easily be claimed the politicians would go after these depicted ratigns, meaning you might have to remove them.

In other words, it's the refusal of the Senate to include that amendment that opens up this way of reasoning.

Any display can probably be defined as "advertisment".  A review, customer or professional, could be defined as "advertisment" using the same argument.  One could, if one desired, claim that making false public statments would also constitute "false advertising" under the same argument.  It's not that far of a stretch.

But, the FACTS, and as we know the Traitor John Bruce is not know for FACTS, let alone Truth, honor, ethics, or morality, say that the rating system, ANY rating system, isn't an advertisment in favor or even against ANY product.  They are a summary of content to be used as information for individuals and Parents alike to make informed, intelligent, decisions as to what is or is not appropriate for them or their children.  One MIGHT argue that this is a selling point, positive or negative, and therefore is "advertisment".  But see the references to professional and even customer reviews above.

The accuracy of the Traitor John Bruce?  He thinks two male characters kissing in a game is "gay sex", but doesn't call a male and female kissing in a game "straight sex".  You want better accuracy than the Traitor John Bruce?  Find something broken that mechanically gives you incorrect information.  That's more accurate than the Traitor John Bruce.  At least the broken mechanical device has a genuine excuse.  The Traitor John Bruce's failure is intentional.

From what the guv said, it sounds like the industry reps were pretty serious about their threat to take off the ratings. It's basically blackmail ... but that's such a strong word. It was pretty damn smooth though.

Well not really, the Guv is exaggerating what was said by industry reps. From what we've heard of them saying, people like Vance said their was a possibility that they might choose not to enforce the ratings, if they can be held liable. There wasn't much certainty, just the talk of the possibility... Furtharmore, their was no mention of dropping the ratings as a whole; the game industry would still make use of the rating system, it's just that the voluntary enforcement that retailers give it might disappear.

It's not blackmail, it's just a business practice... sometimes a business might be willing to take some bad PR if it means they can avoid being sued... There wasn't a mass of retailers saying that was exactly what they would do, just random people trying to predict what managers MIGHT do in such a situation.

I'd like to think he misunderstood.

I'd had to think that the industries would vacate the rating systems themselves.

I'd also hate to think the governor lied about the industry threatening to vacate the rating systems to drum up misinformed support for the bill. 

So I'll go on the assumption, for now, that he just misunderstood.  Maybe he thinks the ratings and the policies are tied together, which they aren't.

Let's not forget that Huntsman is a politician and what a politician says usually has much spin. Who knows what really went into his decision to veto? But whatever it was, you can bet that he'll come up with something to say that shines a most favorable light on himself.
