Jack Thompson e-mailed GamePolitics a few minutes ago to say that Utah Gov. Jon Huntsman (R) has vetoed HB 353, the video game/movie bill passed overwhelmingly by the Utah House and Senate.
We've also confirmed this with another source in Utah.
According to Thompson, backers of the bill plan to seek an override of the Guv's veto.
We're hearing (not from Thompson) that the word on the street is that retailers lobbied the Guv energetically.
GP: Color me surprised. I did not think that Huntsman would buck the legislature on this one.

After careful consideration and study, I have decided to veto HB 353...
While protecting children from inappropriate materials is a laudable goal, the language of this bill is so broad that it likely will be struck down by the courts as an unconstitutional violation of the Dormant Commerce Clause and/or the First Amendment.
The industries most affected by this new requirement indicated that rather than risk being held liable under this bill, they would likely choose to no longer issue age appropriate labels on goods and services.
Therefore, the unintended consequence of the bill would be that parents and children would have no labels to guide them in determining the age appropriateness of the goods or service, thereby increasing children’s potential exposure to something they or their parents would have otherwise determined was inappropriate under the voluntary labeling system now being recognized and embraced by a significant majority of vendors.

To be honest, this was not what I antcipated. I thought it would pass, go to court, die. But the smart gov said "screw that" and killed the bill before it ever wasted taxpayer dollars in legal fees. So, the good news, bill dead. Bad news, Gov Huntsman will now have to put up with JT endlessly calling "Conspiracy" on him.

Instead of the wrath of JT and the Eagle Forum, I think the Govenor is better off because he has just won the fans of many Videogamers and people within the Industry in Utah.
Also with many parents who are thankful for the ESRB ratings and also the Movie goers who love R rated movies it is a big thing for them.
As a politician, you keep your friends close, and your enamies closer so you can always remind them that if they make such a silly attempt at a half assed legislation, the govenor will just veto it anyway.

I am willing to admit as a gamer that if the Movie Industry was not also targeted, then this bill would have been passed by the Governor.
Thank god we have allot of friends in the Movie Industry, at least they also understand how it is like to be targeted by religious political coservatives.

Tis truly a rare breed of politician...
One who listens to advice, weighs a situation to see whether or not the end justifies the means (and whether than end can even be achieved), considers other factors (such as almost certain overturns from the judicial system) and makes the correct choice based on evidence rather than personal feelings.
We in Australia would like to borrow Gov. Huntsman for a bit, possibly to fill the role of the Attorney General of South Australia (R18+ game ratings) or Communications Minister (ISP mandatory censorship). A bit of evidenced based decision making from politicians rather than emotive clap trap is desparately needed.

Excellent news :) Why can't Thompson and his cronies in the Eagle forum see that this botched attempt at legislation would have the opposite effect to that which they desire. The Governor rightly saw that it would be unconstitutional, and as we have been saying again, and again, and again, would lead to retailers abandoning any attempts to enforce ESRB ratings as store policy.
You know that a law is stupid when it punishes those who try, and ignores those who don't bother.

But then again, it makes a point: ALL of these laws are based around the ESRB rating system. You kill that system, the bill is rendered moot.

It wasn't just the ESRB, it was also the MPAA. Their ratings are also voluntary, and would of fallen under this 'law' as well.

Yes it is very nice to see some common sense among our political leaders. No, it's not the end of the story on this bill, but perhaps the governor's words would help others to see reason. This was a dumb bill from any perspective...even if one believes that violent media is harmful, a bill that would lead to LESS use of voluntary labels makes little sense (I suspect it was a backhanded way to try to force mandated, state-controlled labels).
Perhaps continued advocacy and getting the word about the "real state" of the scientific evidence rather than the advocacy nonsense has been effective.

Thing is, the Gov. was in a difficult position, no matter what he chose to do with this Bill, he would have been accused of being influenced by one side or the other, he's either under the thumb of the Video Game industry, or under the thumb of the Eagle Forum.
The thing is though, the gaming Industry didn't force his hand, it was pressure from the Eagle Forum et al that led to the creation of this law, and the retailers responded to that attack, so this looks more to me of a case of refusing to buckle to the Eagle Forums' demand than buckling to the Retailers' defence of it.
My congrats to the Gov. for looking at the law from a point of view outside the Thompson-generated rumour-mill.

I disagree. I think it would be wrong of us NOT to praise him because he is Republican rather than it being in any way construde as a U-turn. We are on opposing sides of a political divide, united with our love of gaming. There are going to be many disagreements and frankly I don't see gaming as a big issue when ti comes to voting, no matter which side of the Atlantic we are on. However one thing remains true; when people do something, however unexpected, that is common sense and well thought out, they deserve praise.

Seems to be he also saw the part that the one who drafted this bill was hoping to exploit.
Thompson just reminds me of an 80s movie villain. Trying hard as hell to outlaw something the younger generation finds fun, and failing time and time again.

though grant it, he does get things slightly wrong... pople within the industry said that retailers might choose not to enforce the ratings. Not that they would likely do it, and that they would get rid of the ratings completly... he's still correct, but it's a bit of an exaggeration of what would happen. It is afeterall true that a number of retailers would rather risk some bad PR than to actually become liable for what they do not have absolute control over; retailers don't have ability to micro manage and watch everything their employees do

Anyways, I think his decission is very well justified. That bill just has too many holes to be functional. I´m glad that Utah´s guv was strong enough to see it and for not let him to be dragged by uninformed persons as Utah Senate members.
