Jack Thompson Lashes Out at Utah Guv Following Game Bill Veto

March 26, 2009 -

Following abortive attempts to bring video game legislation to Utah in 2006 and 2007, Jack Thompson's fortunes in the conservative Western state seemed to be improving this time around.

Despite early confusion as to whether Thompson or bill sponsor Rep. Mike Morley deserved credit for dreaming up HB 353, the bill quickly gathered momentum. The Utah House and Senate passed the measure overwhelmingly and it was known to enjoy the support of Utah power broker - and Thompson ally - Gayle Ruzicka, head of the ultra-conservative Utah Eagle Forum.

Republican Gov. Jon Huntsman pulled the rug out yesterday, however. Huntsman vetoed the bill, citing constitutional concerns and the potential for "unintended consequences."

For his part, Thompson went on the offensive. A letter from the disbarred attorney to the Governor took a harsh tone and threatened even more restrictive legislative action in the future:

You got suckered [by the video game industry]. Further, there is no constitutional, First Amendment problem... 

If your veto is not overridden, then we will be back with a bill to ban the sale of these products altogether, in light of the recent massacres in Germany and in this country directly caused by these murder simulation products that are being copycatted by teens who are being fraudulently sold them.

GP: The threat to ban violent games for players of all ages - including adults - would appear to be highly suspect, in light of the First Amendment. We asked Thompson about that, but he did not respond.

Thompson also circulated public records showing a May, 2006 campaign contribution of $500 from video game publishers' lobbying group the ESA to Huntsman. In an e-mail, Thompson accused the industry of buying Huntsman's veto.

We have verified that the $500 contribution from the ESA was received on behalf of Huntsman's 2004 campaign fund. But for Thompson's assertion to be correct, the ESA would have been prescient, indeed, to forsee - and pay for - a gubernatorial veto three years in advance. One would also have to accept the premise that the Guv could be bought. We asked Thompson about this, but again did not receive a response.

Dear Governor Huntsman:

Those of us who labored long and hard to assure the rightness and constitutionality of the above bill are shocked not just by your veto of it but even more so by your utter failure to extend to Rep. Mike Morley the courtesy of  allowing him to address your concerns before you wielded your veto pen.

This failure of normal courtesy tells me that you did not want to be confused by the facts.  The facts are that neither the movie nor the video game industries, and their retail networks, can possibly opt out of the age-rating system, yet you have bought their red herring statement that they would.  To do so, after ironclad promises to President Clinton and Congress that they would never do so, would bring federal content regulation of their products.  This is something they want to avoid at all costs.  You got suckered.

Further, there is no constitutional, First Amendment problem, because there is no attempt in the bill to  regulate content or punish action based on content.  This is a fraud statute which simply says:  If you tell the public you do something, then you must do it.  Adam Smith, the author of the Wealth of Nations in 1776, and arguably the father of capitalism, noted that a marketplace based upon fraud is not free.

If your veto is not overridden, then we will be back with a bill to ban the sale of these products altogether, in light of the recent massacres in Germany and in this country directly caused by these murder simulation products that are being copycatted by teens who are being fraudulently sold them.

So..hold on...

The ESA makes a minor (you could even say paltry - if $500 is all it takes to buy off a governor then I'm amazed more people don't do it) donation to a candidate so that if he wins, three years later he can veto a bill written up by Jackie, which the ESA had no prior knowledge of?

Well, $500 is such an absurdly low amount (as far as campaign contributions go) that the ESA could probably easily donate that much to a governer campaign in every single state as a preemptive measure.

Of course, since $500 is so tiny, even a cynical man like me has a hard time believing it could buy you anything.

The likely irony in the whole "bribery" story is that I would bet the governor got far more money from republicans and conservatives who supported the bill then from those who opposed it.  Could we say all his other contributions are bribery as well?

The game industry does have time travel.  I mean, they must have, because they sent copies of Call of Duty back in time in order to start all those wars.  Only way such violence could exist before video games were invented.  I wonder what game they used to start the crusades.  Who knows... maybe it hasn't been made yet!

If $500 is considered enough to equal "protection money", then what does $10,000 or heck $25,000 buy you(which if you look on governor's contributions lists, there are alot more donations over $500)? Able to sleep in the governors house?  How about $200,000?  Maybe that has the governor providing "special, wink, wink" services for the donor?  I do find it interesting that the article doesn't mention how much was donated to the governor, letting readers think its some huge amount!

The confusion stems from the fact that you mentioned GP running a story, which sounds to me like Dennis running an official story here, when in fact he has not run any story on the comments in the Desert News. GP readers found those comments and mentioned them here, but that's a totally different thing. Maybe that's what you meant when you said that, but unfortunately it didn't sound that way to me.

I believe someone stated that Dennis doesn't think those comments are actually Thompson, though perhaps I am mistaken. Regardless, I'm sure Dennis will verify whether those comments on the Desert News are real before he runs a story about them.

Are we sure this is Jack Thompson? Yes, it sounds like him but the style in which he types is inconsistent. In one paragraph he uppercases all the proper nouns like America and Dennis, but in another comment he doesn’t. Even when you are angry you are most likely to type in the same way. I could just as easy type my name as Jack Thompson in the comment box, and write a comment. BAM I’ve now become Jack Thompson or at least I temporarily have his name as my username. There is no registration on this site so how can we be sure? Can we get verification from Mr. Thompson himself?

The story on GP is in regards to an email Dennis received.  Dennis would have direct verification.

As to the comments section on Desert News, yes, compare IP addresses if possible to prior email IP data (which there is no doubt they've received emails by him before).

I wouldn't trust verification from him any more than I would trust him... period.
