Jack Thompson Lashes Out at Utah Guv Following Game Bill Veto

March 26, 2009 -

Following abortive attempts to bring video game legislation to Utah in 2006 and 2007, Jack Thompson's fortunes in the conservative Western state seemed to be improving this time around.

Despite early confusion as to whether Thompson or bill sponsor Rep. Mike Morley deserved credit for dreaming up HB 353, the bill quickly gathered momentum. The Utah House and Senate passed the measure overwhelmingly and it was known to enjoy the support of Utah power broker - and Thompson ally - Gayle Ruzicka, head of the ultra-conservative Utah Eagle Forum.

Republican Gov. Jon Huntsman pulled the rug out yesterday, however. Huntsman vetoed the bill, citing constitutional concerns and the potential for "unintended consequences."

For his part, Thompson went on the offensive. A letter from the disbarred attorney to the Governor took a harsh tone and threatened even more restrictive legislative action in the future:

You got suckered [by the video game industry]. Further, there is no constitutional, First Amendment problem... 

If your veto is not overridden, then we will be back with a bill to ban the sale of these products altogether, in light of the recent massacres in Germany and in this country directly caused by these murder simulation products that are being copycatted by teens who are being fraudulently sold them.

GP: The threat to ban violent games for players of all ages - including adults - would appear to be highly suspect, in light of the First Amendment. We asked Thompson about that, but he did not respond.

Thompson also circulated public records showing a May, 2006 campaign contribution of $500 from video game publishers' lobbying group the ESA to Huntsman. In an e-mail, Thompson accused the industry of buying Huntsman's veto.

We have verified that the $500 contribution from the ESA was received on behalf of Huntsman's 2004 campaign fund. But for Thompson's assertion to be correct, the ESA would have been prescient, indeed, to forsee - and pay for - a gubernatorial veto three years in advance. One would also have to accept the premise that the Guv could be bought. We asked Thompson about this, but again did not receive a response.

Dear Governor Huntsman:

Those of us who labored long and hard to assure the rightness and constitutionality of the above bill are shocked not just by your veto of it but even more so by your utter failure to extend to Rep. Mike Morley the courtesy of  allowing him to address your concerns before you wielded your veto pen.

This failure of normal courtesy tells me that you did not want to be confused by the facts.  The facts are that neither the movie nor the video game industries, and their retail networks, can possibly opt out of the age-rating system, yet you have bought their red herring statement that they would.  To do so, after ironclad promises to President Clinton and Congress that they would never do so, would bring federal content regulation of their products.  This is something they want to avoid at all costs.  You got suckered.

Further, there is no constitutional, First Amendment problem, because there is no attempt in the bill to  regulate content or punish action based on content.  This is a fraud statute which simply says:  If you tell the public you do something, then you must do it.  Adam Smith, the author of the Wealth of Nations in 1776, and arguably the father of capitalism, noted that a marketplace based upon fraud is not free.

If your veto is not overridden, then we will be back with a bill to ban the sale of these products altogether, in light of the recent massacres in Germany and in this country directly caused by these murder simulation products that are being copycatted by teens who are being fraudulently sold them.

But seriously,  "even more restrictive legislation" ? This was borderline First Amendment violation, so you come back with an obvious violation?

For the US the 1st amendement will keep that type of legislation locked up in court for years, but other countries may not view the freedom of speech the same way.
The 1st amendment of the US constitution is the countries saving grace aswell as its most abused political tool. Similar constitutional entries in other countries generally have limits imposed on the applicability of its content. (generally for obvious hate mongering and racial predudice)

Actually, not to sound like an ass or anything, but he does. Hell, we all do. We just have to act upon it. If Dennis e-mailed Gov. Huntsmann, he's using his political power as a vocal citizen to influence a politician.

Now accusing Dennis of doing something illegal or unethical is childish; it's the usual fare Jack displays when things don't go his way (e.g. his disbarment trial).

A) Causation has still not been proven.  At all.  Deal with it.

B) The Germany shooting?  The kid had mental problems, and his parents left an unlocked weapon in a bedroom where the kid had easy access to it.  You really think video games are to blame?

C) Nowhere save in a dictatorship will you succeed in an attempt to ban all violent media, simply because 1) 'Violent' is far too broad a term, 2) Such a ban is a 1st Amendment violation (Aren't you a 1st Amendment 'expert'?  You should know this) and 3) Once again, causation has not been proven.

D) Do you really think anyone takes your threats seriously anymore?

Another conspiracy accusation?  Who'da thought?  Of course, its simply not possible that a rational, logical adult would find fault with anything Thompson does/supports, therefore any opposition is obviously either an oblivious moron, a tool of the industry, or being blackmailed.  It all makes sense.

And also LOL at the fact that he's accusing others of not wanting to do exactly what he is trying to prevent.  What good is parental intervention/education if the government decides -it- is the parent?

Actually, what I think Nightwing is suggesting is that the comment could be considered libelous and actionable. While Dennis has seemed in the time I've lurked around here to be too level-headed to bother with something so frivelous, Nightwing may have a point.

It's iffy.  Dennis might choose to overlook it.  But I thought he might want to know because his name was called.

In shout, Dennis doesn't think it's him.  But I think the way the comment is written is what happens when someone is so angry that things didn't go their way that he's, in effect, stuttering/sputtering.
