Jack Thompson Threatens to "Proceed" Against Utah Attorney General

In the fallout from his latest, apparently unsuccessful attempt to legislate video games in Utah, disbarred Miami attorney Jack Thompson has issued a vague legal threat to Utah Attorney General Mark Shurtleff. The popular Republican is serving his third term as Utah's top law enforcement officer.
On Friday the Salt Lake Tribune reported that Shurtleff had expressed concerns about the legality of HB 353, the Thompson-conceived video game bill which was vetoed by Gov. Jon Huntsman last week.
Thompson, clearly, was not thrilled with the news. He referred to Shurtleff as "dead meat" in the header of an e-mail forwarded to GamePolitics later on Friday.
A Sunday e-mail from Thompson to Salt Lake Tribune reporter Robert Gehrke (and cc:'d to GP) threatens to "proceed" against Shurtleff if the A.G. doesn't move against major retailers for what Thompson claims is "the distribution of pornography to minors in violation of state law." By way of defining porn, Thompson attached links to strip club and hooker scenes from Grand Theft Auto IV. However, while certainly not intended for younger buyers, GTA IV has not been declared obscene in any U.S. jurisdiction.
Oh, and there's a deadline for Shurtleff to act: 5:00 P.M. today.
As GamePolitics has previously reported, Thompson called for Shurtleff's impeachment in 2007 when the A.G. suggested that a piece of Thompson-authored video game legislation then before the Utah House was unconstitutional.
GamePolitics has requested comment on Thompson's threat from Rep. Mike Morley, the sponsor of HB 353, as well as from Gayle Ruzicka, the politically-powerful Thompson ally who heads the ultra-conservative Utah Eagle Forum. We have also asked Shurtleff's office to comment. We'll post any comments that we receive.
UPDATE: Apparently unable to wait for his own 5:00 P.M. deadline, Thompson has written to Utah's Obscenity and Pornography Complaints Ombudsman... Except that the person he addressed his letter to is a law enforcement director in Utah A.G.'s Office. The "porn czar" position was eliminated in 2003 for budgetary reasons - which may be an indication of how serious Thompson is about all of this.
UPDATE 2: Rep. Morley has commented to GamePolitics on Thompson's threat to "proceed" against Shurtleff: "I know nothing about that."

It was a great pleasure meeting you outside Gary Herbert’s office about two months ago. I was with Gayle Ruzicka, Karen Clark, and Alan and Suzanne Osmond to discuss HB 353 with Lt. Gov. Herbert. I particularly enjoyed learning that we both have a dear friend in Lt. Col. Dave Grossman, who heartily endorsed HB 353, in light of the movie and video game retailers’ fraudulent activities.
As you know, the bill was overwhelmingly passed by both houses, only to see Gov. Huntsman veto it. Mr. Huntsman either has no understanding whatsoever of the bill or he doesn’t care to know. His explanation that the movie and video game industries would take their age ratings off the movies and games was an utterly absurd statement, as that cannot be done by virtue of binding contractual obligations they have. The Governor was sold a bill of goods which he bought, for whatever reason. As a result, we can look forward to more false advertising by major retail concerns such as Best Buy.
Be that as it may, Utah’s obscenity/pornography/sexual material harmful to minors statutes are still on the books. Gov. Huntsman hasn’t managed to void them—yet.
Thus, I write you regarding those constitutional laws, as I am told you are Utah’s Obscenity and Pornography Complaints Ombudsman. If you are not, please get this letter to him/her quickly.
Nearly a month ago, I informed A.G. Shurtleff in writing that all video game retailers are openly selling Grand Theft Auto IV to 17-year-olds in Utah. They are doing this both on-line and in their brick and mortar stores. Why the video game industry thinks it can sell indecent material to 17-year-olds just because they have a “Mature” rating system that uses 17 years as the demarcation line when the law makes it 18 is beyond me, but the ways of the video game industry are inexplicable to most normal folks. A 17-year-old is a minor, as you know, and yet someone of that age can walk into Wal-Mart, show a driver’s license indicating he is 17, and walk out with this indecent, pornographic game.
This particular game clearly constitutes sexual material harmful to minors, and its sale to anyone under 18 is a criminal act. If you doubt that, please click on the below two links and see for yourself. I believe most juries in Utah would find this material to be obscene under Miller v. California for sale to adults, let alone children.

I don’t know if Mr. Shurtleff is looking the other way from this ongoing criminal activity because of his cozy relationship with the video game industry, which has included not only the payment of campaign contributions from the Entertainment Software Association to him as well as his doing PSA’s with the ESRB, which were really unreported in-kind campaign contributions by the industry to him during his re-election cycle. Regardless of the reason, his failure to enforce these criminal laws has to stop. This failure is a violation of his oath of office and constitutes an impeachable offense.
Please advise at your earliest convenience that the Attorney General has either begun a prosecution of those individuals selling GTA IV to minors or that he has sent out a letter statewide, through all major media, that this practice must stop immediately. If he does not do either of those things, then I shall proceed in the fashion I must to see to it that Mr. Shurtleff starts doing his job in this regard.
Children are more important than keeping a scofflaw industry happy in Utah.

Oh boy, another one of his lie-filled empty threats and deadlines. It's getting even sadder that we can now utterly count on this behavior out of him every single time.

I honestly agree with you. Jack is one coffee spill/traffic accident away from a full blown mental meltdown or possibly a heart attack. No one can stay this keyed up for this long. Normally I would tell someone wound up like this to go get laid. But knowing how religious Jack is I'm unsure if "getting laid" is a reality for him or not.

I understand your edit, but one thing needs to be clear about this family thing: his wife is supporting him, paying his bills, airfare, etc. She is as much of an enabler of Thompson's antics as anyone.
Plus, he uses his son(who may or may not be a willing participant) on his "stings".

The funniest thing about this latest temper tantrum is that this is the first time his shameful disbarrment has been mentioned in the larger media. 27 counts of unethical conduct (including 4 for deliberately lying to a court) is hardly something to be proud of, and more people are learning of that every day.
Jack seems oblivious to the fact that other people have the internet- powerful people. All they need to do is a quick search, and there lies not only Jack's record, but all of the stupid things he has said all these years.

Not usually. The worst it usually warrants is a bit of scrutiny to make sure you're not making an actual threat, and the FBI or Secret Service politely knocking on your door to ask you to tone it on the remarks that can be construed as threats.

I agree with your assessment, but I had a debit card when I was thirteen, and enough money in it to purchase video games if I so chose. Most sites have a way of knowing just how old the holder of the card is, of course, but still.
Not a perfect world, but it still holds them pretty much "null and void" to the accusation of that they are selling to minors purposefully. They do have precautions...lame ones...but precautions none the less.

The only plausable threat to the AG depends on how much sway the Eagle Forum and other Utah zealots have over the legislature. They managed to get this law through legislature with little problem. Literary: I know the plot of GTA is fairly simplistic, but i found myself intrigued and wrestled with some of the choices you had to make during it, and was impressed at the outcomes of them. I also enjoyed the hilarious comedic radio stations which are very well written.
Artistic: The city, while based on NYC is beautifully rendered, all of the music is by recognised artists.
Political: There is a lot of political humour present in the game, poking fun at Republicans and Conservatives alike.

I'm sorry to tell you mdo7 but "chan" is not a name suffixe denoting respect in Japanese. Well, it is but i'ts mostly used with close family and friends, to people you want to demonstrate some affection. Otherwise it's san or sama (sama being even more honorific so I don't recommend it with Thompson).

When I said Jackie-chan. I used it as a humor. I used this in another article (Don't remember where). When I said that first time, a picture of JT doing a Kung-Fu kick was another person reply for my humor. You need to know when I'm using humor or not.
Just a sidenote. the -chan honorific refers to a female. If he were japanese he would be jackie-san (technically he would be senpai. Even if we dont like him he is older than most, hense considered senior).
Then again if jackie were japanese he would also have likely been tossed into an active volcano or feed to a nameless giant radioactive lizard to protect the public. jackie does not understand the concept behind honor so would not do well in most other countries. On second thought I wonder how much postage it would be to ship him off somewhere.. maybe Greenland.
Hehe here I go again, the chan name suffixe can be used in a honorific way with women and girls but only if they are younger than you are. Otherwise san still applies. Chan can still be used with men and boys that are closed friends and family but usually, kun will be used instead. As for Senpai, that is used with "seniors" but only with senior colleagues. Like senior students in school or co-workers that have been there longer than you have.
I'll admit I'm not the best ressource when it comes to japanese though. I'll ask when I'm in Tokyo this summer ;)

Jack's defintion of pornography really makes me laugh. Those scenes he cited would probably be rated PG-13 in a movie. You can't see anything with the hookers and the strippers have bikinis and thongs on to cover their private areas. There's nothing even close to pornographic in GTAIV, the game is rated M for Mature and if your under 17 an adult has to be with you durring the purchase. In fact the retailers he cited also have the best enforcement policies according to the FCC. I honestly think the only thing that will stop Jack from acting like this if he ends in jail or sued for a lot of money and one or both will probably happen within the next year or so.
Apparently you missed the whole part about him linking to videos on YouTube, which doesn't carry ANYTHING pornographic. That pretty much puts the nail in the coffin right there.

heres the funny thing about this. none of the stuff showed porn in it what so ever (wellmaybe the car bit if you go by motions). in my book. for somthing to be pornographic, it has to A, HAve a topless or nude females, B (optional) nude males, C, show in detail what is going on aka close up of all the "bad stuff" in jacks world.
GTA has none of that at all.
The strippers are clothed, gratned it be in thongs and very small nipple cover tops, but is still coverd. none of them are ever nude or topless.
The hookers you can pic up just move into your lap and you can only tell whats going on if you bother to move the camera, but once again. not detail what so ever.

I think there is really something emotionally wrecked about Thompson, his actions really are child-like in response. Either someone is with him or against him and as soon as he doesn't get his way then he lashes out, no matter the facts or situation. It's all or nothing with him: any level of objective 'pornographic' content should be outlawed, all games are teaching people to kill and any protests or against his work results in legal threats and moral outrage.
I have sympathy for him, maybe he's had harsh times in the playground or somewhere during childhood, but he's physically a fully grown adult and needs to take responsibility, rather than constantly screaming at everyone around him. He can't go on like this forever.
At the end of the day, Jack is still responsible for his actions, and for that he deserves absolutely no pity.

I'm getting confused. First Jack tries to get a law put in plade that will bring legal action against retailers if they say that they will uphold the ESRBs 17 and up M rating. Now he is opposed to the 17 and up M rating. So does he want it enforced not?
