Utah Senate President Wants to Prosecute Jack Thompson Under CAN-SPAM Act

It seems as though Jack Thompson may have burned his final bridge in Utah - and turned a former political ally into an adversary in the process.

In an e-mail sent out earlier today, Thompson claimed that Utah State Senate President Michael Waddoups (R, at left) has threatened to have him prosecuted if the disbarred attorney doesn't stop sending him e-mails.

Waddoups, who presided over the Utah Senate as it overwhelmingly passed Thompson's video game bill last month, apparently became upset by an Easter Sunday e-mail in which Thompson attacked Utah Attorney General Mark Shurtleff.

As GamePolitics has reported, the disbarred Florida attorney and the popular Utah A.G. have been trading insults ever since the bill was vetoed by Gov. Jon Huntsman. On Sunday Thompson slammed Shurtleff in yet another e-mail which claimed that the A.G. is ignoring the sale of pornography to minors. That's a highly questionable assertion, since in this case Thompson is defining Grand Theft Auto IV as pornography.

To back up his point, Thompson included a screenshot depicting of a pair of strippers giving GTA IV protagonist Nico Bellic a lap dance. Why Waddoups reacted so strongly is not entirely clear, although it is possible that he was offended by the pic. Or perhaps he has grown weary of Thompson's persistent attacks on Gov. Huntsman and A.G. Shurtleff, both fellow Republicans. GamePolitics contacted Waddoups for comment, but the Senate President did not return our call.

In any case, Thompson supplied the text of an e-mail that he says he received from Waddoups earlier today:

I asked you before to remove me from your mailing list.  I supported your bill but because of the harassment will not again.  If I am not removed I will turn you over to the AG for legal action.

In response, Thomson re-sent the lapdance pic to the entire Utah legislature:

If you are offended by seeing this, as was Senate President Waddoups, then know that you should be more offended by the fact that Utah kids can buy the game in which there are repeated sexual encounters like this... 

You will apparently read in the Salt Lake Tribune tomorrow morning that Senator Waddoups has now threatened me with criminal prosecution by Mark Shurtleff for sending him “porn.”...  Mr. Waddoups now threatens me for alerting him to this... I look forward to my criminal prosecution in Utah...

GamePolitics readers may recall that Thompson has a bit of a track record for attaching actual porn - not the GTA virtual variety - to his e-mails. In 2007 a federal court judge and the Florida Supreme Court took him to task for doing so (see Judge Spanks Jack Thompson For Including Gay Porn in Court Filing).

UPDATE: The Salt Lake Tribune reports that Waddoups wants to pursue Thompson under federal anti-spam legislation:

Waddoups, on Tuesday, confirmed he would attempt to pursue legal action under the federal CAN-SPAM Act of 2003.

While that law carries a punishment of up to $11,000 in fines, it covers "e-mail whose primary advertisement purpose is advertising or promoting a commercial product or service," according to the Federal Trade Commission.

UPDATE 2: Predictably, Thompson has written to the U.S. Attorney in Salt Lake City, urging that Waddoups be prosecuted for violating his civil rights. The letter, which we have also received via e-mail, can be viewed in the comments to the Salt Lake Tribune story.

How hard would you laugh if JT gets jail time for doing this stuff.  I think after doing this to another state, and being disbarred, he should already be forced into jail time for disturbing the peace, wasting tax payer money with his mindless chatter, and for waster electricity for his spam online.

Actually, Pokemon (along with Dragonball Z) is the reason why I'm a big fan of anime and manga  (I watch a lot of entertainment from Asia, China and Japan to be exact).  The Pokemon manga (along with DB and DBZ manga) is the reason why I'm reading manga today.  Let's not forget good ol' Toonami (RIP Toonami) that help made anime public to everybody.  I would credit all these for making anime and manga popular today, it's no longer a small market like it was in the early 90's.  You don't have anything to be embarassed to be about, what Pokemon did was give anime a spotlight.

While your reasons for wanting that is understandable, it is impossible to keep his family out of it.

Personally, I as well as a few members here (they know who they are)* feel sorry for Patricia and Little John b/c they have to put up with his antics more than anyone else. I specifically do not believe they deserve to be damned for supporting Jack as they cannot do anything else regarding the problem with him.

Agreed to a point. Bringing up his wife and child to some degree isn't that hypocritical since Thompson pretty much did it first, what with using his child as a sample size of one, making the son look like something of a stooge, while later using his wife as a sort of pity card on more than one occassion. "Meh, she has cancer, i need time with her, postpone the thing i said i wanted done immediately."

Geez! He is really pushing his luck(again) with this. I personally won't be surprised if he Is taken to task by a judge for doing this. One would think that any half way sane man would know when he is pushing his luck and about to get in serious legal trouble with someone of the law;Then again Thompson has never struck me as someone half way sane. With every passing day he seems to blurr the already thin line between being classified as sane or Insane. He is just sane and civil enough *Snort* to stay out of the nut house. All it will take is one slip up on his part to have him classified as dangerously unstable. That being said, I hope that if such an event occurs that it does not involve violence, and less so caused or inspired by a gamer. Unfortunetly I can see, with the brush Mr.Thompson has painted himself with, him doing exactly what he has accused gamers of doing IE:playing violent videogames till he is ready to go somewhere and gun down some innocent people before shooting himself, all as some sort of sad and sick way of saying "I told you so. I told you I was right."  While I detest the things this man has done and the way he has gone about reaching his goal, I do not hate him, nor do I wish him ill.

 

Responsibility: Its time that the next generation takes up the reigns of power in our government, before the old fools who hold them steer this country of ours closer to capsizing. We must act before its to late to repair the damage.

While I find this to be good news I can't decide if it is a testament to my representatives growing a set, or Thompson's supernatural ability to alienate anyone.

One would think disbarment would make him think about toning down the whole burning of bridges and attacking people that COULD HAVE been his friend(s)....hell he didn't burn the bridge. That is actually my main concern.  While he is annoying, I am not sure how the law will actually apply to him or if we even WANT it to apply since if it is a new application one can expect to see it used on others too.  I suspect we have another lawmaker who doesn't understand the law here.

Giving someone your opinioin is Freedom of Speech and a Right.

Giving someone your opinion repeatedly, over and over in multiple formats, accusing anyone who doesn't accept your opinion as the only possible opinion of being some kind of traitor etc, those are harrassment.

It's entirely possible that, rather than it being anything in particular in that one letter, it was just that the Senate President had got utterly fed up with recieving continual communication from Thompson despite requests to stop.

Since Thompsons' Email's are purely to promote a failed law that he himself helped to write, something he made no secret of at the time, I would agree that his behaviour hovers dangerously close to promotional activity, though you'd have trouble proving it was a commercial venture.

Basically, Thompson's being an ass again, and, as with NIMF, he managed to make an enemy out of an ally through his sheer presumption and arrogance.

 

Edit: Of course, the funniest part is that the person who has made it far less likely that the law will be re-heard or the veto overturned is one of the group that tried to get it enforced, that's a nice little twist of karma, and not one the Eagle Forum will forget, I suspect ;)

Thompson doesn't just burn bridges. He runs onto a bridge, sets that end on fire from on the bridge, then runs to the other side, sets another fire while being so short sighted as to not get off the bridge, then can't figure out for the life of him why he's trapped between two closing fires, but then decides everyone else was out to get him

Hey Utah, many people in the Videogame Industry know that this is what Jack Thompson usually does since he is now a Disbarred Lawyer.

Don't just sue him, throw that madman in jail and take away his internet rights.

That is the only way you could ever get rid of him.

Also take it from a few people from the Florida Bar who also had to deal with this jerk, Jack will never change. And he ever pays for his fines too.

I would suggest Mr. Thompson to seek out the aid and stability of friends and family. Find a little peace and quiet. I would also suggest that he perhaps talk to a psychologist. Being upset so much about something that he feels pressed into sending another person emails, continuously, even when that person is starting to threaten that you stop, doesn't sound quite right. It reads somewhat like Mr. Thompson is unable to see or empathically feel another persons views the way most other people can, if these views collide with those of his own.

 

I've also read that Mr. Thompson will easily have the feeling that somebody is breaking his trust. That he would often question peoples "inner compass" of right or wrong, when it looks like they are considering his ideas, but found that there are issues left to be addressed or other problems with those ideas. Because this seems to have happened in the past already several times, it's a behaviour pattern he should also consider getting looked at.

ya seriously, this is hilarious since this is a perfect example of why Jack is his own worst enemy. Out of all the anti-game legislation created, the bill in Utah was probably the closest to a constitutionally sound bill, and yet because of Jack's antics, many Senate members will not want anything to do with him or support the legislation he helps create. He pretty much killed any kind of chance he might have had in Utah... It's kind of funny thinking that Jack might be a much more viable threat if he was just more civil.

Funny thing is this is a part 2. Last time he was in Utah to pass a law, he got burned (surprised) and when crazy on the Attorney General. Now this time, he is starting to attack the Attorney General and the Senate President x.x  I would love to see a part 3...Jack vs the State....Jack loses.

You forgot to include the Utah Governor as a target of Jack attack... Also as for Lousiana, i'm not sure as states have an annoying way of ignoring Jack's antics outside their own state.

BUT, if i recall, Jack did quite a bit of bridge burning the last time he was down in lousiana... what with his demands that things be down his way, and holding back "evidence" and "experts" because they were not fighting "hard enough" to get his Bill passed... not to mention that the last time the bill did pass, but ended up getting shot down in court and costing the state thousands of dollars; and Jack was the one swearing to high heaven that it was constitutional.

Well jackie already tried to have the have the AG of Utah impeached and removed becuase he would did not support jackie in the past.  Not much of a reach (at least for jackie) to try and impeach the Utah Senate President, er Um Mr. Waddoups.  Not even vaguely wise of course but this is never slowed john bruce before.  

Utah was almost in his grasp. 

Wondering if he is keeps it up if they will take back that award he got in Utah last year.  Bet that would get his attention.

Hold the fucking train.  So Jack, who has repeatedly threatened people who have emailed him, says that his civil rights are being threatened if he cannot spam this individual?  What the fuck?

JDKJ: Part of the problem is, I believe, that (a) the Army had a lot of time and money already invested in him and which they were unwilling to simply write-off and (b) an increasing need for the type of skills and services he provided.

JDKJ: And it isn't yet clear what type of ammunition Hasan used. It's strange that he purchased a gun but didn't purchase ammunition for it at the same place and time. Especially because the calibre required is peculiar to the actual gun.
