A new plan being prepared by the British government would see drastic action implemented against individual file sharers, reports the Irish Independent.
Business Secretary Lord Mandelson (left) will call for a new law that would allow Internet access restrictions as well as fines of up to £50,000 for those found engaging in P2P.
However, former minister for digital engagement Tom Watson has criticized the plan:
Not only do the sanctions ultimately risk criminalising a large proportion of UK citizens, but they also attach an unbearable regulatory burden on an emerging technology that has the power to transform society, with no guarantees at the end that our artists and our culture will get any richer.
Working on the safe assumptions that (a) people like downloading music from the internet, and (b) most people would prefer not to break the law, we should aim to map a way forward for businesses to take financial advantage of the digital market.

Granted about $100,000 US is an absurd amount, it still is less then the couple of million that they were charging over here... unless they are planning on charging $100,000 per song. Then they would be back to BSI.

This is why we need a clearer harder and wider definition of fair use and what people can do with CP that is not truly damaging to CP creators..... you can not trust the rich and the government to handle things correctly....

For those that only read the summary and didn't bother to read the original article there is no plan to Outlaw p2p.
The fines and restrictions mentioned were only in reference to people who use p2p for illegal activities.

Ok, I can understand them wanting to crack down on the copywrite theft side of things, but as many people have said there are still Legal uses of P2P, also why aren't the UK government going after people who are commiting violent crime, oh yeah they'd much rather go after the easy cases... tbh other than siezing your computer can they actually tell whats being downloaded? can they discriminate between legal and illegal p2p? oh wait discrimination of any kind is illegal in the UK.
on another note, Mandelson is the evil behind Tony Blair and Gordon Brown, he commits various offences, recieves money/gifts from various people who want the government/law "adjusted" to suit their means, these should be illegal practices but with good old Peter, its a slap on the wrist and a "drop out of sight for 6 months and we'll find you a new job" the guy needs to be sent to a proper prison (not a nice fluffy one like we currently have )

In a society where the most dangerous criminals on the internet are those who try to hack into people's accounts and wireless internet connection decices. Steak their passwords/private information/bank details and steal all their money. (Cyber Criminals I think they are called)
And yet the Governments of the world want to crack down on P2P file sharing, porn, violent videogames because they consider those things in the internet more harmful than the former...I think some governments don't really fully understand what they SHOULD and SHOULD NOT worry about on the internet.
Or maybe because the governments of the world don't wan't to target the Cyber Criminals all because they are too hard to catch, yet they pick on innocent people who just happen to be into P2P, porn or Violent Videogames...it seems to me that the Government like the UK and the Australian Governments need to focus more on the important issues online and not on wastefull things like trying to make something so unique to the internet into something illegal.
It is a sad world we live in when people in power don't have a clue in what they are messing with.

there fixed it for them... there is a way for people to download music and allow businesses to take financial advantage... it's called itunes (and other similar avenues)
The reason people use file sharing to get music is because file sharing is FREE... essentially, what Watson is really saying is that the industry should find a way to provide free music to consumers while still finding a way to benefit from it financially... seriously, the guy should not speak up about such a notion unless he actually has a plan that could bring about such a thing. Only idea i can think of is somehow setting it up so that downloaders are forced to watch/listen to advertisements (that way the industry can make money by selling commercial time)... kinda like what some have been doing with youtube.
Ofcourse, that's not to say what the UK is doing is right... when it comes down to it their are legal reasons to use file sharing as not EVERYTHING being shared is copyrighted/stolen material. Not to mention that the fines involved tend to be WAY to high.

Well, as for video... you do have sites like Hulu and the "Channels" section on youtube, of which i think all the shows on there are free and legal to watch. The catch is that you are forced to watch commercials and thats how the owners of the shows make their money... i know they do TV shows but i'm not sure if they do movies
The only real problem is that not EVERY show/episode you could possibly want are available... but these things are still rather young and need time to catch up...

Ah, shame that... though like i said, these things are still young; i mean i think Hulu only started like 2 years ago. If the industry really does feel like it's working to make them enough of a profit, then you just gotta give it some time for it to really become a mainstream... it'll probably go world wide once more sites start popping up to jump on the bandwagon

This won't end well. As said, there are no guarantees that this will help the decaying business models by eliminating a distribution channel. It just drives it underground....

Actually, outlawing P2P would outlaw a good bunch of games too, not only those that use P2P in a obvious manner (like Taikodom wher you download the official installer using torrent), but also ones that use P2P for updates (WoW) or some that use P2P technology in its multiplayer or some other misc stuff...

Yes, but I very much doubt that anyone is proposing outlawing P2P per se. It's just being used as a shortening for sharing copyrighted files on a P2P network without the copyright holder's permission. Any actual law would be more specific about this.

Some use P2P to share rare unlicensed remixes, usually in the electronic music scene. It's not like everything being shared is illegal. The punishment should definitely fit the crime, because it's ridiculous that you could get fined for a lot less for shoplifting a physical music album from a store, and "shoplifting" digital content is punished more severely.

I get why you want to punish people for breaking the law. They're breaking the law. What I still don't understand is why the hell you would charge such an insane amount of money for it. The average person isn't going to be able to pay such a stupid fee, and they know it, but people aren't going to stop file sharing either. People are fined less for reckless driving for Pete's sake-and those people put other people's LIVES at risk. P2P does no such thing.
And P2P doesn't automatically mean they're sharing copyrighted files, yes that's what most people do, I won't say otherwise, but to punish everyone who uses P2P, just because it's P2P, is stupid.
Thank you, Tom Watson, for being able to think rationally.
Finally, no offense to anyone in the UK, but Lord Mandelson's bow (tied onto his tie!?) made me giggle.

Agreed. A £50-100 fine with a reasonable appeals mechanism would be a perfectly adequate deterrent.
I'd still be pretty bitter if I was fined, of course but I wouldn't expect anyone to have any sympathy for me...

You have a point about P2P. I'm an avid Guild Wars player, and they use P2P filesharing to decrease load times (very effectively, too, imo). That means that, technically, you'd have to pay fees to this organization for UK players just to play an F2P MMO.

This is a terrible idea. Tom Watson has the right idea here. When people find a new to obtain goods/services illegally, you don't try to ban it, you take it for yourselves and use it as a way to get money.

Not surprising after Mandelson has been wined and dined on a yacht paid for by the Dreamworks CEO. Mandelson it should be noted receives a lot of presents from wealthy men and out of coincidence suddenly the government decides to bring in favourable policies. BTW for people who don't know Mandelson is in charge of the UK.
Two weeks ago Mandelson had dinner with Coloner Gadaffi's son, two weeks later the only man to be convicted of the Lockerbie bombings is to be released. Coincidence?

Uh, Mandelson is definitely not "in charge of the UK". He's taking the Prime Minister's (Gordon Brown) duties for a short period of time while said Prime Minister is on holiday. Before Mandelson had his turn, it was Alistair Darling, and (I think) Hazel Blears.

Whilst I agree with the fact that Mandelson has far too much power in government, it must be stated that he hasn't got any control of the Scottish justice system due to devolved powers. The minister with the final say over the Lockerbie bomber is Kenny MacAskill (part of the SNP administration).

Whilst Mandelson doesn't have the power himself in Scotland, it's not as though he was unable to advise on the release or insist on it. We all know what sort of a man Mandelson is with all of his dodgy deals, it's possible this may have been one of them. He may have made a deal with the Scottish government over budgets in return for the bomber's release. We will not know what goes on behind closed doors, but it would be naive to believe that the UK government hasn't had any role in this decision at all.
