Bureaucracy Delays France’s Hadopi Law

France’s controversial “three-strikes” law aimed at taking down illegal downloaders appears to have suffered a delay while the government seeks mandatory approval of the law from an independent authority.

France needs an opinion from the Commission Nationale de l’Informatique et des Libertés (CNIL) to enact the law writes Paid Content. So far, CNIL has chosen not to issue a decree, reports La Tribune, thus effectively blocking the implementation of the law, which was scheduled to be put into motion this month.

This bump in the road could mean a delay of three months until the law, also known as the Hadopi Law, is enacted.

Internet pirates will be warned twice under the law—once by email and once in a physical delivered letter—before a third strike is issued, which could result in fines, prison terms and/or the loss of Internet service.

Hmph, a double-edged sword. On one hand, the real criminals are put in their tracks, while the ones that pirate for legit reasons are also shunted with them.

Can't back one edge without backing the other. A real problem.

If by "pirate" he means "uses torrents and other such methods that are routinely (and erroeneously) assumed to be used ONLY for piracy" then I have a response.

If that's what he means then there's no need.  I can think of plenty myself.  However, off the top of my head, I can't think of any circumstances that would legitimize piracy.

I can. I paid for in full Morrowind and Oblivion through Steam. If steam goes the way of the dodo though I am out my games, so I have pirate copies waiting in the wings so to speak, in case that ever happens. Yet in France that would mean I get disconnected from the internet, fines, and possible JAIL TIME. How ridiculous is that?

Eh, there's still more for me to learn, but DarkSaber's got it right. Torrents and whatnot are constantly assumed to be stealing or pirating, and yet can be used for things that are perfectly legal AS WELL AS for internet piracy. The issue is stopping the pirates while allowing the legal ops, without getting the two mixed up or lumped into one group, be it legal ops or pirates.

Not gonna happen, 'cause they base their "three strikes" on your IP address caught on p2p networks (torrents&cie or yous broadband usage), so basically that means that you're a vile pirate even if the only thing you did was your wow client update...

Therein lies the problem. They should be able to tell the difference, and yet they choose not to. As you said, even if someone's just updating their WoW client, for all these people know, they're stealing the updated information, and should rot behind some iron bars for it.

Yeah, but they can't tell what you were downloading when you got caught, in fact they have no idea of the technical reality (they say that the firewall in OpenOffice should be sufficient to protect you from ip thieves) or how they're going to pay for that.

Not to mention the fact it's increasingly commonplace for unsigned or amateur filmmakers to put demo products up on torrent site for fans to download as free samples.
