Pirated Copies of Namco Title Spill onto Internet

Illegal beta copies of Namco’s blood-soaked Splatterhouse game are up for sale online for the price of $675.00 each (shipping included).

Worthplaying discovered the illegal wares for sale on the collector site ASSEMbler, where a user named dulledblade posted a series of pictures in an attempt to prove the legitimacy of the copies. Dulledblade claimed to have pulled the betas off of four nonworking Xbox 360 test kits and instructs that the games have to be played on an Xbox 360 development kit (XDK), which he also sells, for $1,150 each (once again, shipping is included). Package deals featuring an XDK and a copy of Splatterhouse are also apparently for sale by the same user.

Worthplaying notes that the brazen seller did very little to hide his identity; using his Gamertag on his Xbox-Scene postings and putting his location down as Michigan.

Splatterhouse was originally in development by BottleRocket Entertainment, but was later assigned to an internal team at Namco. The game is due out sometime this year for both the 360 and the PlayStation 3.

Yes, but he's got a dev kit. It's not as though any of this is playable on a commercial machine, so the content is quite well protected.

Hes selling stolen goods, there is a diffrence in getting it and keeping it for yourself and 10 milloin other close friends quite another to sell it to the nearest fool you can find!

Wow! Only $675! What a deal! Let's get to downloading! (sic) The original PS3 was cheaper than that! Isn't getting stuff for FREE the whole point to pirating? Or at least cheap! I don't think Namco has anything to worry about with this guy.

Hmm, if he purchased those units legally and the software was on them, this might not be illegal. I remember a court case a while ago dealing with this sort of thing. Of course now that it's relevent, i'l never find the articles again.

It had to do with copyrights not working when the music (in those cases) was not sold as a copyrighted work.

I imagine it would depend on the details, specificly, what terms the software was on the drives under.

In general, just because someone buys something legally, if there is illegal material with it, it does not magically become legal.  I think normally he would be covered by the same IP and lisence restrictions the originial developers had, so if the games were 'do not distribute' and depended on IP that was not lisenced yet (or to him) then he still could not sell them.

I wonder if the guy is one of those Storage depot owners. When a tennant doesn't pay rent for his storage unit I believe that he owner of the depot notifies the client and if he/she does not respond in a determined amount of days the contents inside the storage room belong to him.

Or maybe he stole them who knows.
