AU Teen Arrested for Playing “Offensive” Music in Public

While the incident isn’t game related, an Australian teenager’s recent run in with the law illustrates the country’s growing web of censorship.

The Herald Sun features the story of 19-year old Nathan Michael Wilkie (pictured), a resident of the town of Timboon in the territory of Victoria. Wilkie was in a supermarket parking lot waiting for his mother and passing time by pumping some music when cops showed up. Police allegedly stuck their heads in the car window and were not impressed by the expletive-laden lyrics they heard from “underground rapper” Kid Selzy, as they arrested the teenager. The police reportedly found the music offensive and derogatory to females. 

The paper wrote that Wilkie was charged with “offensive behavior for listening to music,” which is believed to be the first charge of its kind in Australia.

A sample of the lyrics Wilkie was listening to allegedly included “shut your f------ mouth bitch, f------ motherf-----". Wilkie also reportedly told the officers that they were “a joke” and to “go do some real police work.”

Wilkie is scheduled to have his day in court on June 11. He will plead not guilty and will also be supported by Kid Selzy himself, who has promised to show up in court to support the teen. Selzy is also from Victoria.

The trial will turn into a listening party of sorts as police are expected to play Selzy’s album The Creepshow for the benefit of the court.

I'm starting to wonder if the police heard the music, were offended, and decided that the music being played at any volume is "too loud."

Seriously though, if the kid's gonna get banned for listening to music, arrest the artists who wrote/performed it and the people responsible for producing it. Go the whole 9 yards. Teenagers are paranoid and angsty enough towards adults without cops literally picking on them for being punks.

Hey, if police in the AU want to live up to the "fascist pig" stereotype, I say go for it, because it will make teens not give in to that bullshit and so that they'll work to change it in the future when they grow up.

Since we don't have much in the way of facts, all we can really take so far is this:

1. The charge has nothing to do with volume, only "offensive behaviour"... whatever the hell that means.
2. The police stuck their heads into the window without reason or warrant.
3. Why the hell did they have to stick their heads into the car if the music was too loud?

This wouldn't surprise me though. My friend from Aussieland's wife got attacked by 2 people. They tried to steal her baby. A man came outside to fight them off and helped her get home. Anyway, my friend and his wife called the police and an officer came over. They told him the story. He actually didn't believe them, and further, was pissed off enough to charge them. What the exact charge was, I don't know, but I do know that I haven't heard much from him these past few days, he's been busy fighting this in court.

Here's the best part: later that same week, another woman got attacked and had her baby taken from her... by 2 attackers who matched the description my friend's wife gave. Once my friend found out, he called the police to see if they would drop the charges. Not only did they not drop the charges, they sent officers over (somehow, with a warrant) to investigate the house. He had plans to bring it to the media after that. I will try to find out if he did.

TL;DR Aussie police are facists.

first question is how loud was the music to begin with, second, where were they parked, and third is that the ACTUAL reason given for the arrest?

I wouldn´t be surprised if they arrested him also for the way he looks. I´m amazed they didn´t call the SWAT team (or whatever they have there).

Can I point out to people that there is a noise law in Australia that prevents volume over certain decibels in a vehicle? All the time you see P platers driving around with their highly distorted doof-doof garbage and their windows down.

This kid supposedly had his music too loud, someone complained about it. Cops pulled him up, found the music and realized that no only was it too loud, but it contained racial and sexual expletives. About time the cops FINALLY got someone for having shitty music playing at high volume. I shouldn't be able to hear some moron swearing every second word to barely syncronized distortion from inside MY car wtih MY volume up high and the window closed!

The existance of the so-called noise law is the same circumvent-Human-Rights laws that various legislators are trying to create in various nations and states around the world.  Let's use scaremongering and misinformation tactics to attempt to prevent various retailers from selling the stuff the politiicans, organizations, and "moral majority" don't want others to listen to, read, or watch.

Since these officers are most likely not carrying around devices to determine and record decibel levels, and since they, as well as you, have stated that it is, in fact, the CONTENT, that offends you, then it is very clear that this law is ONLY implemented on material the officers and other Anti-Human Rights individuals, organizations, and government wanted silenced altogether.  The noise law is a sham and a clear attempt to circumvent the Human Rights of various indivdiuals.

I find THAT far more obscene and offensive than any music lyric of any music genre that I have no interest in.

Makes you wonder if there wasn't more than the one charge.  I could get behind nabbing the boy for excessive volume but not “offensive behavior for listening to music" (as long as that actually means charged with exceedingly crummy taste in tunes).

Restricting Music because it's offensive would be a violation of Free Speech (in the U.S. of course no Oz) but barring music for being too loud or causing a disturbance would not as it's a time and place and not a content restriction on Speech.

Thank God! About time we cracked down on this whole "music" thing. Cause I was driving in my car ealier and heard some dude next to me playing Me and Julio Down by the Schoolyard! The nerve! Did you know that those lyrics can be interpreted as two gay kids making out!? Oh how I wish there were a couple of police officers right there to arrest that guy's ass. It would be nice to see the police finally using our tax dollars properly!

And now some of you are going to have to buy new sarcasm detectors, sorry for shorting them out like that.

These officeers clearly are in violation of Human Rights, Freedom of Expression, by their acts.

The article mentions that his mom posted a note on the rapper's MySpace page which included:

First, they had no legal probable cause to have "stuck their head in his half-open window".  These officers are clearly Anti-Human Rights, Anti-Freedom of Expression, and should not only be called out as the fascists violators of Human Rights that they are, but should be terminated from their jobs and arrested, tried, convicted, and sentenced for the crime of violation of Human Rights in the performance of their official duties.

Secondly, claims that such lyrics lead listeners to disrespect others, including women, have just been PROVEN false and fraudulent (fraudulent in the sense that such claims have been lies and deceit for the purpose of depriving others of their Human Right to Freedom of Expression) by the very statement in the note his moter posted:  "...he saw me (his mum) coming out of the local supermarket with shopping bags and left his car running and music playing to help me with my bags ...".  Let those who continue to make such false claims be condemned, recognized as liars, deceivers, and morally bankrupt and attempting to mentally molest others, including children, into believing that lies, deciet, dishonor, and a lack of ethics are "moral".

These officers, and any of their supporters, should find their faces and identities spread across the world to be recognized as violators of Human Rights and to be recognized as being without honor, ethics, or morality.

Whether Australia has laws protecting Freedom of Speech/Expression is, in fact, irrelevant because Freedom of Expression is recognized as a Human Right, even at the international level.

The UN's Universal Declaration of Human Rights recognizes Freedom of Expression, Article 19, as a Human Right.  A number of nations have already signed and ratified the Declaration.  At last report, the US signed, but had not yet ratified the Declaration.

As already pointed out in the article, their reason for arresting him WAS NOT because it was too loud but because the fascists, after having stuck their heads into someone's car without authorization or probable cause, felt the lyrics were offensive to THEM, and so, in true Anti-Human Rights fascist fashion, arrested the teen.

Just because they had to trump up a fake charge doesn't mean we should ignore their openly stated TRUE motivation.

Loud music in public is NO different than loud protest or loud worship to an "imaginary friend" in the public square.  Only fascists dictate that one type of speech is acceptable and all others are not.  Either ALL speech that can be heard by others in a public square can lead to an arrest or NO loud speech in a public place can lead to an arrest.

And what makes you the fascist is the attempt to circumvent Freedom of Expression by hiding behind the argument of "loud".

I don't think a store's parking lot counts as a "public square" but in essence I agree.  You don't arrest people for the type of music they listen to.

Last time I checked, we allowed adults to play adult-themed games here in America, as well as allow adults to listen to music with questionable lyrics.

In the interest of accuracy, I'd have to say "It's America, if they were anymore backwards or conservative, they'd be in Australian politics!"

I didn't read the source article but nothing in GP's story suggests the cops stuck their head in the car in order to hear the lyrics clearly.  They could have just as easily stuck their heads in because the kid inside wouldn't be able to hear them over the music otherwise.

Having read the source article now, it could be construed from the mom's comments that the kid was not in the car and the cops had to stick their heads in to hear the lyrics clearly.  If that's actually the case (I doubt it but who knows) then yes, noise wasn't the issue.  Of course, that's pretty clear based on the charge.  The volume, whether excessive or not, doesn't seem to factor into it.

According to Zip, the mom said that the kid wasn't even in the car, because he was helping her with groceries, and that they stuck their head inside the car.  If that's the case, how do you explain that?

If that's actually what happened (which doesn't sound likely but who knows) then yes, the issue wasn't noise pollution.   Either way, I think the most telling thing is the fact that the kid was charged with "offensive behavior for listening to music" instead of something that would indicate the music was too loud.  Andrew Eisen

So says the mom.  And as I've said in at least two other places now, if the cops had to litterally stick their heads in the car to even hear the lyrics clearly (sounds unlikely but who knows) then, yeah, noise truly isn't the issue.  And looking at the charge, noise (whether it was excessive or not) wasn't the issue anyway.
