SCEA Fighting PS3 Jailbreak in America

Sony is taking the fight against PS3 jailbreak mod chips to America. While Sony battles a PS3 jailbreaking device in Australian courts, SCEA is taking reseller Zoomba LDC to task in the California Northern District Court for attempting to sell the new PS3 Jailbreak mod chip via SHOPPSJAILBREAK.com. The PS3 Jailbreak allows users to circumvent the PlayStation 3's copy protection and play games installed on the console's hard drive.

 

SCEA filed a lawsuit in the California Northern District Court on Tuesday, accusing Zoomba of copyright infringement, violations of the digital millennium copyright act and trademark infringement. SCEA seeks an undisclosed amount of damages and an injunctive relief, to block the sale of the device.

Here's a description of the device in question taken from SHOPPSJAILBREAK.com:

The PSJailbreak Modchip allows you to store games on your PS3 and play them when you please without having to insert the original Blu-Ray disc game. Using the PSJailbreak Modchip instantly allows you to play and store backups on your Playstation 3. Those who circumvent copy protection aren't ALWAYS looking to steal games. In many cases it's simply to create a backup copy.

Right... a "backup" of the games they recieved from Gamefly/Blockbuster right?  Perhaps a backup of the torrent they downloaded the night before?  Sure there are some people who don't use homebrew for piracy but the majority do it for free games.  How many people do you think bought R4's or installed CFW on their PSPs and have never downloaded a rom or ISO?

It doesn't matter.

Piracy is already illegal.  Prosecute the pirates, not the legitimate users.

Devices shouldn't be banned because they have the POTENTIAL for piracy.  I have a scanner and a printer hooked up to my computer right now; I use them for legitimate purposes but could use them for illicit ones.

Their right to circumvent copy protection to play thier back ups on a backup unit that can not go online, yes.

 

Piracy is secondary, like murder and guns just because a tool can be used to kill does not make that tool irredeemable.

Basically because it's unlocking what the device should truly be capable of.
