Report: SCOTUS To Issue One Opinion This Week

SCOTUS Blog's THIS WEEK AT THE COURT says that the court will issue at least one opinion this week (on Tuesday), while a note on Greta Van Susteren's Gretawire blog claims that court watchers should keep an eye out for opinions on a number of cases including Schwarzenegger v. Entertainment Merchants. The note comes from Lee Ross, who covers the Supreme Court for FOX News.

Snyder v. Phelps Westboro Church funeral protest Schwarzenegger v. Entertainment Merchants California's Violent Video Game ban
Arizona Christian School Tuition v. Winn Arizona tax scheme related to private school vouchers
Schwarzenegger v. Plata Judicial order forcing California to reduce its prison population
Chamber of Commerce v. Whiting This is the Arizona immigration case cracking down on employers who knowingly hire illegals

I heard the Court will be issuing opinions both today and tomorrow. Either way, it still seems a bit early for this case-we'll probably get a decision on Snyder before we get EMA.

Unless SCOTUS decides to release both the Snyder and EMA decisions and opinions at the same time.

That is possible.  they'll probably be close in timeline at any rate, as there is *some* (but of course not perfect) overlap in the issues in the 2 cases.  and of course they were argued only a few weeks apart as I recollect.

About a month apart. Snyder v. Phelps was one of the first cases they heard oral arguments this term, and Schwarzenegger v. EMA was in the first week of November.

being ignorant in the legal system, this opinion seems to be an official statement (rather than just, you know, an off hand opinion).

Is this just a little preview in how the discussion is going, or is this the final word of the court?

My understanding, which when it comes to the American legal system is in no way complete, is that this is the final word of the court.  Saying it's the court's "decision" may be a bit more clear than saying it's their "opinion".  Though I believe opinion is the technically correct word.

So I just watched the SCOTUSblog and I guess Shwarzennegar v. EMA wasn't decided today.  Is that correct?

I agree But like beardoggX said, given that the court found that it's vague and that it may offend the 1st amendant rights of adults, I doubt it will pass constitutional Muster

What did they say about the first amendment rights of adults again? Its been a while since I read it. I know it would mean stores could stop selling these games to anyone of any age but I don't think they talked about that.

That is the slippery slope argument. Because of the vagueness of the "graphic violence" section, just about any game could potentially fail the test and be regulated, but noone will know for sure until someone complains. This would eventually result in game stores "playing it safe" and refusing to stock any game that they feel could result in a fine for a mistake.

To add to that, it could also result in publishers "playing it safe" by not funding such projects and developers "playing it safe" by not creating them.
