Video games retailer GameStop faces a lawsuit filed by a former employee who claims that employees who endured constant security checks during breaks and meals were not properly compensated for the time it took. GameStop has a policy of conducting mandatory security checks on employees when they take breaks or finish a shift. The lawsuit filed in California isn't about privacy or employee dignity, but about the amount of uncompensated time it takes.
The main thrust of the allegations is that GameStop failed to provide employees with uninterrupted, unrestricted breaks for meals and rest periods. According to California law (and in most other states, for that matter), employers must afford employees a 30-minute meal break per five hours worked as well as a 10-minute rest break per four-hour shift.
The suit also makes other claims such as uncompensated time spent undergoing security checks, no compensation for work shifts that exceed eight hours, as well as not providing accurately itemized wage statements. In addition to seeking class action status, the suit seeks an hour's worth of pay for each day in which "adequate meal and rest breaks were not provided," as required by California law. The suit also seeks any other damages as determined by the Court.
