EA Spanked for Misleading Wii Game Commercial

Electronic Arts needs to be more truthful in its advertising, according to a British goverment agency.

As reported by gamesindustry.biz, the UK's Advertising Standards Authority rapped EA's knuckles for including Xbox 360 footage in a commercial for the Wii version of Tiger Woods PGA Tour 09

From the gi.biz story:

The ads featured the sportsman swinging a Wii remote, but showed Xbox 360 gameplay footage at the same time, giving the wrong impression of the visual quality of the Nintendo version of the game. The publisher explained to the ASA that footage of the Wii game "would not be of broadcast quality" and had included text in the ad that the game was available on multiple formats in an effort to avoid confusion.

The ASA wasn't buying EA's explanation, however:

"Although we acknowledged that the message 'available on all formats' appeared in the final scene, we considered that viewers would infer from the ad that Tiger Woods was playing the game on a Wii console and the graphics shown behind him were representative of the actual game he was playing," said the watchdog.

 

"Because viewers would not be able to achieve the graphical quality shown in the ad on a Wii console, we concluded that the ad was misleading."

Bottom line? EA can't show the commercial for the August release again - not that they were planning to.

New Jersey Senate Leader Teams with ESRB for Ratings Awareness Commercial

New Jersey State Senate President Richard Codey (D) has teamed up with the ESRB on a public service announcement designed to remind parents about video game content ratings.

Timed to coincide with the holiday shopping season, the PSA will air on local television and radio. Codey and ESRB President Patricia Vance unveiled the new campaign during a press conference at the Statehouse in Trenton yesterday.

In addition to his long service in the State Senate, Codey also served as New Jersey's interim governor after the 2004 resignation of James McGreevey.

Of his involvement with the ESRB, Codey said:

As a father, I know parents face tough decisions these days about the media they allow into their home. There’s simply no substitute for parental involvement and responsibility, and it’s important that parents play an active role in choosing games for their children. With the ESRB ratings, parents don’t have to feel like a Scrooge if their kids want a game that’s not appropriate for their age. The ESRB is a great resource that provides plenty of tools for parents to determine if a game is appropriate or to find a suitable substitute...

 

While many parents are aware of the ratings, and are making sensible game purchase decisions as a result, there is always more that can be done to raise awareness. Working with ESRB, we hope that these ads will help arm parents with the information they need to make the right choices about the video games they deem appropriate for their children and families.

Vance added:

Video games are no different than movies and TV shows in that they are created for a diverse audience of all ages. That is why it is so important that parents remember to check the rating when purchasing games for their children. I’m pleased to be joining Senator Codey in announcing this effort to reach out to New Jersey’s parents and educate them about the ratings.

Also on hand to support the campaign was Diane Zierler, president of the New Jersey Parent Teacher Association.

GTA IV Ads Back on Chicago Buses, But Future M-Rated Game Ads Banned

Shortly before the April 29th Grand Theft Auto IV launch, the Chicago Transit Authority pulled ads for the game from its vehicles and facilities. Prompting the move was a rash of unrelated shootings in Chicago and a Fox News hit piece that linked GTA IV to the violence, even though the game hadn't yet been released.

Just a week later, Take-Two warmed the hearts of censorship opponents by suing the CTA in U.S. District Court for breaching its $300,000 contract. The case dragged on through the summer, but in late September GamePolitics reported that the parties were nearing a settlement.

Chicago Breaking News is now reporting that, as part of that settlement, GTA IV ads will appear on CTA buses for the next six weeks, which should give T2 a little boost for the holiday season. CTA spokesperson Noelle Gaffney explained:

The CTA made the earlier decision to remove the ads from the system following some violence in the city. The CTA felt that, based on the circumstances, it was in the best interest of our customers to remove the ads and further review the circumstances.

But wait - the CTA dropped some discouraging news as well, saying that it will accept no further ads for M-rated games once it works off its GTA IV debt. Here, the agency employs some highly questionable - read: highly political - logic:

Last week, the CTA board voted to ban advertising for video games rated "M" and above. The ordinance, which takes effect Jan. 1, cites a "demonstrable correlation" between intensely violent video games and violent or aggressive behavior.

Thus, Chicago joins Boston among major U.S. cities in which public transit systems will not accept M-rated game ads. Miami also yanked its GTA IV ads after now-disbarred attorney Jack Thompson raised a stink.

GP: Even though many M-rated games are fantastic examples of the creative arts, the transit agencies are essentially equating such games with smut. The industry needs to stand up for itself on this issue. Take-Two was right to sue the CTA over its GTA IV case, but the larger ban on M-rated games in general needs to be addressed by the ESA.

Beijing Billboard Urges Chinese to Drop the Hammer on Piracy

Due to rampant IP piracy, the video game market in China is largely centered around subscription-based online games.

But the Beijing government has apparently taken notice of complaints by the United States and other nations over copyright violations. Hence this government billboard, found in the city's Haidian District. It reads, "Strike Hard at Piracy."

The billboard image is included in a roundup of Chinese public advertising compiled by the Transnational China Project at Rice University.

Bill O'Reilly Whines About Heidi Klum's Guitar Hero Commercial

On Fox News program The O'Reilly Factor, pundit Bill O'Reilly tries to drag Heidi Klum's Guitar Hero commercial into the culture wars, but even his two conservative female guests don't want to go there.

At issue is Heidi's Risky Business-inspired Guitar Hero shredding routine. O'Reilly is apparently concerned about the the moral effects of the commercial, featuring a lingerie-clad Klum, airing in prime time.

Then again, O'Reilly has never been much of a fan of video games. Or iPods. Or Blackberries. But Mr. Morality does enjoy a good loofa.

Japan's Most Wanted: Fugitive Murder Suspect Pictured in Game

Japanese game company Famista will place the picture of a fugitive murder suspect in an upcoming PC game.

Sky News reports that Tatsuya Ichihashiis (far left) is wanted for the sadistic murder of Lindsay Hawker, a 22-year-old English tutor. Her body was found in the suspect's apartment in March. The young woman had been bound, strangled, and beaten over the course of a 36-hour ordeal.

Ichihashi's face, along with those of other wanted men, will appear in a slot machine game. Hitting the jackpot will reveal detailed information about the fugitives and explain how to report tips. Famista spokesperson Takashi Saito commented:

We thought this could be a new way to contribute to the community. There are many internet sites that display photos of those on the wanted list, but they are not necessarily visited frequently. By mixing it with entertainment, we thought we could make some contribution to the police efforts.

UPDATE: Sky News is now reporting that the family of victim Lindsay Hawker is upset about Famista's  plans to include information about her murder in the game. Julia Hawker, Lindsay's mother, said:

We have not been consulted about this - the first we heard about it was through the Sky News website and we are not happy about this. We have contacted the Foreign and Commonwealth Office and have asked them to contact the Japanese Police to find out what they know about it and why we have not been consulted.

I also want to know if this is a commercial venture, as if it is, then it is in extremely poor taste. The whole thing is distasteful and not befitting Lindsay's memory.

The family has established a website devoted to finding Lindsay's killer.

UPDATE 2: Big in Japan identifies the Famista offering as Slot Detective, a Pachinko-style game:

Famista have tried to justify the release of this machine by saying it is providing a valuable social service. This game, playable online, through your mobile phone or in pachinko parlours, will give information about the wanted people if you get a jackpot, the crimes they are suspected of and what to do if you see them (probably something along the lines of, “Just have one more gamble before you report them”).

Is GameStop Lich King Ad Really Supposed to Read This Way?

So, GP just cruised over to GameStop's website to grab a couple of box shots for the EA lawsuit article, and our gaze immediately fell up this ad for the upcoming WoW expansion, Wrath of the Lich King:

The Lich King, full of anger, vexation and, some might even say, wrath, brings a dark threat to Azeroth.

 

This expansion opens up the Lich King's icy domain of Northrend, with the Borean Tundra, where the Packers play, and the Howling Fjord, which is what you get when you drive with the windows of your Taurus cracked open.

GameTrailers Editors Go OFF on ESRB over Fallout 3 Trailer Removal

In unusually strong language, the editorial staff of video site GameTrailers.com has condemned the ESRB for forcing the removal of Fallout 3 trailers last week.

The comments were made in a podcast released Friday. GameTrailers editor-in-chief Shane Satterfield (left) and staffer "Grumpy" ripped the ESRB which, in addition to rating game content, enforces the industry's advertising standards.

The segment on the ESRB starts just after the 26-minute mark of the podcast. Here's a sample:

Shane: You may wonder why all the trailers ever released for Fallout 3 were removed from GameTrailers.com. Well the reason that happened is because of our good pals at the ESRB.

Grumpy: Wankers! ...I am just absolutely flabbergasted about the ESRB. They're a bunch of bleepwads sitting in Washington.

Shane: Hear, hear!

Grumpy: ...they get publishers to pull video footage. They assisted in getting the Fallout 3 ads taken out of Washington because some dumb bleepwit... on a bus got upset that they were showing images of decimated Washington...

Shane: Never watched a movie before!

Grumpy: Exactly. It's a futuristic, post-apocalyptic game. I am so sick of this nanny state... they are not a government organization. They are a body made up of unqualified nincompoops... unfortunately, they're taking the nanny state to the nth degree... They make the FCC look like a bunch of broad-minded, non-censorship individuals... It sucks that Bethesda had to pull all this Fallout 3 stuff, because it was bleeping good media...

Shane: All age-gated...

Grumpy: ...nobody could get at it. But because some little toe-rag at ESRB decides to get pissed off about something, all that good work is gone... Good job, Bethesda. It sucks that they have to kowtow to the ESRB...

Shane: I hate the ESRB... The week before that we had gotten an exclusive on a trailer... suddenly we get a call... and the publisher is telling us to take it down because of the ESRB... The ESRB can only regulate media that the publishers send us. Anything that we create in-house, as GameTrailers, they can't touch... we'll make our own violent-as-hell trailer that they can't do anything about. So we did. We put it up, it was huge... then we get a call from publisher X [who said] "...the ESRB is putting pressure on us and so that bleep is going to run downhill to where we can't work with you guys unless you do what the ESRB says" ...they are like the frickin' Mafia... These people have totally gone like a frickin' power trip...

PETA Tosses Sega a Bone After Samba de Amigo Ad is Yanked

People for the Ethical Treament of Animals (PETA) has said "good boy!" to Sega after the publisher pulled a Samba de Amigo ad which featured a live chimp.

Why is that a big deal? PETA explains:

After learning that SEGA used a real chimpanzee in an online video promoting Samba De Amigo... we contacted the company.

We explained how involuntary chimpanzee "actors" are taken away from their mothers when they are just a year or so old and forced to perform confusing and repetitious tricks. We also explained some of the horrible methods that chimpanzee "trainers" use, such as electric shocks with shock collars and prods, isolation, beatings with sawed-off pool cues and slapjacks, and food deprivation. Then, at the ripe old age of just 8, the chimpanzees reach puberty and their showbiz careers are over—and they end up being dumped at dismal roadside zoos or sold to laboratories for experimentation.

Faster than you can mangle a Metallica song on Guitar Hero, SEGA pulled the video from its site and promised to keep all great apes out of its ads!
