Delaware Passes Law to Give Heirs Rights to Digital Property

Delaware has become the first state in the US to enact a law that ensures families’ rights to access the digital assets of loved ones during incapacitation or after death. Last week, Delaware Gov. Jack Markell signed House Bill (HB) 345, "Fiduciary Access to Digital Assets and Digital Accounts Act," which gives "heirs and executors" legal authority to take control of a digital account or device, according to Ars Technica.

Delaware Court Rules That Vivendi Can't Invoke French Law in Activision Shareholders Lawsuit

A Delaware Court has ruled that Vivendi cannot invoke a French law to avoid discovery in a lawsuit filed by shareholders over its stock deal with Activision. Activision announced on July 26, 2013, that Vivendi had agreed to sell back 85 percent of its majority stake for $8.17 billion. Vivendi owned 61 percent of Activision stock but allegedly owed more than $17 billion to its creditors, and desperately needed cash.

Delaware Supreme Court to Hear Appeal of Shareholder Lawsuit Against Activision Blizzard

Activision Blizzard will take its fight against shareholders trying to block a deal to become independent from majority stakeholder Vivendi before Delaware's Supreme Court next month, according to Reuters.  Lawyers for the company hope to overturn a lower court's surprise decision earlier this month to halt the video game company's planned $8.2 billion deal with French media conglomerate Vivendi SA.

Delaware Passes Bill Approving Online Gambling

The state of Delaware has decided to legalize online gambling today. The Delaware State Senate approved the bill by a 14-6 vote to allow online betting in the state. The next stop for the bill is the desk of Gov. Jack Markell (D) for his signature. With state and local governments seeing growing budgets and shrinking revenue, they have warmed up to the idea of allowing gambling both in their cities and online. The law is the second in the country to approve online gambling on a state level.

If CA Wins, DE Pol Primed to Introduce Similar Legislation

A trickle down effect is one of the game industry’s biggest fears if the Supreme Court does eventually rule in favor of California in Schwarzenegger vs. EMA, and one politician, known for her anti-game legislation attempts in the past, is chomping at the bit for just such an opportunity.

Delaware Representative Helene Keeley (pictured), a Democrat, attempted to introduce legislation in 2006 that would have placed violent videogames under her state’s obscenity statute. Her efforts sailed through the House, but failed to pass the Senate.
