Lead Counsel In SCOTUS Violent Games Case Lays Out Arguments

The lead counsel for the video game industry in the upcoming Supreme Court fight against California’s proposed violent video game restrictions outlined the problems with the state’s legal arguments in a recent public appearance.

Speaking at an intellectual property forum at Chicago-Kent University last week, Jenner and Block LLP Partner Paul M. Smith said that no matter how a state defines "extreme" violence in such laws, they will run into constitutional problems with vagueness.

"I've litigated nine cases in a row where states have tried to define the category nine different ways – and they always lose when they make this case because violence is considered a perfectly appropriate and normal part of what we give our kids to see starting from a very young age," he said.

John Carmack Talks More About Facebook Acquiring Oculus VR

Last week former id Software programmer and founder had very little to say about Facebook acquiring the company he recently joined (save that having some financial backing would help them avoid future scaling issues).

But over the weekend, Carmack responded to a post on the blog of Peter Berkman, detailing why he thinks Oculus VR being owned by Facebook isn't such a bad thing. Carmack sympathizes with fans who wanted Oculus Rift to follow a model similar to what Valve did with Steam, he says that virtual reality is too significant a technology to remain at that level.

CCP Games Will Continue to Support Oculus Rift

While some developers like Mojang say that they will no longer pursue plans to support Oculus Rift after Facebook announced that it would acquire the virtual reality technology last night for $2 billion, others are saying that they will continue to support the device. One of those developers is Eve Online developer CCP Games. The company tells Eurogamer that it still plans to launch its space combat game Eve: Valkyrie for the consumer version of Oculus Rift, whenever that comes out.

Mojang Won't Support Oculus Rift After Facebook Deal

Hot on the heels of Facebook announcing that it would acquire Oculus, Minecraft maker Mojang announced that it has canceled talks to support the technology in its popular world building game. Mojang's Markus "Notch" Persson said that he is canceling talks for an upcoming official version of Minecraft for the Oculus Rift.

"We were in talks about maybe bringing a version of Minecraft to Oculus," Persson tweeted shortly after the announcement on Tuesday. "I just cancelled that deal. Facebook creeps me out."

Facebook to Acquire Oculus for $2 Billion

Facebook announced this afternoon that it would purchase VR headset maker Oculus for $2 billion with a combination of cash and stock. The company will pay $400 million in cash and 23.1 million shares worth about $1.6 billion. Oculus employees will also eligible for an additional $300 million if the company achieves certain targets.

"This is a long-term bet on the future of computing," said Facebook Chief Executive Mark Zuckerberg Tuesday on a call with analysts. "I believe Oculus can be one of the platforms of the future."

NSA Denies Any Activity Related to Facebook.. Via Twitter

Earlier this week it was revealed (through documents from Edward Snowden's cache of NSA internal documents) that the National Security Agency planned to infect millions of computer systems using sophisticated malware. This would allow it to pose as Facebook and other sites in order to intercept data. Today the agency is denying the information in those documents. The agency said today that it does not pose as any U.S. companies and that "what it does is legal."

Zynga Settles With 'Bang With Friends' Maker

King.com Sues 6waves

Candy Crush developer King.com has filed a lawsuit against mobile developer 6Waves, alleging that the company has "blatantly" infringed on two of its games, Pet Rescue Saga and Farm Heroes Saga. The lawsuit, which was in the U.S. district court in San Francisco today, claims that 6Waves copied the color scheme, puzzle design, and UI elements for its games Treasure Epic and Farm Epic.

Zynga Abandoning Online Real Money Gambling Space

Zynga is in a bad spot. New information revealed through an earnings statement filed Thursday with the Securities and Exchange Commission (SEC) shows that the social game maker has lost a lot of daily active players and had a substantial loss in Q3 2013. In its filing Zynga reported that the number of daily average users (DAU) dropped from 52 million to 39 million in the quarter. This is the lowest number of daily active users since the company started tracking those numbers. Roughly 25 percent of its daily user base has stopped playing Zynga games in a single quarter.

Facebook Bans 'Social Roulette' App

Facebook has blocked an app that lets users play a game of "Russian Roulette" with their Facebook account. The social suicide game was a little too over the top for Facebook, apparently. Like the real-world game involving a gun with one bullet in it, the app gives participants a one-in-six chance of deleting their Facebook account. Social Roulette was brought to the attention of Facebook by an automated system that deals with "negative user experience."

EA Shutting Down The Sims Social, SimCity Social and Pet Society in June

Electronic Arts announced this morning that it is shutting down three games operated by its Playfish Facebook game development studio. Facebook Brings Big Numbers to GDC

Facebook was at the Game Developers Conference today in San Francisco throwing around a lot of facts and figures to show that it is still a popular and relevant gaming platform. The company said that over 250 million users are still playing Facebook games each month, accounting for around 20 percent of the social network's daily traffic. Facebook also claims that over 100 game makers generated over $1 million (each) or more last year. Collectively game developers earned over $2 billion in payouts.

Zynga Discontinues 11 Games to Cut Costs

Zynga will shut down a total of 11 of its social games as it finds new ways to cut costs to fulfill the cost reduction plan announced by CEO Mark Pincus in November of this year. FTC Updates Child Online Safety Regulations to Deal with Social Networks, Apps

Square Enix Deploys, Then Pulls Questionable Hitman Absolution Facebook App

In what has to be a record take-down of a questionable piece of marketing, Square Enix pulled a Facebook app promoting Hitman Absolution two hours after it was deployed after a scathing report from Rock, Paper, Shotgun. The company later apologized for the app. The trouble began after RPS wrote about how "Hire Hitman" app allowed users to target and assassinate their Facebook friends, complete with death threats to your intended target.

Zynga Vice-President of Business Development Resigns

Zynga's VP of business development has resigned, joining a long list of high level executives that have left the social game maker to find greener pastures. According to an AllThingsD report, VP of business development Jonathan Flesher left the company on November 9.
